PROJECT BACKGROUND: On April 12, 1991, Norm Bray, Building Inspector,
placed a stop work order on the property and told the owners that a
building permit was required for the construction of a retaining wall
over 4 ' in height. On May 7, 1991, Susan Meyer, Wetland Specialist, and
Cory Smith, Associate Planner, visited the site. At the time of the
visit some clearing and grading had been done. Although, some areas
were wet due to groundwater seepage, none of the site appears to be in
a wetland. The area above the recently graded area was strewn with
broken concrete slabs, old growth stump, and partly buried debris. It
appears that this fill was dumped in the area several years ago and may
have added to the steepness of the slope. The slope generally appeared
to be in a stable condition. A single-family dwelling is located on the
south half of the site.

The applicant is proposing to construct a crib wall at the
northwest corner of the property at 602 SW 297th St. This site is
located two lots west of the John Boe drainage diversion site. The
property owner has already started on construction and has been
red-tagged for lack of a permit.
A soils report accompanied the SEPA checklist for the project which
detailed the construction requirements. However, this report
lacked sufficient information on drainage control. The report
recommended the removal of stumps and concrete from the fill behind
the crib wall and the inclusion of a drain pipe behind the wall.
Prior to the start of construction of the wall there existed a
steep bank which permitted runoff from the site to sheet flow to
the right-of-way to the north and eventually to the drainage system
toward SW 294th St. Construction of the wall will divert runoff to
a concentrated point which may or may not cause erosion downstream
of the site. The discharge point has not been specified or
detailed on the plan submitted for review.
A sanitary sewer exists in the right-of-way to the north of the
site. Construction of the crib wall may cause increased or
excessive loads on the sewer pipe potentially resulting in its
collapse. The location of this sewer pipe in relation to the wall
has not been shown on the plans.
In review of the proposal, the following recommendations are made
relative to SEPA review:
1. The recommendations in the soils report submitted as part of
the application should be adopted. All construction should
conform to these recommendations and the City's amendments
thereto.

2. A building permit shall be obtained prior to continued
construction. Acceptance of the wall shall not be made until
a letter of certification has been received from a licensed
geotechnical engineer as to the adequate structural integrity
of the wall and conformance to the construction requirements.
3. The plans shall provide for a drainage outlet from behind the
wall and from the site above the wall. The outlet shall
include erosion control measures such as a riprap pad,
dispersion trench or other City acceptable systems. Potential
seepage from the hillside shall also be addressed. Plans
shall be submitted as a part of the building permit
application process.
4. Erosion control measures such as siltation fencing shall be
installed prior to any further construction activity taking
place on the project. These facilities shall be maintained
for the entire length of the project until all disturbed areas
are stabilized with vegetation.
5. A Right-of-Way Use Permit shall be obtained for any work to be
conducted in the right-of-way to the north of the site.
As part of the permitting process the following items shall be
required:
a. A boundary line survey shall be conducted to confirm the
location of the property line and ensure no encroachment into
the right-of-way.
b. Erosion control measures shall be included on the approved
plans.
c. The designed drainage facilities shall be shown on the
approved plans.
d. The plans shall identify the location of the existing sanitary
sewer main and its relation to the proposed wall. The bottom
of the wall shall be set back from the 1:1 angle of repose
from the bottom of the sewer pipe. This relation shall be
shown in a scaled cross-section drawing.
e. A performance bond shall be posted prior to issuance of the
right-of-way use permit to assure proper construction of the
wall, clean-up of the disturbed right-of-way, and maintenance
of the facility for a period of one year after City's
acceptance of the construction.

Dear Mr. Holmes:
The Washington State Environmental Policy Act (SEPA) review process
has been completed. Your building permit application has been
reactivated. However, before the various departments can complete
their review of your building permit application, the following
items need to be submitted:
1. A plan must be submitted that provides for a drainage outlet
from behind the wall. The outlet shall include erosion
control measures such as a riprap pad, dispersion trench or
other City acceptable systems. Potential seepage from the
hillside shall also be addressed. The designed drainage
facilities shall be shown on the approved plans.

The responsible Official of the City of Federal Way hereby makes
the following decisions based upon impacts identified in the
environmental checklist, the Federal Way Comprehensive Plan, and
other municipal policies, plans, rules, and regulations designated
as a basis for exercise of substantive authority under the
Washington State Environmental Policy Act Rules pursuant to
R.C.W 43 .21C. 060.
The lead agency for this proposal has determined that it does not
have probable significant adverse impact on the environment, and an
Environmental Impact Statement (EIS) is not required under
R.C.W. 43 . 21C. 032 (2) (c) , only if the following conditions are met.
This decision was made after review of a completed environmental
checklist and other information on file with the lead agency. This
information is available to the public on request.
Conditions:
1. Recommendations specified on page 2 of Pacific Testing
Laboratories report, dated April 18, 1991, (Certificate No.
9104-4075) prepared for this proposal shall be followed as may
be modified by building permit design review.
2 . The owner/developer shall provide the City with written
certification signed and sealed by a qualified professional
geotechnical engineer as to the structural integrity of the
constructed wall and its conformance to the approved plans or
modifications thereof, prior to calling for final approval.
3 . All material ised as fill must be non .ssolving and non-
decomposing and shall not contain organic or inorganic
material that would be detrimental to water quality or
existing habitat or create any other significant adverse
impacts to the environment.
4 . Debris, (i.e. , broken concrete slabs, old, stumps, etc. ) shall
be removed both above and downslope of the retaining wall, as
directed by the Director of Public Works. Prior to issuance of
a building permit the applicant shall establish a performance
bond or other security, (i.e. , assignment of funds) for said
cleanup. The amount will be one hundred and twenty percent
(120%) of the estimated cleanup costs for removal and disposal
of debris, as approved by the Director of Public Works. The
bond or security shall be released 10 days after final
approval by the Director of Public Works.
5. A filter fabric fence for temporary siltation control is
required downslope of the retaining wall, as required by the
Public Works Department, prior to excavation and shall be
maintained until all exposed areas have been stabilized with
vegetation.
6. To prevent further erosion within two weeks after
construction, exposed areas where cutting and filling have
taken place shall be revegetated, as required by the Planning
Director.
7 . Prior to issuance of a building permit, a maintenance bond, or
other security, (i.e. , • assignment of funds) , in the amount of
thirty percent (30%) of the cost of replacing the vegetation
shall be established in accordance with Chapter 180, Federal
Way Zoning Code.
8. Construction shall commence within 90 days of completion of
the SEPA process.
This MDNS is issued under WAC 197-11-340(2) ; the lead agency will
not act on this proposal for 15 days from the date of issuance.
Comments must be submitted by 5:00 p.m. on August 1, 1991.
Unless modified by the City, this determination will become final
following the above comment deadline. Any person aggrieved of the
City's determination may file an appeal with the City within 14
days of the above comment deadline.

The following comments and recommendations are made regarding the application to erect a
retaining wall on the Holmes' property.
- A wet area due to groundwater seepage was identified by Pacific Testing Laboratories in
the existing wall keyway. It is unknown whether this was wetland, and it is probably not possible
to determine whether it was wetland because of past filling activities.
- A large amount of cement blocks and organic debris is piled downslope from the wall,
and appears to be within the 50-foot setback from the minor stream. This rubbish could contribute
sediment or other pollutants to the stream.
RECOMMENDATIONS
- Remove rubbish from areas downslope of the retaining wall.
- Install sediment fences downslope of the retaining wall to ensure that no sediment is able
to reach the minor stream.

The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires all governmental agencies
to consider the environmental impacts of a proposal before making decisions. An environmental impact

Dear Mr. Holmes:
I In response to your request we are pleased to submit design and
construction recommendations for a proposed ecology block wall
along the west side• of your property. We will also address certain
11 questions relating to this project which have been raised by the
City of Federal Way. These will be attached in an Appendix.
STATEMENT OF THE PROBLEM
11 It is our understanding that you wish to construct a block wall
. along the slope which borders your property to the west: This
11 slope is natural. We further understand that the gully further to
the west, which contains a small stream, has been designated a
Sensitive Area by the City of Federal Way. The purpose of the wall
I would be both cosmetic, and to help to stabilize the upper part of
the slope where some landscaping is intended. In this latter
capacity it will serve primarily to control'erosion. The wall, at
its' highest point, may be as much as twelve (12) feet high.
ISITE CONDITIONS
11 An engineer from Pacific Testing Laboratories visited the site of
the intended wall on Monday, April 8, ' and carried out a visual
examination of the area. At the time of this visit some
II preliminary site preparation work had been done. This consisted of
a partially cut keyway along the projected base-line of the wall,
and had been done with a small (Case 450 Series) bulldozer. Some
vegetation, in the form mainly of blackberries and very small
I alder, had apparently been pushed out during this operation, and

was lying among still-standing small alder and blackberries, and
contained topsoil and other wood fragments which appeared to be
remnants of old stumps. The soil exposed in the partly-
completed keyway cut consists of medium, dense, damp, clean,
brown sand with some gravel. In one small area the sand is wet,
due to groundwater seepage. In this area the exposed ground is
soft and will require stabilization.
11 The only vegetation on the slope above the keyway consists of
assorted weeds and grasses. This upper area is also, in places,
strewn with broken concrete slabs, and an old growth stump is
11 partly buried in this debris and soil. Voids exist among the
concrete debris, and it is apparent that some fill has been
dumped in the area, probably several years ago. The overall
effect of dumping the fill appears to have been that of
steepening this part of the slope somewhat. At the time of our
visit the slope generally appeared to be in a stable condition.
11 RECOMMENDATIONS
•
The native ground noted in the area (medium, dense sand, with
11 some gravel) is capable of supporting structural loads, and/or
standing unsupported at relatively steep slope angles, provided
that it is not in a loose, wet, or contaminated condition. We
believe that the proposed ecology block wall will serve the
intended purposes of providing slope protection and facilitating
some landscaping of the area behind and above it. However,
certain conditions must be met prior to, and during
11 construction.
These are the following:
(i) The base of the wall must be keyed into native,
undisturbed, firm bearing soil, having a bearing
capacity of at least 2500 psf.
(ii) The keyway should be at least one (1) foot deep (see
Figure 1, Appendix) .
41 (iii) The wall shall be battered towards the slope at an
inclination from the vertical of 1H:6V, or flatter.
(iv) Prior to wall construction the slope behind it shall be
composed of firm native soil, free of all vegetative
and other debris (concrete remnants, etc. ) . This is not
a retaining wall. Native material shall be stable and
I (v) free-standing in the cut face.
Provision must be made for adequate drainage from behind
the wall (see Figure 1 for a typical drainage
arrangement) .

(vi) The wet area noted in the keyway must be stabilized
with free-draining material such as 2"-4" quarry
spalls, to provide the required bearing capacity, and
allow for' drainage.
(vii) The base of the wall must be set in the slope so as to
provide a no-load zone of adequate size between the
wall base and the toe of the slope below it (see Figure
2) .
(viii) Placement of adjacent structures must be in accordance
with accepted standards (see Figure 2) : In addition, no
new footings or structures shall be placed within a zone
11 delineated by a line extending upwards from the base of
the wall at an angle of 2H:1V.
Provided that these conditions are met we believe the wall will
be stable and will serve its intended purpose and will not in
11 any way adversely affect the gully or the stream below, to the
west. Our recommendations have been made on the understanding
that the proposed wall will not exceed 12 feet in height.
Should it exceed 12 feet in height some review of the required
soil bearing capacity will be necessary. Similarly, should the
proposed wall location be changed or extended the new situation
would have to be evaluated separately and the contents of this
11 report would not automatically apply. Also, our recommendations
apply only on the understanding that the natural slope below the
base of the wall will not be excavated or otherwise disturbed.
11 Loose fill and vegetative debris resulting from construction of
the wall should not be allowed to remain on the lower part of
the slope, but should be properly disposed of in an approved
11 location.
LIMITATIONS
11 This letter has been prepared to aid in the evaluation of the
site. Our observations and conclusions have been prepared in
accordance with generally accepted professional engineering
principles and practices. We make no warranty, either expressed
or implied. Our observations are based on the results of the
field examinations and on our interpretation of existing surface
11 conditions. The conditions and observations presented should
not be applied to surrounding properties. If conditions are
encountered that appear to be different than those described in
this letter, we should be notified so we may review and either
11 verify or modify our observations.
