The following information addresses the specific questions included in the request. The current zoning classification for the subject properties are is Multifamily Residential (RM). Specifically, parcel number 720480 0095 is RM1800 and parcel number 720480 0111 is RM2400. The adjacent property zoning designations to 720480 0095 are as follows: North: The city of Kent South: Single Family Residential (RS7.2) East: Multifamily Residential (RM1800 and RM 2400) West: Community Business (BC) The adjacent property zoning designations to 720480 0111 are as follows: North: Multifamily Residential (RM1800) South: Single Family Residential (RS7.2) East: Multifamily Residential (RM1800), Single Family Residential (RS7.2 and RS5.0 West: Multifamily Residential (RM1800), Single Family Residential (RS7.2) The subject parcel is a “Permitted Use by Right,” currently regulated by Federal Way Revised Code (FWRC) Title 19, “Zoning and Development Code,” Chapter 19.205, “Multifamily Residential (RM),” 19.205.040, “Multifamily Dwelling Units.” The subject parcel is also regulated by FWRC Chapters 19.115 “Community Design Guidelines”; 19.125 “Outdoors, Yards and Landscaping”; 19.145 “Environmentally Critical Areas”; and 19.140 “Signs”; among other aspects of FWRC Title 19 regulating development of the subject parcel and its associated zone. The subject property was developed initially under the jurisdiction of King County, prior to the adoption of the city’s zoning code. Due to the development occurring prior to 1990 when the City of Federal Way incorporated, the apartment complex, Club Palisades Apartments, were built under the jurisdiction of King County. Therefore, the city cannot say whether or not the property was developed with site plan approval. King County was the applicable zoning and building authority at the time of construction for this property. Contact the King County Department of Permitting and Environmental Review Record Center at permitrecords@kingcounty.gov, or 206-296-6696, to inquire about records and site plans they may have. You will need to provide them with the parcel number(s) pertaining to the property. There are currently no variances, special permits/exemptions, or conditions according to the city’s database. According to the city’s database, there are no outstanding/open zoning or building code violations that apply to the subject property. With regards to fire code violations, South King Fire & Rescue handles fire related records requests. Per FWRC 19.30.200, if a nonconforming use or development is damaged by sudden accidental cause, that use or development, including associated improvements, may be reconstructed if it meets the following requirements: (1) The use or development, including associated improvements, as reconstructed, is not any more nonconforming than it was immediately prior to the damage. (2) The applicant applies for building and any land use permits to reconstruct the damaged improvement within six months of the date of the damage and reconstructs the improvement pursuant to such permits. Verification of conformance is typically performed at the time of a formal project review. At this time, the city cannot confirm compliance with the current zoning code or building requirements without a formal site plan review.
