At our meeting today-, we discussed how the S 324th Street extension project and the connection
to 32'a Ave S and S 323rd Street could be modified to accommodate DaVita's proposed
development consistent with their goal of having no streets between their existing and proposed
buildings.
As discussed, it appears to be in our mutual interest to have DaVita expand within the City. At
the same time, it is also important for the City to maintain adequate transportation mobility,
inclusive of vehicle, bicycle and pedestrian, to support existing and planned development
consistent with our Comprehensive Plan.
As such, although it reduces connectivity between 32nd Avenue and the S 324th Street extension,
the City is supportive of the proposal to extend S 324th Street eastward directly to Weyerhaeuser
Way S instead of terminating the extension at the intersection of S 323rd Street and 32nd
Avenue S in order to meet. DaVita's site plan goal, provided the parcel owner to the South that
the revised alignment would impact is also supportive of this concept. We believe that this
modification is functionally consistent with the alignment's current design.
This does complicate the City's ability to maintain connectivity between existing and planned
segments of the BPA Trail across 1-5, and we therefore will need to jointly pursue alternatives to
provide non -motorized connectivity between the 1-5 / S 324th Street interchange and the BPA
corridor east of 1-5. This may involve a trail connection through the DaVita property between
S 324th Street and 32nd Avenue S.

3120 S 344TH ST; Right -of -Way Modification Request
Dear Mr. LaBrie:
This letter addresses your right-of-way modification request dated August 12, 2016, to revise the
requirements for Weyerhaeuser Way South frontage improvements. Weyerhaeuser Way South is
a Minor Arterial, consisting of a 66-foot street with curb and gutter, 6-foot planter strips with
street trees, 8-foot sidewalks, and street lights within a 100-foot right-of-way.
Staff has reviewed applicable zoning and development standards. As established by the
Weyerhaeuser Company Concomitant Pre -Annexation Zoning Agreement (CZA), the 1994
Federal Way City Code (FWCC) applies. This code requires full frontage improvements and
right-of-way dedication for the entire width of Weyerhaeuser Way S for any amount of building
square footage exceeding the 300,000 square feet excluded by section 14.2 of the CZA. Since
the proposed building is 314,424 square feet, full frontage improvements are required by the
applicable code.
The right-of-way dedication will shift property lines toward the interior of the lot. As directed
by the CZA, the full 50' vegetated buffer adjacent to the right-of-way must be provided.
Further modifications were requested to the pedestrian path requirements as follows:
Modification #1: Request to use the current sidewalk configuration (S'sidewalk abutting the
curb, no planter strip) for that portion of Weyerhaeuser Way S that has sidewalks.
This request is denied. Weyerhaeuser Way S must be constructed to meet applicable standards
as outlined above. Pedestrian facilities must be ADA compliant, including requirements for
separation between the sidewalk and the curb. ADA compliance is of particular concern at the
roundabout.
tYlodr ication #Z: Request to connect sidewalk to the paved shoulder at the current location of
the guardrail.
This request is denied. The developer is required to provide sidewalk and planter strip meeting
applicable City standards. This shall extend from the truck entrance to the freeway ramp
pedestrian crossing. The sidewalk and planter strip must be placed behind the guardrail. The
developer must provide a striped pedestrian crosswalk to connect with the existing ADA ramp.
ADA requirements must be met for new and existing connections.
Modification #3: Request to place sidewalk at back of curb and eliminate planter strip
requirement for a distance of approximately 95 ' south of the roundabout due to the existing
wetland.
This request is denied. The sidewalk and planter strip must be placed at the ultimate location for
full build -out of Weyerhaeuser Way S. Since this wetland will be within public right-of-way, the
applicant will need to work with Community Development Department and any applicable State
and Federal governing agencies to determine required mitigation.

Hi Mark,
As we discussed on 9/1/16, during review of Preferred Freezer's Right-of-way Modification Request for Weyerhaeuser
Way S, right-of-way dedication came up. Currently, Weyerhaeuser Way S has a dedicated right-of-way width of 60 feet
between the northwest corner of the Preferred Freezer site and the east side of the site. Approximately 300 feet south
of the roundabout, the right-of-way widens to 100 feet . Both the 1994 standard and the current cross-section adopted
by Federal Way Revised Code require a 100-foot right-of-way for this street. Under the 1994 code, right-of-way
dedication and frontage improvements would be required for the entire 100 -foot cross-section. Current standards only
require half -street improvements and dedication, which would result in a dedication area that is approximately 1,100
feet long and 20' wide (22,000 square feet, more or less).
For the pre -application conference, staff reviewed Federal Way Revised Code and determined that frontage
improvements and right-of-way dedication would normally be required. However, the Weyerhaeuser Company
Concomitant Pre -Annexation Zoning Agreement, section 14.2 , dictated certain limitations. Frontage improvements
could not be required at this time since the proposed use did not exceed the equivalent trip generation of 300,000
square feet of Corporate Office Park development. There were also no compelling, immediate capacity or safety issues
that would require additional right-of-way. Since the frontage improvements could not be required, staff believed that
the agreement also limited the right-of-way dedication. The pre -application summary letter informed the applicant of
the potential twenty foot right-of-way dedication, but did not specify that it needed to occur at this time.
With additional information, staff determined that the development actually exceeds the concomitant agreement
limitations by generating trips equivalent to a 314,000 square foot Corporate Office Park development. This does not
exceed the limitations enough to provide the nexus necessary to require frontage improvements. However, further
review revealed that right-of-way dedication was not specifically limited by the concomitant agreement. The City has
consistently required right-of-way dedication as a condition of development, even when no frontage improvements
were required. Not doing so in this case would be inconsistent with City policy. It would also cause undue
complications for right-of-way development that will be necessary, given the potential scope of future development in
East Campus.
If the twenty feet is dedicated at this time, it will impact the site plan and associated engineering plans that have been
submitted for land use approval. The required 50' forested buffer would need to be moved further into the site, and
portions of the parking lot would need to be reconfigured. The building location and southern boundary line could be
impacted. A first review of the site plan has been completed and comments were provided, but this issue was not
raised.
If the dedication is not completed at this time, the City will have to acquire the right-of-way at a future date. Upon
dedication, the forested buffer will effectively be reduced to 30', according to the provisions of the concomitant
agreement.
We are seeking your opinion on the legal ramifications of a decision to require right-of-way in this instance.

Request to Modify and Waive Frontage Improvements
Dear Mr. Salloum:
We are currently pursuing a Process III approval for development of a 19-acre site, located
on the west side of Weyerhaeuser Way S, just north of Highway 18. This development will
require frontage improvements to be installed along Weyerhaeuser Way S that meet the
current City standards, which include an 6'-wide planter strip and an 8'-wide sidewalk.
With this letter, we are requesting a modification to city standards to allow the following:
Modification #1 - Use of the current sidewalk configuration for that portion of
Weyerhaeuser Way S that has sidewalks;
Modification #2 - Allow the new sidewalk to end approximately 137' before the
southern extension of the property frontage; and
Modification #3 - Allow the new sidewalk configuration to be placed against the
curb for a distance of approximately 95'.
Modification #1
We understand that the existing sidewalk configuration along this property's frontage has
served the pedestrians in this area well without issue since its installation many years ago.
Any requirement to remove and replace it will provide absolutely no benefit to the
pedestrians who use it, and this action would result in a substantial cost to the developer
that is not warranted.
Modification #2
Sarady has provided the comment in the City's Process III response letter that the
sidewalk, street lighting and planter strip would need to be extended to the SR-18
westbound on -ramp signal, We are requesting to modify the sidewalk and planter strip
requirement for the southerly 137' of the property frontage because it would conflict with
the existing WSDOT guardrail installed in this location. Furthermore, a sidewalk placed in
this location would be behind the guardrail, leading to a dead end.

Instead, we are proposing to connect the sidewalk to the paved shoulder at the current
location of the guardrail; therefore, pedestrians can continue southbound and cross the
on -ramp using the current handicap ramp and crossings recently installed by WSDOT.
This is very similar to the improvements that were provided on the southeast side of the
interchange for development of King County parcel 222104-9040.
Modification #3
The current sidewalk configuration (adjacent to the back of curb) ends just south of the
Weyerhaeuser Way S and 33`d Place S roundabout We are requesting to extend this
configuration approximately 95' before making the transition to the new location, behind a
6'-wide planter.
The reason for this modification is to avoid impacts to an existing wetland (wetland DQ)
and its buffer which are located within the 50'-wide managed forest buffer that parallels
Weyerhaeuser Way S in this location.
Enclosed with this letter is a check for $160 and a copy of sheet ST-01 of the Process III
plan set with the appropriate areas highlighted for easy reference. As always, we are
happy to meet with you to discuss the particulars of this matter in an effort to resolve this
quickly.
