Dear Ms. Andrade:
The Community Development Department has received your March 30, 2018, Process I Master Land Use
(MLU)application to install a fenced in area for a temporary patio for outdoor dining at the above-
referenced address. The Process I application is hereby approved based on findings and conclusions
below.
FINDINGS
• The zoning for the site is Neighborhood Business(BN).The existing restaurant is a permitted use
within the BN zone pursuant to FWRC 19.215.020. The proposed outdoor patio area is considered a
minor improvement to the existing site,and therefore reviewed as an administrative land use process
pursuant to FWRC Chapter 19.55, `Process I—Director's Approval.'
• According to submitted materials,the applicant proposes to designate 4 parking stalls for outdoor
seating for up to 30 individuals.The area will be fenced by chains and have approximately 10 tables
varying in size. Pursuant to FWRC 19.215.020, restaurant uses in the BN zone require 1 parking
space for each 100 sq. ft. of gross floor area. The existing restaurant is 8,000 sq. ft. and the patio area
would add 646 sq. ft. for a total of 8,646 sq. ft.,requiring 87 parking stalls.The number of existing
parking stalls, after the patio area is provided, is sufficient for the restaurant use.
• Per FWRC 7.10.050,the city adopts by reference the maximum environmental noise levels
established in the Washington Administrative Code(WAC) 173-60. WAC 173-60-040(enclosed)
establishes maximum permissible environmental noise levels with which the subject property must
comply with.
• The proposal does not reduce the amount of required landscaping, buffering, open space,or public
areas, below minimum FWRC requirements. Based on the submitted site plan,the subject property
meets the minimum amount of required parking spaces; thereby,conformance with the parking
requirements of the BN zone is not adversely impacted.

CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities,or
uses are permitted only if approved using Process I—Director's Approval. Based on the findings above,
the proposed improvements to the developed site meet the Process I approval criteria and land use review
thresholds of Federal Way Revised Code(FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including,
but not limited to: Permits and Review Processes; Process I—Director's Approval; and FWRC
Zone Use Chart 19.215.020,Restaurant uses in the BN zone.
2. The proposal is a minor improvement,modification,or addition to a site that is exempt from State
Environmental Policy Act(SEPA) review.
3. The health, safety,and welfare of the citizens of the city are preserved.
APPEALS
The effective date of this decision is May 6, 2018,or three days from the date of this letter. Pursuant to
FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision
to the Federal Way Hearing Examiner by May 21,2018. Any appeal must be in the form of a letter
delivered to the Department of Community Development with the established fee.The appeal letter must
contain a clear reference to the matter being appealed and a statement of the alleged errors in the
Director's decision, including the identification of specific findings and conclusions made by the Director
disputed by the person filing. You may waive your right to appeal, if desired, by writing the City a letter
to this effect.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies,and
standards relating to this development. This Process I approval is valid for one year from the effective
date of this decision. If no further action is taken within one year,this decision will expire.

The project "Temporary Patio" will be a designated area for outdoor seating for up to 30
individuals.The area will be 19x34 feet, approximately 4 parking spaces.The patio will consist
of 5 large tables capable of seating 4 people and 5 smaller tables capable of seating 2 people all
with umbrellas to provide shade.This area will be fenced in with 7 large cement filled urns
topped with soil and flowers, connected by chains.
