Hi Natalie,
In general the following is applicable and/or must be submitted for the proposed access stairs for a shoreline property. Please note this
may not be all the permits required by the city; I can only speak about zoning and land use requirements based on the preliminary
drawings. For building permit requirements contact the permit center at 253-835-2607 or permitcenter@cityoffederalway.com.
Shoreline Substantial Development Permit: The proposed project is located with Suburban Estates(SE)zoning district. The
properties shoreline designation is'Urban Conservancy' in the city's Shoreline Master Program(SMP)overlay.Areas within 200 feet of
the marine shoreline, including the Urban Conservancy designation area, are regulated under the state's Shoreline Management Act,
which is administered locally via the city's SMP.
Under FWRC 15.05.070—Summary of Uses,the use of the property for shoreline purposes is considered residential.The stairway is
considered accessory to that use. The development is not exempt from substantial development permit requirements as it is not a
normal appurtenance to the existing single family home per WAC 173-27-040(2)(g).A Shoreline Substantial Development permit will
be required which is reviewed pursuant to FWRC Chapter 19.65, Process III 'Project Approval.' The project is exempt from SEPA
environmental review,WAC 197.11.800(2)(f).The proposed stairs will not be constructed on lands covered by water and is an addition
to a single family house,which is exempt from SEPA review.
Any work within the Urban Conservancy designation shall comply with the General Requirements(a)through(f)of FWRC
15.05.090(3).Residential development is allowed within the urban conservancy designated areas under FWRC 15.05.080(5)(a)(i)with
additional restrictions. The formal application must demonstrate that any proposed improvement meets all applicable criteria.
Height and Setbacks—The stairs cannot exceed 30 feet tall.Setback is 50 feet from OHWM,or as required for protection of critical
areas,whichever is greater. Please Note:accessory uses are permitted to intrude into the setback from the OHWM, but accessory
uses in the setback are limited to eight feet in height and cannot cover more than 150 sq.ft., unless a shoreline variance is obtained.
Geologically Hazardous Areas—According to critical areas maps, the site contain Geologically Hazardous Areas(GHA)regulated
under FWRC 15.10.160.Any work that is on or within 25 feet of a defined geologically hazardous area including erosion hazard,
landslide hazard,seismic hazard, and steep slope hazard areas may be approved by the director only if no reasonable alternative
exists and if the proposal will not lead to or create any increased slide,seismic,or erosion hazard. In order to review the new stair
improvements, a professionally prepared soils report that describes how the proposed actions will impact each of the following on the
subject property and on nearby properties must be submitted for review:
o Slope stability, landslide hazard,and sloughing;
o Seismic hazards;
o Groundwater;
o Seeps,springs, and other surface waters;and
o Existing vegetation.
The report should also include recommended methods for mitigating identified impacts and a description of how these mitigating
measures may impact adjacent properties.
The geotechnical report review will be subject to land use review and should be included with other reviews for the subject property.
Please note that peer review will be required as provided under FWRC 15.10.080 Basis for Determination.Your proposal will be
forwarded to the City's geotechnical engineering consulting firm for fee evaluation. The applicant must pre-pay the Geotechnical
Consultant review fee, which will be held in an account maintained by the City.

Cultural Resources—The city is aware of archaeological sites that have been located in and along this shoreline.With authority
granted by FWRC 15.05.040(6),the department will require,as a condition to the shoreline permit,a site inspection and evaluation by
a professional archeologist prior to issuance of any permit.The evaluation shall include recommendations for monitoring of potentially
disruptive activities,data recovery,and/or mitigation measures if warranted.The archeologist report should be submitted as a
component of the shoreline permit submittal. Note that the city would consider waiving this report if Department of Archaeology and
Historic Preservation(DAHP)indicates that such a report is not necessary in this case.
I've attached a Master Land Use(MLU)application and checklist of requirements for the shoreline permit. If you have already filled out
the shoreline substantial development permit application that was online you can turn that in instead of the MLU. If you have any

Purpose of the checklist
The State Environmental Policy Act (SEPA), RCW Chapter 43.21 C, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of
the environment. The purpose of this checklist is to provide information to help you and the agency identify
impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help
the agency decide whether an EIS is required.
Instructions for the applicants
This environmental checklist asks you to describe some basic information about your proposal. Governmental
agencies use this checklist to determine whether the environmental impacts of your proposal are significant,
requiring preparation of an EIS. Answer the questions briefly with the most precise information known, or give
the best description you can.
You must answer each question accurately and carefully to the best of your knowledge. In most cases, you
should be able to answer the questions from your own observations or project plans without the need to hire
experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not
know" or"does not apply". Complete answers to the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations such as zoning, shoreline and landmark designations.
Answer these questions if you can. If you have problems, the governmental agencies can assist you.
The checklist questions apply to all parts of your proposal even if you plan to do them over a period of time or
on different parcels of land. Attach any additional information that will help describe your proposal or its
