The following comments need to be addressed prior to approving the plans and issuing a permit: 1. SW 342nd Street is classified as a minor residential collector. The proposed street frontage improvements do not meet current city code requirements. The street frontage improvements need to be' revised to include widening of pavement to 20 feet from centerline, curb and gutter, 4 foot wide landscape/utility strip, 5 foot wide sidewalk, street trees planted at 45 foot o.c., street lighting, undergrounding of all utilities, and all necessary tapers and transitions. See the redlined plans for additional clarification. 2. Provide topographic survey of the existing roadway (SW 342nd Street) and provide elevations for proposed curb and gutter and proposed longitudinal and transverse elevations and grades for roadway. 3. Proposed driveway curb cut locations need to be shown and be incorporated into the street improvements to eliminate the need to remove and replace curb and gutter at the time of constructing a home on each lot. 4. Core Req. #2 "Off-site Analysis" submitted does not adequately address that the proposed development neither aggravates (increases the magnitude, frequency, or duration of) nor creates a new drainage problem. The City has documented downstream flooding at the intersection of SW 340th Street and 35th Ave SW (the headwaters of the east tributary of 7oe's Creek basin). Under existing land use conditions, flooding/unacceptable surcharging occurs during 25- and 100-year storms. Revise the downstream analysis to address these issues and determine the need for additional mitigation. • I 5. Core Req. #4 "Conveyance System" analysis submitted is not adequate. Provide documentation indicating peak flow from the upstream Olympic Plains Detention facility. Provide conveyance calculations for the 100 year peak rate of runoff and determine whether or not surcharged conditions exist. If overtopping of drainage structures exists, the provisions of King County Surface Water Design Manual (KCSWDM) section 1.2.4 shall be addressed. 6. The Core Req. #6 "Maintenance and Operation" requirement is a necessary part of the maintenance portion of the infiltration system drainage easement. KCSWDM Appendix A, Section nos. 2, 10 and 12 ("Infiltration", "Conveyance Systems", and Access Roads/Easements respectively) shall be incorporated into the T.I.R. M. & O. Section. 7. Core Req. #7 "Bonds and Liability." Prior to issuance of any building permit, the on-site and off-site improvement work must be secured by a financial guarantee. The guarantee may be in one of three forms, a cash deposit, assignment of funds in a financial institution, or a bond from a surety. The bond is for 120% of the estimated construction cost. The applicant's engineer prepares the estimate using bond quantity worksheets available from the Public Works Department (copy enclosed). The bond must be completed and on file with the City when the building permit is issued. Complete the enclosed "Bond Worksheet" and return to the City. We will prepare bond for your execution. At the completion of construction and after the city receives payment of inspection fees, receives as-built mylars, and all the inspector's punch list items are completed, the bond will be reduced to 30% of the original value and be retained for a two year maintenance period. Any defects that show up during the maintenance period will require correction and subsequent inspection fees shall be paid before the maintenance portion of the bond will be released. 8. Specify overflow quantity from Olympic Plains Detention facility. Provide conveyance calculations to consider the 100 year peak rate of runoff and determine whether or not surcharged conditions exist. If overtopping of drainage structures exists, the provisions of King County Surface Water Design Manual (KCSWDM) section 1.2.4 shall be substantiated. 9. Pursuant to KCSWDM section 4.5, a single roof downspout system can serve up to 5000 square feet of roof area. Your development proposes a single system to serve approximately 8640 square feet. As a result, either revise proposal to include separate lot infiltration systems or provide "Maximum Infiltration Rate Testing" , as described in KCSWDM sec. 4.5.2, to substantiate the soil classifications and rate used for design. 10. Specify overflow path for proposed infiltration system. Note that the proposed infiltration system is provided for the discharge of roof and footing water only. It is not provided to receive runoff from any surfaces that could transport sediment or pollutants such as paved driveways, without pre-treatment. Additionally, the infiltration system is not currently designed to include driveway impervious areas. Specify how driveway drainage will be controlled and treated. .J ' 11. The property owner shall provide a storm drainage easement to the City of Federal Way for the proposed storm drain line running north from SW 342nd Street to SW 340th Street, across lots 83 and 84. 12. Provide a typical trench detail on the plans for storm pipe installations. 13. Show proposed final grading for all lots and indicate cut and fill quantities of all sitework. 14. THIS FLOW RATE ALONG WITH THE FLOWS GENERATED FROM THE CONTRIBUTING DRAINAGE BASINS WERE USED TO SIZE THE CONVEYANCE SYSTEM. 3 . THE PROPOSED IMPROVEMENTS FOR THIS DEVELOPMENT WILL GENERATE NEW IMPERVIOUS AREA THAT IS LESS THAN 5, 000 SF AND THEREFORE IS EXEMPT FROM ONSITE PEAK RATE RUNOFF CONTROL, PER KCSWDM PAGE 1 .2 .3-5 . 4 . EACH LOT WILL BE TIGHTLINED TO THE SYSTEM WITH PRIVATE DRAINAGE EASEMENTS AS SHOWN ON THE DESIGN PLANS . 2 2. SEVEN CORE AND TWELVE SPECIAL REQUIREMENTS CORE REQUIREMENTS - (1) DISCHARGE AT NATURAL LOCATION: THE ENTIRE SITE SLOPES TO THE NORTH. SURFACE WATER RUNOFF FROM THE ONSITE AREA AS WELL AS CONCENTRATED FLOWS FROM THE NEWLY CONSTRUCTED DITCH THAT CARRIES OFFSITE DRAINAGE THROUGH THE SITE DISCHARGES CURRENTLY TO THE NORTH. THE STORM DRAINAGE DITCH THAT BISECTS THE SITE WILL BE REMOVED AND THE DRAINAGE WILL BE INTERCEPTED AND ROUTED AROUND THE SITE TO THE NORTH INSTEAD OF THROUGH THE SITE. THE REMAINDER OF THE SIGHT WILL CONTINUE TO DISCHARGE AT THE NATURAL LOCATION. (2) OFF-SITE ANALYSIS : TASK 1 : SEE THE ATTACHED DOWNSTREAM PLAN (1" = 50' ) FOR REFERENCE. TASK 2 : FEMA MAPS WERE REVIEWED AND NO EVIDENCE OF FLOODWAY WAS IDENTIFIED. SENSITIVE AREA FOLIO SHOWS THE SITE IS NOT WITHIN ANY SENSITIVE AREA. SOIL ARE ESTIMATED TO BE ALDERWOOD. TASK 3 : FIELD INSPECTION OF PROPERTY 1) UPSTREAM - THERE IS AN UPSTREAM BASIN FROM OLYMPIC PLAIN SUBDIVISION THAT CONTRIBUTES 2 . 66 CFS TO THIS PROPERTY. ALSO SHEET FLOW DRAINAGE FROM THE EXISTING FRONTAGE STREET ALSO ENTERS THE PROPERTY. THE PROPERTY IS BOUNDED TO THE EAST AND WEST BY DEVELOPED HOMES AND TO THE NORTH BY A GRASSY FIELD. 2) ON-SITE - THIS DEVELOPMENT WILL INSTALL AN INFILTRATION SYSTEM AT THE NORTHEAST CORNER OF THE PROPERTY TO HANDLE ALL THE FLOWS GENERATED FROM THE ROOFS . THE RECENTLY CONSTRUCTED "V" DITCH THAT BISECTS THE PROPERTY WILL BE REMOVED. 3) DOWNSTREAM - IMMEDIATELY TO THE NORTH OF LOTS 78-83 IS A GRASSY FIELD THAT APPEARS NOT TO BE LACKING MOISTURE BASED ON THE GREENNESS AND HEIGHT OF THE VEGETATION. THE DRAINAGE DITCH THAT BISECTS THE PROPERTY IS CONTRIBUTING TO THIS DOWNSTREAM AREA. THE DITCH WILL BE REMOVED AND FLOWS DESIGNED TO BYPASS THIS PROPERTY. THE DITCH IS SO RECENTLY CONSTRUCTED IT IS DIFFICULT TO SAY THAT NO SIGN OF ANY OVER TOPPING OR UNNATURAL/DETRIMENTAL SCOURING OR SEDIMENT DEPOSITS WERE OBSERVED. BY OBSERVING THE UPSTREAM DETENTION POND AT OLYMPIC PLAIN SUBDIVISION IT APPEARS THAT NOT MUCH FLOW IS FEEDING THIS DITCH. (3) RUNOFF CONTROL: THIS SIGHT IS EXEMPT FROM PEAK RATE RUNOFF CONTROL BASED ON THE IMPERVIOUS AREA CREATED BEING LESS THAN THE 5, 000SF THRESHOLD ESTABLISHED BY KING COUNTY SWM. 3 (4) CONVEYANCE SYSTEM: WE WILL INSTALL A CATCH BASIN OVER THE EXISTING 12 INCH CONC. PROJECT SITES: Lots 78-82 of Centennial Estates. DATE OF EVALUATION: June 23, 1995. A soils evaluation was performed at the above sites. One test pit was excavated approximately 30 feet south of the north property line, in the middle of each lot. Soil textures and water table conditions were determined by field analysis. The results of the evaluation are as follows: Soil textures -LOT 78: 0-2" gravelly, slightly compacted, gray, sandy loam fill; 2"-20" gravelly, loose, orange-brown sandy loam; 20"-39" gravelly, slightly cemented, gray fine sand; 39"-91" very gravelly, loose, gray medium sand with trace of fine sand. -LOT 79:0-24" gravelly, compacted, gray sandy loam fill; 24"-30" dark brown loam; 30"-49" gravelly, loose, orange-brown sandy loam; 49"-60" gravelly, slightly cemented, gray-orange, faintly mottled loamy sand; 60"-80" very gravelly, slightly cemented, gray, faintly mottled medium sand; 80"-100" loose,gray medium sand. -LOT 80:0-24" gravelly, compacted, gray sandy loam fill; 24"-39" gravelly, slightly compacted, orange-brown sandy loam; 39"-49" gravelly, loose, orange-brown sandy loam; 49"-77" gravelly, moderately cemented, gray-orange, faintly mottled fine sand; 77"-96" gray-orange,distinctly mottled silt loam. -LOT 81:0-16" gravelly, compacted, gray sandy loam fill; 16"-22" dark brown loam; 22"-36" gravelly, loose, orange-brown sandy loam; 36"-96" very gravelly,moderately cemented, faintly mottled medium sand. Water table conditions Water table conditions in the test pits appeared to vary. The test pits on Lots 78 and 79 may have a perched water table above their respective cemented horizons due to the extremely low permeability of cemented soils. However, there was no evidence of seasonal water table below these horizons. Therefore, based on the loose consistency and absence of cementation that exists in the horizons below, it is likely that a seasonal water table does not exist from below the cemented horizons to at least the excavated depth of the test pits. The test pits on lots 80, 81 and 82 likely have seasonal water tables at no more than 49, 36 and 22 inches respectively below the surface,based on observed cementation and mottling. Rocky R. The City will grant a Final Inspection conditioned upon Rutel's agreement to either construct the Improvements or pay a pro rata share of the cost of designing and constructing the Improvements pursuant to the terms of this Agreement. Terms of the Agreement NOW, THEREFORE, the Parties agree as follows: 1. Installation. In the event Rutel elects to install the Improvements, Rutel shall, by a2y¢itp / 19 ff complete all Improvements in fu 1 compliance with the City's specifications set forth in Exhibit "A", and including any City approved amendments thereto. 2. Pro rata Share. In the event Rutel elects to pay a pro rata share of the cost of designing and constructing SW 342nd Street roadway improvements fronting the Property 1 • at the time of the installation of these improvements by the City or a third party, Rutel shall pay to the City his pro rata share which shall be calculated based on the percentage the front footage of the Property bears to the total front footage of the installed Improvements. 3. Failure to Install Improvements or Pay Pro Rata Share. In the event Rutel fails to construct the Improvements pursuant to Section 1 or pay a pro rata share of the cost of the Improvements pursuant to Section 2, the City shall file a lien against the Property. The lien shall be in an amount sufficient to pay all associated costs, services, materials, and administrative overhead necessary for the City to perform labor, furnish materials and supply equipment necessary to install the Improvements adjacent to the Property and all costs associated with enforcement of the lien, including attorneys' fees. As a condition of this Agreement, Rutel shall execute a lien in form and content acceptable to the City, provided, however, that the City shall not record the lien unless or until the conditions described in Section 1 or 2 herein are not met. Recordation of this Agreement shall serve as notice to all owners of the Property, successors, heirs and assigns so as to preserve ,a, the priority of this lien against any and all subsequent M security instruments, mortgages or liens of any kind CD filed subsequent to the recording of this Agreement. 04 4. The covenants, conditions, restrictions and provisions of this Agreement are imposed upon the Property and shall run with and bind the Property and the successive owners thereof, and shall inure to the benefit of and be enforceable by the City and by its respective legal representatives, heirs, successors and assigns, all for a perpetual term commencing with the date this Agreement is recorded in the records of the County Recorder of King County, Washington. -2- • 6. Enforcement and Cumulative Rights. 6.1 Violation or breach of any covenant, condition, restriction or provision contained in this Agreement shall give to the City the right to prosecute an action or proceeding at law or in equity against the person or persons who have violated or breached or are attempting to violate or breach any of such covenants, conditions, restrictions or provisions to enjoin or prevent them from doing so, to cause such breach or violation to be remedied or to recover damages for such violation, and/or to immediately revoke the occupancy permit for any building located on the Smith property. 6.2 The rights, powers, privileges and remedies of a covenantee provided herein are cumulative and not exclusive of any right, power, privilege or remedy provided by law or in equity. 7. Severability. In the event any portion of this Agreement shall be declared by any court of competent jurisdiction to be invalid, illegal or unenforceable, such portion shall be deemed severed from this Agreement, and the remaining parts hereof shall remain in full force and effect, as fully as though such invalid, illegal or unenforceable portion had never been part of this Agreement. G8. Indemnification. 8.1 For City. Rutel agrees to indemnify and hold the City, its elected officials, officers, employees, agents, and volunteers harmless from any and all claims, demands, losses, actions and liabilities (including costs and all attorney fees) to or by any and all persons or entities, including, without limitation, his respective agents, licensees, or representatives, arising from, resulting from, or connected with this Agreement to the extent caused by the negligent acts, errors or omissions of Rutel, his respective agents, licensees, representatives, or employees, or by Rutel Is breach of this Agreement. 8.2 Survival. The provisions of this Section shall survive the expiration or termination of this Agreement with respect to any event occurring prior to such expiration or termination. -3- l 9. Attorney Fees. In the event either of the Parties defaults on the performance of any terms of this Agreement or either Party places the enforcement of this Agreement in the hands of an attorney, or files a lawsuit, each Party shall pay all its own attorneys' fees, costs and expenses. The venue for any dispute related to this Agreement shall be King County, Washington. 10. Governing Law. This Agreement shall be made in and shall be governed by and interpreted in accordance with the laws of the State of Washington. 11. Authority. Each individual executing this Agreement on behalf of the City and Rutel represents and warrants that such individuals are duly authorized to execute and deliver this Agreement on behalf of Rutel or the City. 12. License. Rutel hereby grants to the City the irrevocable license and right to enter the Property to inspect any work and install or maintain the Improvements pursuant to the terms of this Agreement, as the City deems necessary.
