Dear Mr. Frum:
The Community Development Department received your inquiry regarding an allowable land use
classification for a proposed dialysis center at the above address. Your inquiry states, "This site is
designated as OP.The City Code 19.235.010 Office/Retail identifies medical and dental office as an
allowed use. Would such designation preclude an ambulatory dialysis center from being located on the
site?"
Following review of the definition section of the zoning code, the office use definition set forth in Federal
Way Revised Code(FWRC) 19.05.150 is the appropriate allowable land use category for your proposal as
it provides medical care for patients.
Office Use is defined as:
"A place of employment providing services other than production, distribution, sale or repair
of goods or commodities,and includes but is not limited to: medical,dental or other health
care."
The property at 501 S 336th St. is zoned Office Park(OP). Office uses are permitted in the OP zone per
FWRC 19.235.010. A preapplication meeting with the city is encouraged prior to submitting land use and
building permits as there are a variety of code requirements that may apply to the project depending on its
scope.

We have several questions regarding its zoning:
• It is designated as"OP". The City Code"19.235.010 Office/Retail" identifies"medical and dental office"as an
allowed use.Would such designation preclude an ambulatory dialysis center from being located on the site?
It is a permitted use. However,the change in use may trigger a formal change in use planning process requiring
additional parking or site improvements/upgrades for clients(ADA standards).
Pursuant to the use zone chart quoted.Office under the code definition FWRC 19.05.150(0)does contain'medical,
dental or other health care':

"Office use"means a place of employment providing services other than production,distribution, sale or repair of goods or
commodities,and includes but is not limited to:medical,dental or other health care;veterinary,accounting, legal,architectural,
engineering,consulting or other similar professional services; management,administrative,secretarial,marketing,advertising,
personnel or other similar personnel services; sales offices where no inventories or goods are available on the premises; real
estate, insurance,travel agent, loan companies, brokerage or other similar services.The following uses are specifically excluded
from the definition of"office":banks, savings and loan companies and similar financial institutions.'
If you wish to obtain a formal confirmation letter in writing prior to proceeding with transactions,please contact the
Permit Center at 253-835-2607 and see the Administrative Decision Request form attached.All applications are
submitted in person via the permit center.
• Signage:from "19.140.140 Signs in nonresidential zoning districts—Freestanding signs"we deduct that a
medium profile sign would be allowed.Can you please confirm?
