It is my understanding that you received a correction notice from one of our inspectors stating the deck may not encroach into the required 5-foot required yard setback and wanted to know if you could get a variance or what is needed if you had to remove the deck. Pursuant to Federal Way Revised Code(FWRC) 19. 125.160(3),an improvement or structure that is not more than 18 inches above finished grade may extend not more than five feet into a required yard. In addition, per FWRC 19.125.160(5)fences and railing not over six feet in height may be located in required yards.As such, if your deck is only 18 inches in height where it extends into the side yard setback as stated in the AD request,then it can remain as-is.The privacy fence is also allowed as long as it does not exceed 6 feet in height. I've discussed this with the Building Inspector Andy Norton.Andy said you can call in for building final and he will go out and measure the deck to verify the height.
