Dear Cody Cannon:
On November 17, 2020, the City of Federal Way’s Department of Community Development received your
zoning inquiry regarding the property located at 28120 18th Avenue. South, Federal Way, WA 98003 (parcels
332204-9039, 332204-9081, and 632850-0010). Your request for information includes questions listed below
in bold, with the city’s response following.
1. The current zoning classification for the subject property is:
The current zoning classification is twofold on this property. For parcel 3322049039, the zoning
classification is Multi-Family Residential (RM 1800). Parcels 3322049081 and 6328500010 zoning
classification is Multi-Family Residential (RM 3600). The adjacent property zoning designations are:
North: RM 1800, RM 2400
South: RM 3600
East: RS 7.2 (Single Family Residential)
West: RM 1800
2. According to the zoning ordinances and regulations for this district, the use of the subject
property is:
The property’s use as Multifamily dwelling units (stacked dwelling units) is permitted per FWRC
19.205.040.
3. Conformance: Per the current zoning ordinances and regulations applicable to the subject
property, the current structure(s) is:
The time of construction on these parcels was prior to the City of Federal Way’s incorporation.
Verification of conformance is typically performed at the time of a formal project review. At this time,
the city cannot confirm compliance with the current zoning code or building requirements without a
formal site plan review.

According to the city’s database, the subject property has not been granted any variances, special
permits/exceptions, ordinances, or conditions.

conforming property:
If the development is found nonconforming at the time of casualty, then it would have to comply with
the Federal Way Revised Code (FWRC) 19.30.200, which states:
“If a nonconforming use or development is damaged by sudden accidental cause, that use or development,
including associated improvements, may be reconstructed if it meets the following requirements:
“(1) The use or development, including associated improvements, as reconstructed, is not any
more nonconforming than it was immediately prior to the damage.
“(2) The applicant applies for building and any land use permits to reconstruct the damaged
improvement within six months of the date of the damage and reconstructs the improvement
pursuant to such permits.”
If it is a conforming development, then the structure may be rebuilt according to current code.
