For and in consideration of One Dollar ($1.00) and other valuable consideration, the receipt of
which is hereby acknowledged, McDonald's Real Estate Company, a Delaware Corporation,
("Grantor") grants, conveys and warrants to the CITY OF FEDERAL WAY, a Washington
municipal corporation, ("Grantee") for the purposes hereinafter set forth a perpetual easement
under, across and over a portion of that certain real property (the "Property") located in Federal
Way, Washington, legally described as follows;
Lot 1 of King County Short Plat No, L94S0017, Vol. 102, Page 256, Recorded
under Recording no. 9503229004, records of King County, Washington
Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon that portion
of the Property consisting of a utility easement ("Easement") described as follows;
Legal Description of Easement attached hereto as Exhibit "A" and depicted on
Exhibit "B", incorporated herein by this reference.
1. Purpose. Grantee and its agents, dcsigpees and/or assigns shall have the right, after fifteen
(15) days' prior written notice (or no jioticc in case of emergency) to Grantor, at such times as
deemed necessary by Grantee for maintenance situations, to enter upon the Property to inspect,
clean, operate, maintain, repair, replace, and remove all surface water facilities including, but not
limited to, underground facilities and/or systems under the Easement, semi -buried or ground
mounted facilities, vaults, outlet structures, control structures, pipes, catch basins, manholes, and
all appurtenances thereto ("Facilities"). Following the initial construction of the Facilities,
Grantee may from time to time construct such additional facilities as it may require, after
providing fifteen (15) days written notice to Grantor. Grantee shall minimize disturbance to the
operation of and access to the restaurant operating on the premises. The City of Federal Way's
maintenance responsibility is confined to the conveyance system within the easement area which
serves Pacific Highway South, and does not extend to any part of the private storm water facility.
2. Access. Grantee shall have the right of access to the Easement over and across the Property to
enable Grantee to exercise its rights hereunder by utilizing the improved driveway on the
Property or by any other method mutually agreeable to Grantor and Grantee,
3. Obstructions; Landscaping. Grantee may from time to lime remove vegetation, trees, or
other obstructions within the Easement, and may level and grade the Easement to the extent
reasonably necessary to carry out the purposes set forth in paragraph 1 hereof, provided, that
following any such work, Grantee shall restore the Easement to a condition the same or better
than its condition prior to such work. Following the installation of the Facilities, Grantor may
undertake any ordinary improvements to the landscaping of the Easement, provided that no trees
or other plants shall be placed thereon, which would be unreasonably expensive or impractical
for Grantee to remove and restore,
4, Grantor's Use of Easement. Grantor reserves the right to use the Easement for any purpose
not inconsistent with Grantee's rights, provided that Grantor shall not construct or maintain any
buildings or other structures on the Easement, that neither Grantor or Grantee shall not perform
grading, digging, tunneling, or other form of construction activity on the Property, that would
alter the functioning of the Facilities, and that Grantor shall not blast within fifteen (15) feet of
the Easement. Further, no other improvements shall be constructed within five (5) feet of the
centerline of the City's pipe without City's consent, which will not be. unreasonably withheld.
5. Successors and Assigns, The rights and obligations of the parties shall inure to the benefit of
and be binding upon their respective successors in interest, heirs and assigns.

in Federal Way, WA. For questions regarding the installation and structural performance of ADS N-
12 pipe, please reference the ADS Drainage Handbook at www.ads- i e.com..
After performing a cursory review of the supplied plans it appears that the project requirements for
the storm drainage bypass pipe are consistent with the requirements published in the ADS Drainage
Handbook. Please note that it is imperative that backfill be placed uniformly around the
circumference of pipe to provide proper structural support. Care should also be taken to ensure that
the pipe backfill remain stable through out the design life of the project. Please refer to ADS
flotation Technical Note 5.05 for areas of the project where flotation may be a concern. Please note
that ADS has not performed any engineering or design services for this project, nor does ADS
purport to address all the relevant design consideration associated with the project. It is the design
engineer's responsibility to ensure the project plans meet or exceed the applicable national, state, or
local requirements.

Dear Ms. Taflin:
City staff has reviewed the plans and calculations provided for McDonald's storm bypass. Please make
the following revisions:
1. Provide a signature block (City of Federal Way detail # 2 —1) on each sheet.
2. Provide a letter from the pipe manufacturer verifying that the pipe material and thickness are
suitable for this application. Staff is concerned that the pipe might shift within the gabion or that
point loading could damage the pipe since it is not surrounded by typical bedding material and is
not anchored.
3. Add a structure mid -length of the pipe to facilitate cleaning.
4. Extend the existing gravel access pad approximately 20 feet to the north to allow access to the
new catch basin on the west corner of the property.
Verify the vertical clearance between the existing perforated pipe and the new pipe. In addition,
verify that the existing 72" manhole on the east corner of the site will not be compromised
structurally by having an additional pipe cored in above the existing pipe.
6. Provide a drawn -to -scale detail of the outlet structure.
If, under some circumstances, the bypass pipe may back up into the pond, verify that this is
acceptable to the property owner.
8. Verify that a larger footing is not required under the gabions to prevent differential settlement.
9. Please note: City staff calculations (enclosed) using 1.5 acres of impervious area resulted in
larger peak flows than Pacland showed, however the size of the pipe still appears to be adequate.
10. Provide erosion control.

maintenance. The property owner will need to prepare a legal description and exhibit map in a

The purpose of this technical memorandum is to address the design of the proposed stormwater
bypass system at the existing McDonald's site in Federal Way, Washington.
Currently, runoff from approximately 1.5 acres of Pacific Highway South drains to the private
onsite stormwater detention pond on the McDonald's site. Since the pond was not designed for
this additional area, it gets overwhelmed by the additional runoff during small rainfall events. In
order to restore proper operation to the pond, a bypass system must be constructed for the Pacific
Highway South runoff.
Horizontal Alignment:
The proposed bypass system will convey runoff from Pacific Highway South to the drainage
structure downstream of the pond. The horizontal alignment of the bypass system is governed by
the location of the pond and surrounding site improvements such as the adjacent fencing. Since
there is no room for the pipe between the fence and the pond, the proposed alignment goes
through the existing pond. The pipe will be supported by gabion baskets through the pond.
Additionally, gabion baskets will be installed around the pipe to protect it from UV rays, ensure
the pipe is not damaged over time and prevent the pipe from buoyancy concerns. See the Storm
Drainage Bypass Plan, C-1.0, in Attachment 1 for details.
Vertical Alignment:
Due to vertical constraints in the existing drainage systems, the proposed bypass system is
generally flat. A conveyance analysis has been prepared for the proposed system using KCRTS
and KCBW to ensure that the proposed system has the capacity to convey the runoff from Pacific
Highway South. Flows were calculated in KCRTS using drainage areas provided by Will
Appleton, Surface Water Manager with the City of Federal Way, via email on April 1, 2011. See
Attachment 2 for drainage information provided. From these calculations, the 25-year and 100-

year peak flows were analyzed in KCBW. Per the calculations included in Attachment 3, the
system has adequate capacity to convey the peak flows from Pacific Highway South,
Conclusion:
As discussed above, the proposed bypass system as proposed on C-1.0 diverts the surface runoff
from Pacific Highway South from encumbering the private pond and has sufficient capacity to
convey the runoff around the existing McDonald's stormwater pond.
