The request is to locate a district office within a vacant multi-tenant space. ZONING COMPLIANCE REVIEW FWRC 19.15.025 addresses a change of use at a developed site as follows: 19.15.025 Zoning and use review process,for new tenants—Change of use at a developed site. The purpose of this section is to review and determine compliance with applicable zoning and development code requirements when a new use is proposed to occupy an existing building or site. When a land use changes from one use category in the zoning charts to another use category, a zoning compliance review shall be performed as part of the use process review, when required, or in conjunction with the required business registration and/or building permit review. Each paragraph in a zoning chart is a use category. If the new use is in the same use category as any previous legal use of the site, no zoning compliance review is required. A new use is proposed to occupy the tenant space in the existing building. The subject property is located in the Business Community(BC)zone but is governed by a Development/Concomitant Zoning Agreement. Per the Agreement,the allowable uses on the property are limited to those set forth in the Neighborhood Business(BN) District Regulations"as the same now exists or may hereafter be amended" with a few exceptions. Provisions related to height, setback, lot coverage, and other development regulations must comply with provisions of the BC zone. The proposed district office for Winco Foods is an allowed use in the BN zone.The previous tenant was a fast-food restaurant. The two uses are not located within the same zoning chart; therefore, a zoning compliance review is required as indicated above. Required parking for retail uses in the BC zone is one space per 300 square feet of gross floor area per FWRC 19.220.010. This is less than the amount of parking required for the previous use, which was one space per 80 square feet of gross floor area per FWRC 19.220.020. Therefore, the Change of Use does not Mr. Berg September 28.2016 Page 2 trigger any additional parking requirements. All other relevant standards contained in the two use zone charts are identical. Your zoning change of use is considered to be in compliance with the relevant zoning requirements and is hereby approved.This does not constitute approval of a building permit or change of occupancy. The City's Building Division is currently reviewing the associated building permit, File#16-104297-00-CO. No tenant improvement work may begin until the building permit has been issued.
