The city is in receipt of your November 28, 2017, submittal and April 23, 2018, resubmittal for a Change
of Use from retail use to a church use. The site is zoned Commercial Enterprise (CE) and contains several
multi -tenant buildings. The previous use of the building was for office/retail. The request is to locate a
church with office rooms and classrooms in a 4,400 sq. ft. tenant space. Minor tenant improvements are
proposed inside the building. No site modifications are planned.
ZONING COMPLIANCE REVIEW
Federal Way Revised Code (FWRC) 19.15.025 addresses a change of use at a developed site as follows:
"19.15.025. Zoning and use review process for new tenants — Change of use at a developed
site. The purpose of this section is to review and determine compliance with applicable
zoning and development code requirements when a new use is proposed to occupy an
existing building or site. When a land use changes from one use category in the zoning charts
to another use category, a zoning compliance review shall be performed as part of the use
process review, when required, or in conjunction with the required business registration
and/or building permit review. Each paragraph in a zoning chart is a use category. If the new
use is in the same use category as any previous legal use of the site, no zoning compliance
review is required."
The existing and proposed uses are located in different zoning charts; therefore, a zoning compliance
review is required. Per FWRC 19.15.025(1), any new use shall comply with only those standards of the
use zoning charts that are directly related to the new use as determined by the director. Examples include
parking, use -specific setbacks, use -specific special regulations and notes, and nonconforming surface
water quality improvements identified in FWRC 19.30.120. Other nonconforming aspects of the site
which are not made nonconforming as a result of the change of use are not required to be brought into
conformance as a result of this subsection.
CHANGE OF USE ANALYSIS
The subject property is zoned Commercial Enterprise (CE). Churches are a permitted use pursuant to
FWRC 19.240.160, "Churches."

Use -Specific Regulations and Notes — No external changes to the existing building are proposed.
Parking Requirements — Per FWRC 19.240.000, the previous tenant space use of retail had a minimum
parking requirement of one parking space for every 300 square feet of gross floor area. The proposed
church use requires one parking space for every 5 seats. The sanctuary has a total of 113 chairs, which
requires 23 parking stalls.
The submitted site plan and aerial photo of the parking spaces details 57 parking spaces. The overall
parking for the site is shared between the tenants. Based on the mix of uses per Sheet Al.10 there is
adequate amount of parking for the proposed use and existing uses.
Setbacks — Required minimum setbacks for the proposed use in the CE zone are 20 ft. front, 0 ft. side, and
0 ft. rear. No additions are proposed; the existing building meets setbacks.
CONCLUSION
In summary, the proposed zoning Change of Use for this developed site is acceptable. This letter is not
intended to identify all issues, as modifications to the building require additional review processes,
including, but not limited to, building permit review. Also, you will need to obtain a city business license
through the City Clerk's Office before occupying the building. If you have any questions regarding this

This building was previously used as an office and was remodel back in 2008 for an office use. The change of use
analysis clearly informs the applicant that the approval of a change of use may also result in a change of occupancy for
this building and building permits and approvals would be required. No building may be occupied until approved by the
City of Federal Way Division of Building Safety so I'm not sure why the church made the decision to occupy this building
without having the approval for the change of use completed or inquiring further as to what is required from other
departments to occupy this space? This building has undergone a complete change of occupancy from an office to an
assembly occupancy. You cannot occupV this building until you have approval to do so. You must provide scaled site
plans showing the required parking, provide scaled floor plans showing the function of each room. You must include the
seating layout in the sanctuary, where, if any, classrooms are located and the ages of any children within these
classrooms. Accessibly for the impaired must be provided from the parking area to the main function areas to include
the bathrooms and drinking fountains. This may require some alterations to the existing bathroom facilitates and the
installation of a drinking fountain. The occupant load for this space may require the installation of a sprinkler system, as
well as, additional exit signage and emergency exit illumination. You will have to provide information as to how the
current HVAC meets the requirements for a church.
As you can see there are some potential safety issues regarding occupy this space without approvals from the building
and fire department as well as having an approval from the planning department for the change of use process. Please
do not occupy this space until you have been approved by the Division of Building Safety. Please consult a design
professional to provide you with code compliant drawings and exiting plans. I have include a building permit application
and a commercial check list with this email as well as relevant code sections from the 2015 International Building code.

Hello Becky,
Thank you for your response. Just for clarity are you advising that there is an additional Building Permit
Application that we need to complete?
Please note that we were advised prior to signing the lease that it was zoned for a church and consequently, it's
already occupied.
When I contacted the Fire Marshall for an inspection, he advised us that we were NOT properly zoned. When
we came to the Permit Center, we were instructed to only complete a the Change of Use form. However, please
know that we will work expeditiously to be compliant with all your requirements.

Hi Felicia,
I've received the zoning compliance review/change of occupancy request you submitted on November 28, 2017, for a change of use
from office space to a church. Please note, before the building can be occupied for church services the submitted change of use
analysis must be reviewed and approved and you must obtain change of occupancy approval from the Building Department. No
certificate of occupancy has been issued at this time.
A review of the submitted materials identifies the following items must be addressed before issuing a department response to the
change of use -zoning compliance:
• Please submit a scaled floor plan relating to the proposed church. The submitted plan is too small and out of scale to read. Is
there any interior improvements proposed? Where is the congregation area and what is the seating plan? Are there any
classrooms/kitchens?
m Please provide gross floor area of the entire building and subject tenant space.
Please provide a site plan including number of existing parking spaces.
o The applicant shall provide 1 parking space for each 5 seats or 10 lineal feet of bench seating for the church use.
Minimum parking requirements of 1 parking space per 300 square feet of gross floor area must be maintained on -site
for the remaining tenant spaces as well. The site must have sufficient parking for all tenant spaces on -site.
The Building Division has no comments on this change of use application. However, the applicant must submit a building permit
application for change of occupancy for staff to review. Please contact the Permit Center at 253-835-2644 or
