Documents in the city's permit database indicate the residential building has been deemed a dangerous or unfit building by the department's Building Official. The residential building is nonconforming to SMP development regulation setbacks.Federal Way Revised Code (FWRC) 15.05.090(5)(a)(i)(A) requires a minimum 50-foot setback from the Ordinary High Water Mark.The existing structure appears to be entirely within this required setback. FWRC 15.05.220(1)(c) allows structures that were legally established but nonconforming with regard to setbacks to be maintained and repaired, but as the structure is wholly encroached into the shoreline setback,it may not be enlarged or expanded. Pursuant to FWRC 15.05.220(2),a nonconforming structure may be replaced if it is destroyed. It must be replaced as it existed prior to the destruction and application for permits must be made within one-year of the destructive occurrence. It does not appear this residence meets these replacement criteria. Be advised that any remodeling or repair of the existing structure will need a shoreline exemption decision and necessary building permits from this department.This letter is limited to analysis compiled with data available from King County mapping,and city development regulations and permit database.No professionally prepared plans were submitted and this is not a land use or building permit.
