Dear Mr. Linardic:
The City has received a Process I application for exterior changes and use of the former bank drive through
building as a new restaurant. Door, window, and ramp changes are proposed to establish the Pink Spot Cafe
business. The Process I application was submitted on January 26, 2010, is determined to be complete.
Specifically, this Process I application is only for reuse of the existing bank building as a new cafe. In the
March 16, 2010, comment letter for the Pac Plaza Redevelopment, the City noted that the proposed "Phase P'
project, which was re -use of the existing bank building as a fast food restaurant together with the addition of a
catering truck/fast food restaurant, did meet the Federal Way Revised Code (FWRC) definition of a change -of -
use (FWRC 19.05.040) due to increase in the hours of operation, increase in required parking, and changes to
traffic generation. Traffic comments are copied here. Due to the increased impacts, the Phase I application that
includes the catering truck requires Process II review. However, the building reuse concept requires only a
Process I land use application.
Additional Information Requested
The following information must be provided prior to issuance of Process I approval for the new cafe:
1. Customer access to the restroom is proposed via a new exterior door to be installed on the north side
of the building. Access to this doorway is via a ramp that ends in the planter area. There is no way for
customers to re-enter the building or the parking lot without going through the planter area. Further,
this ramp blocks the pedestrian access to the main building entrance from the north. Revise the plan to
provide unimpeded pedestrian access to and from this ramp. Consider wrapping it around the building
instead of into the planter area. Depict accessible routes of travel for the ramps as well.
2. Identify each entry landing area on the site plan.
3_ Document what will occur under the canopy areas that are not used for coffee pickup_ Will there be
seating. will it be available for covered parking, etc.?
Please be advised that the building permit application #10-100360-CO is under review. A City Business
License will be required as well as applicable permits from the Health Department. Please note that if the
catering truck is still proposed for this site, additional land use review process and fees will be required.

Dear Mr. Linardic:
The City has completed Process I review and hereby approves the application for exterior changes and re-
use of the former bank drive -through building as a fast food restaurant. Zoning for the site is Community
Business (BC) and fast food restaurant uses are permitted within the BC zoning district pursuant to
Federal Way Revised Code (FWRC) 19.19.220.020, "Entertainment - Generally."
A Process I application was submitted on January 26, 2010. Door, window, and access ramp additions are
proposed to the east and west facades of the existing building to establish the Pink Spot Cafe. The
existing parking adjacent to the building will be modified in order to meet current ADA standards. One
lane under the existing drive -through canopy will be used as a food delivery/pick-up window, the balance
of the area under the canopy will include planters and minimal seating. No vehicle parking will be
permitted under the canopy. The proposed facade changes do not reduce required parking, landscaping,
buffering, open space, or public areas; does not change the location of utilities or easements; maintains
pedestrian connections; is consistent with the approved architectural design of the site; and creates no
impacts to sensitive areas or significant trees.
Based on the City's review, the Process I application for proposed door, window, and access ramp
additions along with reuse of the former bank as a fast food restaurant is administratively approved.
Building permit #10-100360-CO is under review for the proposed improvements.
This decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this project site. The effective date of decision is April 16, 2010, or three days from the date of
this letter. Pursuant to FWRC 19.55.050(1), any person who received notice of the administrative
decision may appeal this decision to the Federal Way Hearing Examiner by April 30, 2010 (14 days from
the effective date of decision).
In that you are the only party of record, you may waive your right to appeal by submitting a letter to this
effect to the City of Federal Way, Department of Community Development Services. If you waive your
right to appeal, you may begin work on April 19, 2010, PROVIDING you have obtained the necessary
building permits.

Additional Process I hourly fees in the amount of $118.50 (1.50 hours at $79.00/hour) are now due and
must be paid before the building permit will be issued. Please use the enclosed invoice with any payment.

Hello Deb,
Find attached photographs of the existing ramp and what the proposed ramp would look like. As you can see
there is an existing concrete walkway that connects building entry to the handicap ramp and to the striped
walkway that leads to the sidewalk located in the ROW (Existing westelev.pdf . Due to reconfiguration of the
existing building (public toilet cannot be accessed thru a kitchen area) we had to provide access to the toilet by
means of an outside walkway. In order to provide access to the toilet we are proposing to raise the existing
walkway so that it would be at the same level as the existing entry landing and as the walkway continuous to
the north we are proposing a ramp down that will connect to the striped walkway. We are also proposing a new
ramp from the existing main entry landing that would provide HC access to the existing parking stall. Based
on my interpretation of building code the proposed ramp/ walkway will meet the requirements of accessibility
code.
Let me know if this proposal meets your approval and if not maybe you can let us know what needs to be
altered in order to meet your approval. As you know we have been working on this for last 5-6 months and the
tenant is anxious to open for business as soon as possible.
If you think we should meet to address any last issues you might have I would be happy to meet with you. We
are also ready to submit for a building permit for the catering truck. Per an e-mail from Sarady this use will
not add traffic trips and per process II application that we had submitted it is my understanding that we have
addressed other issues such as use, parking and landscape requirements. I'm assuming that letter date March
16, 2010 is for process I (10-100330) and that process II application is still under review and possible further
comments might follow. In either case can you let me know if we can apply for a building permit or do we have
to wait until process II is complete?

Mike - I did route the Pink Spot resubmittal to the review team, including the building department. I can let
you know that the ramp access to the restroom through the planter island won't work for ADA accessibility.
Either enlarge the sidewalk so that there a paved route to get back to the accessible stalls without going into
the drive aisle OR relocate the ramp. I will put this formally in writing to you later this week; I'm on deadline
for a couple of items ahead of Pink Spot right now.

Enclosed are the corrections you requested for the above mentioned project per your comments dated
March 16 2010.
1. The access ramps have been revised. Please note that the original proposed ramp lies atop an existing
conc walk which provides site access to the public way.
The original design proposed a ramp access that stopped at the new rest room door, we have revised
this ramp to extend all the way to the building access by raising the existing walking surface to the next
landing for the building access. An additional ramp is provide from the ADA parking stall to the building
entrance.
2. Please see sheet A-2.0 for landing designations
3. The additional area under the canopy not used for the drive thru portion of the project will be provided
with seasonal planters and no vehicular access will be allowed. Some minimal seating may be present
depending on the tenant

Division. The following are technical comments that should be addressed:
1. The proposal to convert the existing drive -through bank building (760 so into a Coffee/Donut
shop with drive -through will not generate any new trip. As such, a concurrency is not required
for this development.
2. Internal traffic circulation should be revised to promote safe and efficient traffic movements. The
PW traffic division is willing to meet with the applicant to go over options to improve the existing
access.
