soil samples for analysis. The samples were analyzed with EPA
methodology or equivalent methods as specified in the attached
analytical schedule. The results, sample cross reference, and
quality control data were issued under ATI accession number
9101-053 on January 16, 1991.
Two samples were reaccessioned for additional tests on January 24,
1991. Enclosed is the report for the additional analyses.

t:\tcp\vcp\GEN-VCP\VCP-LOG.xIs or can be obtained from Pat Melone. Please remember to total
the "Hours" column and to sign and date all logs. KEEP THE SITE LOG WITH THE FILE. Do
NOT TURN THEM IN WITH YOUR TIME SHEETS.
2. Hold on to final determination letters ("NFA° or "Further Action Required") until: a)
accumulated fees have been collected or b) any Restrictive Covenants have been filed.
3. Check the "Release Information" on pages 3 & 4 of the Site Summary form. Please check
to see that the information entered is a fair approximation of the cleanup. If you make changes or
update the data, please use red (green, purple, orange, etc.) ink so data entry folks can spot any
changes quickly.
4. Complete the Environmental Indicators form (attached). The PREFERRED ALTERNATIVE
is to use the Excel version in t\tcp\vcp\review\forms\ENVID.XLS and e-mail itto me. The
guidelines for completing the form are in ENV IND.DOC.
5. Return the entire file to me when done. Remove all post -it notes and markers from files.
Include site logs, a signed copy of the determination letter (NFA or Further Action required), a
copy of the recorded restrictive covenant, and all the files. Please note the date you went on
site by highlighting the date on your site log.
Given the increasing frequency with which independent remedial action sites are the subject of
litigation, with Ecology's decisions serving as the basis for some of it, I strongly suggest that you
have your determination and correspondence peer -reviewed prior to sending it and that you
document the basis of your decision with a brief memorandum to file.

1. Site Description (include site address with street, city, and county; physical
description; current and historical uses of site; etc.):
The site is located at 29625 Pacific Highway South in Federal Way, King County in an
area of mixed residential and commercial properties. It is approximately 0.96 acre in
size. A UNOCAL gasoline station was constructed in 1969 and operated till 1990. The
site was. then occupied by an automobile sales facility and U-Haul company during the
early 1990s. The UNOCAL; gasoline service station building was demolished in 1994195.
The current underground storage tanks and fueling system were installed in 1995 as part
of the construction for the existing gasoline service station and convenience store. The
site slopes steeply downward toward the north-northwest, an undeveloped area covered
by vegetation.
2. Describe affected media (soil, groundwater, surface water, sediment, air):
Soil was contaminated by petroleum products during the period when UNOCAL gasoline
station operated the site. Two 10, 000-gallon gasoline USTs, one 520-gallon waste oil
tank and one 550-gallon heating oil tank were removed from the subject site in 1989.
The steel gasoline tanks were replaced by two 12,000-gallon double -wall fiberglass -
coated steel USTs. The steel waster• oil tank was replaced with'a 520-gallon double -wall
fiberglass: -coated steel tank. The steel heating oil tank was removed but not replaced.
Petroleum contaminated soil was discovered during the tank removal. Approximately
600 cubic yards of contaminated soil was removed from beneath the gasoline USTs and
100 cubic yards from beneath and in the vicinity of the former waste oil UST. However,
soil confirmation samples showed residual contamination in the vicinity of the former
waste oil UST excavation area, and it was concluded that removal of the remaining
contamination would require removal of the service station building and the new tank. A
vapor well was installed in 1990 to monitor the conditions- in the vicinity of the former
waste oil tank excavation area.
Groundwater was not encountered during any borings which reached 30 feet below
ground surface (bgs). It is anticipated that the depth to groundwater at this site is greater
than 100 feet.

The two fiberglass -coated steel gasoline tanks and the fiberglass -coated steel waste oil
tank which were installed in 1989 were removed. between December 1990 and January
1991. The product lines and the vapor well were also'removed. Approximately 50 cubic
yards of soil were excavated from the waste oil tank excavation area, 50 cubic yards from
the gasoline tank excavation area, 10 cubic yards from the product -line excavation and
180 cubic yards of 'soil were removed from the vapor well test pit excavation area. All
the contaminated soil was disposed off site. One soil confirmation sample taken at the
vapor well excavation pit around the depth of 16 feet showed TPH (heavy oil- range) of
280 mg/kg, which was above the MTCA A cleanup Levels at that time, but is below the
current cleanup level of 2000 mg/kg. All the other soil confirmation samples showed
compliance with MTCA Method A cleanup requirements. -
A Limited Phase If investigation was conducted in the subject site in 2001. All the soil
samples showed compliance with MTCA Method A Cleanup Levels for Unrestricted
Land Use.
"Note:
a. Table 1 of appendix A from the Report of Request for Determination of No
further Action dated on November 23, 2005 has both performance and
confirmation sampling results.
b. Remediation was conducted in 1989 and 1991. However, the site owners didn't
officially request a No Further Action determination at that time and the site
remains on Ecology's Confirmed and Suspected Contaminated Site list. Joe
Hickey issued a letter dated on April 22, 1991 for the subject site. Joe stated in
his letter that proper procedures were followed regarding the tank removal and
site remediation.pursuant to federal and state regulations. Joe also stated that the
residual contamination was -insufficient to warrant further action. Noted here
MTCA method A Cleanup Levels for TPH has been changed after Joe issued the
letter.

Thank you for submitting your independent remedial action report for the FederalWay Deli Mart
Site for review by the State of Washington Department of Ecology (Ecology) under the
Voluntary Cleanup Program (VCP). Ecology appreciates your initiative in pursuing this
administrative option for cleaning up hazardous waste sites, under the Model Toxics Control Act
(MTCA), Chapter 70.105D RCW.
This letter constitutes an advisory opinion regarding whether further remedial action is necessary
at the Site to meet the substantive requirements of MTCA and its implementing regulations,
Chapter 70.105D RCW and Chapter 173-340 WAC. Ecology is providing this advisory opinion
under the specific authority of RCW 70.105D.030(1)(i) and WAC 173-3407515(5).
This opinion does not resolve a person's liability to the state under MTCA or protect a person
from contribution claims by third parties for matters. addressed by the opinion. The state does
not have the authority to settle with any person potentially liable under MTCA except in
accordance with RCW 70.105D.040(4). The opinion is advisory only and not binding on
Ecology.

prepared by GeoEngineers on January 17, 1991.
3. Report of Remedial Action Underground Storage Tank Removal Unocal Service
Station 6227 King County, Washington, prepared by GeoEngineers on April 10;
1991.
4. Letter Report Limited Phase II Investigation Shell Service Station and Mini Mart
29625 Pacific Highway South, Federal Way, Washington, prepared by Assessment
and Remediation Consulting Services on April 9, 2001.
The documents listed above will be kept in the Central Files of the Northwest Regional Office of
Ecology (NWRO) for review by appointment only. Appointments can be made by calling the

The Site is defined by the extent of contamination caused by the release of petroleum products to
soil. The Site is more particularly described in Enclosure A to this letter, which includes a
detailed -Site diagram. The description of the Site is based solely on the information contained in
the documents listed above.
Based on a review of the independent remedial action report and supporting documentation listed
above, Ecology has determined that the independent remedial action(s) conducted at the
Site are sufficient to meet the substantive requirements contained in MTCA and its
implementing regulations, Chapter 70.105D RCW and Chapter 173-340 WAC, for
characterizing and -addressing the contamination at the Site. Therefore, pursuant to WAC .
173-340-515(5), Ecology is issuing this •opinion that no further remedial action is necessary at
the Site under MICA.
Based on this no further action determination, Ecology will update the'status of the Site on its
site database and remove the Site from the Confirmed and Suspected Contaminated Sites List
and the Leaking Underground Storage Tank (LUST) Lisf.
This no further action determination does not apply to any other release(s) or potential release(s)
of contaminant(s) that may impact any other portion of any property impacted by this Site, or
any other property owned or operated by Mr. Yung Ho Han.
