Dear Mrs.Vega:
On May 31,2013,the City of Federal Way's Department of Community and Economic Development received
your letter stating the intent to fence in an area located adjacent to your building within the parking complex to
provide a patio area for outdoor dining.The city has completed an administrative review and the application is
hereby approved pursuant to the conclusion based on findings made by the department's Planning Division.
Findings of Fact
1. Zoning Designation: The property is zoned Neighborhood Business(BN)and has specific parking
regulations associated with the present use of the property.The use regulation within this zone(tavern or
restaurant)specifies 1 parking stall for each 100 square feet of gross floor area.Currently the restaurant,in
addition to the existing outdoor dining area on the northern end,is 8,000 square feet.The proposed 20 x 24
foot outdoor patio would then equate to an existing gross floor area of 8,480 square feet,which would require
85 parking stalls on property.After completion of a site visit,the number of parking stall available for this lot
is greater than the minimum requirement listed under Federal Way Revised Code(FWRC) 19.215.02.
2. Maximum Environmental Noise Levels: Per FWRC 7.10.050,the city adopts by reference the maximum
environmental noise levels established in the Washington Administrative Code(WAC) 173-60. WAC 173-
60-040(enclosed)establishes maximum permissible environmental noise levels with which the subject
property must comply with.
3. Environmental Review: The proposed outdoor eating area is categorically exempt from an environmental
threshold determination pursuant to State Environmental Policy Act Rules 197-11-800(3).
