The project proposal is to extend the LPS along 44`h Avenue SW and SW 307th Street. Improvements would be located along the public right-of-way, beneath the existing road surface,or along the shoulder of the existing road. A portion of the proposed improvements intrude within a geologically hazardous area, stream setback, and wetland buffer. The LPS system extension is necessary because it was determined that the soils in the area are not adequate to support a new septic system due to King County Health Department regulations. WETLAND BUFFER AND STREAM SETBACK Per Federal Way Revised Code(FWRC) 19.154.040(3)and 19.165.070(1),the Director of Community and Economic Development may permit the placement of an essential public facility, public utility,or public improvements in a regulated wetland buffer and stream setback, if it is determined that the line or improvement must traverse the buffer because no feasible or alternative location exists based on an analysis of technology and system efficiency. As septic systems fail or the remaining properties are developed,they will need to connect to the public sewer.This project will eventually serve all properties in the area of the proposed LPS expansion and is therefore considered an essential public facility rather than a private utility. The specific location and extent of the intrusion into the buffer must constitute the minimum necessary encroachment to meet the requirements of the public facility or utility. The city utilized a previous wetland report prepared by Landau Associates dated June 13,2011,and addendum dated July 20, 2011, for a similar project in the same vicinity. Upon review of the project narrative and site plan, along with a wetland report,the City of Federal Way has concluded that no other feasible/alternative location exists based on the analysis of technology and system efficiency. The encroachments into the Category II wetland buffer and stream setback takes place beneath the existing paved surface at 44th Avenue SW, with the paved surface being restored after the new water main is installed. Furthermore, the water main will be installed with direction boring to reduce any impacts that could occur to the road, public access,or any impacts to the adjacent wetland and the stream. Mr.Allen February 10,2012 Page 2 GEOLOGICALLY HAZARDOUS AREAS According to the City's Critical Areas map, the water main improvements are also within a geologically hazardous area. Pursuant to FWRC 19.160.010(2),the Director of Community and Economic Development is authorized to grant approval of intrusion into such areas if the following two criteria are met: (I)no reasonable alternative exists,and(2)the development activity or land surface modification will not lead to or create any increased slide,seismic,or erosion hazard.No reasonable alternative exists as the proposed water main replacement is necessary to accommodate future potential of septic system failures in the area. After reviewing a previous Geotechnical Report, prepared by Landau Associates, dated June 8, 2011,potential impacts will need to be mitigated by using erosion control methods. CLOSING As such,the proposed Dumas Bay Low Pressure Sewer(LPS)Main improvements are hereby authorized to intrude into the regulated wetland buffer,stream setback,and geologically hazardous area.This project has been reviewed for compliance with the Federal Way Comprehensive Plan(FWCP), pertinent zoning regulations,and all other applicable City regulations. This approval shall not waive compliance with future City of Federal Way codes,policies,and standards relating to this decision. A City of Federal Way right-of-way permit is needed for this project. They have been in the process of redeveloping the property into a new single family residence. Through our coordination, it was determined that the soils were not adequate to easily support a new septic system due to the current stringent regulations of the King County Health Department. This neccessitated the extension of the LPS system owned by Lakehaven Utility District. Lakehaven Utility District(LUD)and my client have engaged in a developers extension agreement for extension of the LPS system. Lakehaven had already accomplished a basin analysis for the sewer extension prior to our project and had planned to eventually serve all property in the region of the proposed extension with the proposed system.As septic systems fail or the remaining properties are developed, they will need to connect to the public sewer as site soils will most likely be insufficient to meet existing health departments requirements. This system is therefor considered an essential public facility to be installed within the roadway prism. Currently, we are in the latter stages of having the design approved through LUD. It came to our attention that the City of Tacoma is upgrading their water main in the same alignment as our sewer main extension. In discussions with them for coordinating our designs, they informed us that they were required to obtain an exemption from the Critical Areas ordinance as their alignment passed through wetland and stream buffers, even though it was in the roadway prism.The City of Tacoma Utilities provided wetland delinations and studies and supplied them to the City of Federal Way for their exemption. Since we are following the same road alignment and not deviating from the roadway prism,we are asking for the same exemption that was approved for the City of Tacoma Utilities water main extension project. We are also asking for the wetlands that were previously identified by the City of Tacoma study and submitted to the City of Federal Way to be utilized for reviewing this expemption application as it was recently reviewed by the City. Per the Federal Way Municipal Code 19.175.040(3) Structures, improvements and land surface modification within regulated wetland buffers states: (3) Essential public facilities, public utilities and other public improvements. The director of community development may permit the placement of an essential public facility, public . . • utility or other public improvements in a regulated wetland buffer if he or she determines that the line or improvement must traverse the buffer because no feasible or alternative location exists based on an analysis of technology and system efficiency. The specific location and extent of the intrusion into the buffer must constitute the minimum necessary encroachment to meet the requirements of the public facility or utility. It appears that 44th was installed before wetlands and stream critical areas protections were first implemented and essentially crossed a stream and the associated wetland. The utilities needed to provide the exisitng residential properties with water and sewer must be able to fall within the roadway prism but will in effect be within the wetland buffer identified by the City of Tacoma Utilities environmental reports. There are no alternatives for placement of the sewer line that would not enter into these buffer lines as it must follow the alignment of the road. The proposed alignment is within the roadway and or shoulder of the roadway and will be installed with direction boring to reduce any impacts that could occur to the public road, public access or any impacts to the adjacent wetlands. It is expected that construction within this buffer region will actually only consitute several days work at the most. I understand in discussions I have had with Matt Herrerra, a City planner, that the code is changing at the beginning of January. Currently, a SEPA checklist is required for this exemption request and would have to go through the process.We are requesting that this exemption be approved after the new regulations are put into effect in January to allow for this project to not go through the SEPA process. For a project like this, SEPA is unneccessary and not cost my client would like to have at this point. Currently, they are bearing the costs of the design and installation of the sewer main extension so any cost savings to the project are appreciated. They have already been through a lengthy process for shorelines and zoning requirements on their new residence. I would appreciate a quick review of this project. I have attached the plans that are awaiting final approval for the City of Federal Way on this letter. Please reference the City of Tacoma Utility plans and reports for critical area designations along our alignment.
