The application proposes the placement of a permanent prefabricated office trailer at the existing tow lot located at the above -referenced address. Your application is hereby conditionally approved per the conditions and findings noted below. Be advised that the office trailer cannot be installed until you receive building permit approval from the department's Building Division. Conditions of Approval 1. New chain -link fencing shown on the site plan shall be vinyl coated mesh with powder coated poles and a dark color as required by Federal Way Revised Code (FWRC) 19.115.090(2)(f). 2. The existing un-permitted trailer must be removed from the site prior to the installation of the new trailer. FINDINGS OF FACT 1. Applicant originally submitted the Use Process I application for after -the -fact consideration of an un- permitted office trailer located on the existing tow lot that would be used on a temporary basis. 2. The request for the temporary use of the un-permitted office trailer was abandoned and now the applicant is requesting the permanent installation of a 672 square -foot (12' x 56') pre -fabricated office trailer. 3. Nonconforming development regulations set forth in FWRC 19.30.090(1)(a)(ii) requires the applicant comply with all development regulations applicable to the geographic portion of the site on which the new structure is to be constructed. Planning staff has identified the required five-foot Type III perimeter landscaping along the South 343rd Street frontage to be lacking and within the geographic portion of the site. 4. Applicant has submitted a landscape plan prepared by a registered landscape architect that proposes a five-foot Type III landscape screen along the South 343rd Street frontage that meets the purpose and description identified in FWRC 19.125.050(3). Placement of the prefabricated office as shown on the proposed site plan is outside of required yards set forth in FWRC 19.240.050 of 20' front, 15' side and 15' rear. The prefabricated office meets applicable Community Design Guidelines of FWRC Chapter 19.115 in context with the surrounding uses and access. The subject property is located near the end of a private road that extends off Pacific Hwy South. The property is not visible from the right-of-way and is surrounded by similar uses such as vehicle repair yards. The entrance will be clearly recognizable from the adjacent street and as a condition of approval the proposed chain -link fencing will be required to meet requirements of CE district guidelines. CONCLUSIONS OF LAW 1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in FWRC 19.15.020 — Exceptions. 2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements are to a development site, and they do not exceed thresholds set forth in FWRC 19.15.030(1). 3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(1) Minor New Construction. 4. The Federal Way Comprehensive Plan and zoning designation for the subject property -is Commercial Enterprise (CE). Pursuant to FWRC 19.240.050, the subject property's tow lot use is permitted in the CE zoning district. 5. The proposed improvements meet Process I purpose criteria set forth in FWRC 19.55.020 including compliance with applicable provisions of FWRC Title 19 `Zoning and Development' and health, safety, and welfare standards. 6. Building permit approval is required prior to installing the office trailer as the installation is subject to applicable regulations set forth in FWRC Title 13 `Buildings'. APPEALS The effective date of this decision is November 16, 2014. Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by November 30, 2014. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval does not constitute building approval. The project narrative states the trailer will be used in conjunction with the cleanup of the site, which is a precursor to submitting permits and ultimately building a permanent structure on the site. The department is unable to issue an approval until items below are clarified. BACKGROUND During a phone conversation on Wednesday, June 18, 2014, you informed me that in addition to using the trailer for cleanup purposes, you also use the trailer for Ongoing operations for your. business, specifically For auctions you hold approximately two times a month. This type of operational use is outside the scope of what the city would allow under regulations for temporary buildings set Forth in Fedewl Wary Revised Code (FIVRC) 19.275.080. In order to utilize the trailer for operational purposes, nonconforming aspects of your property near the placement of the trailer will need to be brought up to current standards. This would include, but may not be limited to, a five foot landscape screen along the property frontage. ZONING & LAND USE REQUIREMENTS The department would allow you to use the trailer on a temporary basis for one year as a "job shack" to clean up the property as indicated in your project narrative, but will not allow its use for other business operations unless applicable portions of the site are brought up to current standards. A signed confirmation by you that you are using it for cleanup purposes only will be required prior to Use Process I approval. Alternatively, if you would prefer to use the trailer for operational purposes, a landscape plan prepared by a registered landscape architect detailing a Type III landscape screen five -feet in width along the South 343rd Street frontage will need to be submitted. Other applicable nonconforming aspects may also need to be brought into conformance and traffic mitigation fees may be required as additional analysis of the site is completed. Additionally, the trailer is within the 20-foot required front yard. Pursuant to FWRC 19 240.050, the trailer must be setback at least 20-feet from the South 343rd 'Street vehicular easement. Whether you move forward with the temporary job shack request or operational use request, you will be required to relocate the trailer outside of the required yards assigned to the tow lot use. Burt Page 2 of 2 July 1, 2014 IMMEDIATE ACTION REQUIRED This is an after -die -fact permit request and as such, you have a non-exempt structure on the subject property that has been installed without the required approval of die city and in direct conflict with FWRC 19.15.030 and 19.190.060. You will be required to expedite submittal of intention and/or plans within 30-days of this letter, or enforcement action which includes but is not limited to the abatement of d-ie unpermitted structure by the city. Costs associated with city abatement of the structure will be borne by the owner via liens placed on property. This letter identifies only zoning requirements for the trailer use. The trailer also requires a building permit and compliance with applicable building codes. You will need to contact the Permit Center at 253-835-2607 for more information regarding the building permit requirements. NEXT STEPS To avoid enforcement action, you will need to submit the following items to the Permit Center by July 30, 2014: 1. A signed confirmation the trailer will be used for cleanup purposes only and not operational purposes; or submit a landscape plan prepared by a qualified professional with the five-foot Type III landscape screen along the South 343rd Street frontage if you will use the trailer for operational purposes; and 2. Revise the site plan to indicate the trailer meets the front yard setback of 20-feet from the South 343rd Street vehicular access easement and 15-foot side and rear yard setbacks; and 3. First, we are only able to provide you with Use Process I approval for the trailer if it is used as a temporary building associated with construction or development activities on the property. We consider these types of buildings as "job shacks." We would consider site clean-up and fence construction you mentioned in the application narrative to fit these purposes. However, any uses associated with ongoing operations of your business, such as using it as an office or the auction purposes you referred to during our phone conversation, would be outside the scope of what we would allow under Federal Way Revised Code (FWRC) 19.275.080 regulations for temporary buildings. In order for the department to issue a Use Process I approval for your trailer, the department would condition it's use solely for those clean-up scenarios you presented and the trailer's use would be limited to one year. If you are going to use the trailer as an office or for auction purposes, then it is considered the addition of new gross floor area and nonconforming development regulations are triggered. This means you would need to bring portions of the site up to current code. Please let me know if this is your objective. If so, we'll need to evaluate what items need to be brought up to code and the types of plans you will need to provide. Second, from what you show on your site plan and what I saw on a site visit today, it appears the trailer is within the 20- foot required front yard of the property. As detailed on the attached Use Zone Chart, the required yard (or setback) for all structures is 20-feet for front yards and 15-feet for side and rear yards. While South 343`d St. is a private street, required yards still apply. Required yards are the minimum required distance between a structure and a specific line such as a vehicular access easement as stated in FWRC 19.05.180. Additionally, in order for the department to issue the Use Process I approval for your trailer, it will be conditioned that it is moved to meet the required yard regulations. Please let me know how you would like to proceed. You had mentioned during our phone conversation that you were going to remove trailer and not go forward with the permitting. If you choose to remove the trailer, let me know and I will cancel the application. Tim Burt, the owner of 1 Stop Services Towing & Recovery has leased the property and is currently in the process of rehabilitating the property which will include the removal of trash and debris. As of this date 1 Stop Services has already properly disposed of a half ton of debris, replaced an unsafe power pole (private) that is on the property and replaced it with a solid pole, and replaced the electrical fixtures. As we continue our cleanup project we would like to place a temporary construction office for 1-year. During this 1-year our goal is to phase in some additional work to the property (listed below). Please see the attached map -outlining placement for the temporary construction office. During this transition 1 Stop Services will be occupying this office along with the contractor - this will only be until the permanent structure can be completed on the property.
