Dear Mr. Sharba:
This letter provides a summary to the October 4, 2001, Federal Way Development Review Committee
meeting wherein staff reviewed your proposal to establish a used car sales lot and U-Haul rental business
at the above referenced location. You have proposed to use an existing 80 square foot office within the
759 square foot TV City retail space for the primary office of the BC Auto Sales use. On the submitted
proposed site plan you have indicated that the U-Haul rental vehicles and for-sale used vehicles will be
parked to the north, west, and east of the existing structure.
Committee members at that meeting included representatives from the City's Public Works Department,
Department of Community Development Services' Planning and Building Divisions, Federal Way Fire
Department, and Lakehaven Utility District. This letter summarizes the preapplication conference for
your proposal. Department and agency requirements are enclosed with this letter.

A) Required Review Process
Land Use Approval: The zoning of the subject site is Community Business (BC). This zoning
district permits vehicle sales and equipment rental facilities, excluding heavy equipment rental,
under Federal Way City Code (FWCC) Section 22-754 (enclosed). The required review process for
the project is Process II, "Site Plan Review," in that the project does not meet the criteria set forth in
FWCC Section 22-32.2, "Review Processes for Improvements and Additions to Developed Sites"
(enclosed). Specifically, the proposed used-car lot and U-Haul rental business is defined as a change
of use from the previously established use on the site (i.e. the TV City service and repair use), and as
such, is outside the review parameters of Process I review. For your information, pursuant to FWCC
Section 22-1, "Definitions" (enclosed), a change of use is determined to have occurred when,among
other things, it is found that the type, extent, or amount of outdoor storage on a site modifies the
general character of the previously existing operation. The proposed used-car sales and U-Haul
business will create such a change, and as such, the project is subject to the aforementioned Process
II review.
State Environmental Policy Act(SEPA): Pursuant to the Washington Administrative Code (WAC)
197-1 1-800(3), a project that involves the remodeling of an existing facility in conjunction with a
change of use can be subject to SEPA review. In this instance,the Public Works Traffic Division has

determined that the creation of a used-car sales lot and a U-Haul rental facility will not create a
significant impact on traffic patterns in the area.No other significant impacts have been identified as
a result of the proposed change of use, and as such, it has been determined that this project will be
exempt from SEPA review.
B) Fees: The fee for Process 11 review is $1,473. The $321 deposit paid at the time of preapplication is
subtracted from this total. Additional fees are associated with other City and district regulations and
permits.
C) Nonconformance: Pursuant to FWCC Section 22-334(1) (enclosed), if an applicant proposes a
change of use on only a portion of a property occupied by multiple tenants or uses, the applicant
shall meet those provisions determined by the Director to be reasonably related and applicable to the
change of use. These provisions shall apply only to that geographic portion of the site related to the
use or tenant space on which the change is proposed.
Landscaping Nonconformance
The proposed site currently is surrounded with a chain link fence to the north, east, and west. There
is a narrow landscape strip along the west property line. There is a residential use to the north of the
site;however,that property is zoned Community Business(BC).There is a residential zoning district
to the east of the subject site; however, 18th Avenue South separates this residential zoning use from
the subject property. Pursuant to FWCC Section 22-1566 (enclosed), Type III landscaping five feet
in width shall be provided along all properties abutting public rights-of-way and along all perimeter
lot lines.
• The applicant shall provide five feet of Type III landscaping along the west, north,
and east property lines. Pursuant to FWCC Section 22-1563, the landscape plan for
this requirement shall be prepared by a Washington State licensed landscape
architect.
D) Outdoor Activities and Storage: Pursuant to FWCC Section 22-1113, outdoor display of vehicles
for sale or lease are exempt from screening requirements.
E) Parking Surface: The areas proposed for use for the sales and rental of vehicles is currently a gravel
surface. Pursuant to FWCC Section 22-1453,the applicant shall surface the parking areas,
driveways, and other vehicular circulation areas with a material comparable or superior to the
surface material of the right-of-way.
Parking Requirements: Pursuant to FWCC Section 22-754,the number of required parking spaces
for a retail establishment selling or renting vehicles is one parking stall per 300 feet of gross floor
area. Under the code definition of"gross floor area,"the entire exterior lot area devoted to car sales
and rental will be used to calculate the number of required parking stalls. Added to this amount of
required parking for the proposed project, three additional stalls must be added to provide the
number of required stalls for the existing establishment(TV City).
• Please provide a site plan showing the dimensions of the area that will be used for car
sales and U-Haul rentals. Remember that the required number of parking stalls must
not be utilized for displaying sales or rental vehicles. The site plan should also indicate

the proposed location for the required number of parking stalls. Staff will review the
proposal to ensure that traffic circulation needs are adequately met. Please refer to the
enclosed handouts,Parking Lot Design Criteria and Accessible Parking. It is possible
that the existing parking stalls will need to be moved to accommodate the area
proposed for used car sales and U-Haul vehicle storage.
Parking Lot Landscaping: Pursuant to FWCC Section 22-1567, parking stalls must be provided
with required interior lot landscaping. Landscape area shall be provided at 20 square feet per parking
stall when up to 49 parking stalls are provided. Landscape islands shall be a minimum of 64 square
feet and be planted with Type IV landscaping. Curbing shall be provided in all landscape areas
within or abutting parking areas. Please refer to the enclosed landscape chapter for additional interior
parking lot landscape requirements.
• Please provide a landscape plan showing the required parking lot landscape. This plan
must be prepared by a licensed Washington State Landscape architect.

After reviewing the materials submitted and a visit of the proposed site,the following comments and findings
address issues that need to be resolved prior to development of this site.
LAND USE ISSUES
Stormwater
1. If the applicant proposes to create more than 5,000 square feet of impervious surfaces(including offsite
improvements), then surface water runoff control will be required. Water Quality Treatment will be
required if more than 5,000 square feet of paved surface subject to vehicular traffic is created. These
requirements are necessary to meet compliance with the 1998 King County Surface Water Design
Manual(KCSWDM) and the City of Federal Way addendum to the manual (Note:city's addendum to
KCSWDM may be obtained for a fee at Federal Way Kinko's Copies 253-946-2679). This project lies
within a Level 1 flow control area, and a resource stream protection area for water quality, thus the
applicant must design flow control and water quality facilities to meet these performance criteria.
2. If more than 5,000 square feet of impervious surface is created on this site,this project will meet the
requirements for Full Drainage Review, and at the time of the site plan review submittal a preliminary
TIR must be provided including a narrative addressing the relevance to the project of the 8 core and the 5
special requirements of the KCSWDM,additionally,a Level I downstream analysis shall be provided.
The city has 1"=100', 5 foot contour,planimetric maps available that must be used for basin analysis.
3. For site plan review submittal, conceptual drainage facilities must be shown on the plan to a size and
configuration approximating the needs of the site. The existing site plan shows what appears to be a
conflict with the future roadway easement and the potential storm water management area in the
southwest corner of the site. Additional facilities will be required to provide enough water quality and
water quantity storage for this site.
4. Surface water runoff from all frontage improvements must also be treated and controlled.If this will be
done onsitc, an agreement acceptable to the City must be prepared acknowledging that the subject
property is providing treatment and flow control for storm water from public right-of-way. There is the
for on site or off site storm water detention facilities. If the applicant chooses,the Kitts Corner Regional
Detention facility may be utilized for off site detention at a pro-rata cost of$8,722.00/acre.
Traffic/R-O-W Improvements
See attached Traffic Division memorandum from Raid Tirhi, Traffic Engineer,for traffic related items.
BUILDING PERMIT ISSUES
1. If more than 5,000 square feet of impervious surface is created on this site, a Technical Information
Report(TIR)will need to be prepared for the project and submitted with the building permit application.
The TIR will require the signature/seal of a Professional Engineer licensed in the State of Washington.
2. The applicant will need to provide a geotechnical report that addresses design pavement thickness for the
on-site parking lot.
3. The applicant shall reimburse the City for the cost of all required regulatory,warning and street name
signs that are installed prior to acceptance by the City of all other require improvements.
4. Copies of Public Works'standard checklists are available to assist the applicant's engineer in preparing
the plans and the TIR.
5. Bonding will be required for all improvements associated with the project. The bond amount shall be
120%of the estimated cost of the improvements. Upon completion of the installation and final approval
by the Public Works inspector,the bond value will be reduced to 30%of the original amount for the two-
year maintenance period. An administrative fee deposit will need to accompany the bond to cover any
possible legal fees in the event the bond must be called.
6. The developer will be responsible for the maintenance of the storm drainage and street systems for the
two-year maintenance period. During that time,the Public Works inspector will make periodic visits to
assure developer's compliance with maintenance requirements.
7. When topographic survey information is shown on submitted plans, as may be required, the vertical
datum block shall include the phrase"DATUM: N.G.V.D.-29"or"DATUM: K.C.A.S."on all sheets
where elevations arc called out.
8. All drawings shall be drafted/plotted on 22"X 34"or 24"x 36"mylar sheets with permanent black ink.
Site plans shall be drawn at a scale of 1"=20' or larger. Drawings submitted for plan review shall be
printed on either 22"X 34"or 24" x 36" paper.
9. Provide cut and fill quantities on the grading plan.
10. The site plan submitted should show the location of any existing and proposed utilities in the areas
affected by construction.

Trip Generation & Transportation Impact Analysis (TIA)
The applicant must provide a written estimate ti-T the additional number of peak hour trips generated

When required, special inspections shall be performed by WABO approved agencies
or by agencies approved by the building official prior to permit issuance. Construction
must be approved by all reviewing departments prior to final building division inspection
All concerned departments must sign off before building department will final. Building
final must be approved prior to the issuance of a Certificate of Occupancy. The City of
Federal Way does not issue temporary C.O.'s
All construction projects may be required to have a pre-construction conference. If a
pre-con meeting is required, all subs, the general or representative, the architect or
representative, the engineer or representative, electrical contractor and any other
interested party, should attend this meeting. Meetings will occur at the building
department and will be scheduled by the inspector of record for the project.
All items checked above shall be complied with at application.
Site-specific requirements:
1) Assuming Type V-N construction, bearing walls shall be one hour less than 20'
and required elsewhere. Opening protection shall not be permitted less than 5'
and protected less than 10' per UBC Table 5-A.
2) One van accessible parking space shall be required. Accessible spaces shall
be the size, location, marked etc... per UBC Chapter 11 as amended. See the
attached handout. Accessible spaces shall be placed as close to the accessible
entrance (main entrance) as possible. Accessible exits shall be as described in
UBC 1103.2.3 as amended. The primary entrance shall be accessible.

compliance with the WSEC (Washington State Energy Code) and the VIAQ
