DECISION The requested removal of five identified trees at 181 South 333r Street,Federal Way,WA (parcel#926500- 0258),is hereby conditionally approved. One of the proposed trees (Tree#1,Douglas Fir,25" DBH) to be removed has been denied as the city has determined that the tree lies on a city owned parcel(#926470-0040) and not on Mr. Wu's property. CONDITIONS OF APPROVAL The Douglas fir tree (Tree #3) to be removed within the parking lot landscape island along the west corner of the building currently meets the requirements of Federal Way Revised Code(FWRC) 19.125.070.Type IV landscaping is required to be replanted in this location within 60 days after the nuisance tree is removed from the property in order to ensure this site is no more nonconforming to all city codes than it is currently. VEGETATION MAINTENANCE PROPOSAL The following proposal was submitted by property owner Gary Wu and associate Aaron Wu. Photos confirm the trees are either declining in health,or damaging roadways and buildings. Tree#1 —Douglas fir(25"DBH),unknown reason for removal request. Denied as tree lies on city owned property. Tree#2—Ponderosa pine (9" DBH),dying/falling risk.Hazard and recommended to be removed. Tree#3—Douglas fir(21" DBH),disrupting roads. Nuisance and recommended to be removed. TREE REMOVAL REQUEST ANALYSIS Following review of the tree and vegetation retention policy,staff fords your proposal is exempt from permitting requirements and you may proceed with your vegetation maintenance plan as proposed.The remainder of this letter provides analysis of applicable portions of the FWRC. Applicability—FWRC 19.120.020 states that no person shall remove any trees on a site without first obtaining approval of a tree retention plan by the director of community development;except for those activities that are exempt as described in FWRC 19.120.030. Removal of Dead, Dying, or Diseased Trees—FWRC 19.120.030(12) exempts the removal of overhanging vegetation and fire hazards,or removal of invasive species,hazard trees,nuisance vegetation,or dead,dangerous,or diseased trees when authorized by the director or his/her designee. Pursuant to FWRC Table 19.120.130(1): Minimum Tree Density Requirements for Vacant or Redeveloping Sites Land Use Designation Required Tree Unit Density BC,BN,CE,OP,PO 20 tree units/acre Parking Lot Landscaping Requirements—FWRC 19.125.070 states that Type IV landscaping shall be provided within surface parking areas. FWRC 19.125.050(4),detailing Type IV landscaping,states: "(4) Type IV—Open Area Landscaping. (a) Purpose.Type IV landscaping is primarily intended to provide visual relief and shading while maintaining clear sight lines typically used within vehicular paved areas. (b) Description.Type IV landscaping shall consist of trees planted with supporting shrubs and groundcover. Shrubs shall be pruned at 40 inches in height,and the lowest tree branches shall be pruned to keep an eight-foot clearance from the ground. One tree per landscape island up to 150 square feet shall be planted. One additional tree shall be planted for landscape islands up to 305 square feet.Tree,shrub,and groundcover spacing shall be appropriate for the species type,and the intent of this section.See FWRC 19.125.070 for location of Type IV landscaping." 20-100009-00=0.D Doc.I D.80088 Mr.Gary Wu Page 4 of 4 January 29,2020 ANALYSIS/FINDINGS • The applicant proposes removing six trees.With the removal of these six trees,the site will still contain 154 tree units.The remaining tree units exceed the level of 33 tree units as required per FWRC 19.120.130. • Trees approved to be removed are not located within any critical areas or buffers.Tree#1 exists within a wetland buffer,but is not located on the applicant's property.The city has determined that Tree#1 lies on an abutting city owned parcel(#926470-0040).
