As you requested, this letter confirms our conversation of April 28, 2000, regarding the above referenced
property. At that meeting we discussed submittal requirements to verify setbacks from a potential wetland
located north of your property.
The city's wetland inventory currently classifies the northerly wetland as category 11, requiring a 100-foot
setback. Based on the location and configuration of this inventoried wetland, a I00-foot setback would
fall short of your property. However, if the wetland is classified as a category I wetland, the required 200-
foot setback would encumber most, if not all, of the property.
Because the city's wetland inventory was done on a citywide basis, the inventory only represents potential
wetland conditions and classification by type. The inventory cannot be relied upon as an accurate
representation of wetland conditions, location, or type. Therefore, applicants are required by city code to
provide more precise wetland analysis in conjunction with development projects located in proximity to
potential wetland areas.
Based on these circumstances, and in an effort to minimize your expenses in conducting wetland analysis,
I have determined that a phased wetland analysis approach is appropriate. The first step will require you
to hire a wetland expert to verify the wetland category of the northerly wetland. If the wetland is verified
to be a category II, no further wetland analysis will be required. In the event your wetland expert
determines the wetland is classified as category I, then additional wetland analysis and survey will be
required. I will provide you with more specific direction on city requirements in the event the wetland is
determined to be classified as a category I.
Verification of the wetland category can be provided in the form of a letter that evaluates the wetland
based on the city's wetland definition and wetland category criteria. A qualified expert must perform the
work. Upon submittal, the city will evaluate the information to confirm your expert's conclusions.
