Dear Mr. Sommer:
The Community Development Department's Planning Staff has reviewed your Shoreline Substantial
Development Permit Exemption request and Geologically Hazardous Area(GHA) intrusion request for a
proposed deck replacement/expansion at an existing single-family residence. Your requests are approved
per the conditions listed below. Be advised that no work may begin until the associated building permit
(file 15-103190-SF) is issued.
CONDITIONS OF APPROVAL
Prior to issuing the building permit, the applicant shall:
1. Resubmit building permit plans that have been stamped by the geotechnical engineer that
prepared the geotechnical report; or alternatively, submit a stamped letter by the geotechnical
engineer that prepared the report that the engineer has reviewed the building permit plans and the
plans are consistent with the report.
2. Schedule the geotechnical engineer to be onsite at the start of pile installation to verify
appropriate depths and spacing. The geotechnical engineer shall prepare a letter bearing witness
to this account and submit the stamped letter to the Permit Center prior to scheduling final city
inspection of the building permit.
FINDINGS OF FACT
1. The subject property is located at 30901 50th PI SW within the Shoreline Master Program's Urban
Conservancy overlay.
2. The site is located within a Geologically Hazardous Area overlay, specifically a landslide hazard
area.
3. The Department of Ecology Coastal Atlas identifies the proposed improvement area as Unstable
Old Slide(UOS). Pursuant to Federal Way Revised Code(FWRC) 15.05.030, landslide hazard
areas include those areas mapped UOS.
4. The proposed deck replacement and expansion is a normal appurtenance to an existing owner
occupied single-family residence that is landward of the Ordinary High Water Mark(OHWM).
5. The proposed improvements are greater than 50 feet from the Puget Sound OHWM.
6. The proposed improvements meet underlying RS 35.0 zoning bulk limitations including height,
required yard, and lot coverage.
7. The applicant has submitted a geotechnical report prepared by GeoResources that provides an
assessment of site conditions and recommendations for the deck's foundation support.The
geotechnical engineer has not stamped the building permit plans or made reference in the report
to reviewing the plans for consistency.

CONCLUSIONS OF LAW
1. Pursuant to Washington Administrative Code(WAC) 173-27-040(2)(g),the proposed deck
improvements are exempt from obtaining a Substantial Development Permit.
2. Pursuant to FWRC 15.05.130(3)(a),the conditional exemption approval is consistent with the
city's Shoreline Master Program and Shoreline Management Act.
3. Pursuant to FWRC 15.10.160(2),the conditions assure the proposed improvements will not lead
to or create increased slide,seismic,or erosion hazards.
4. Pursuant to WAC 197-11-800(2Xe),the proposed minor new construction is exempt from an
environmental threshold determination.
CLOSING
Again, this Substantial Development Permit exemption and GHA intrusion request does not authorize you
to begin construction of the improvements. Construction may begin when the associated building permit
is issued. Please provide two copies of the items from Condition#1 as a resubmittal to your associated
building permit(file 15-103190-SF)with the enclosed resubmittal form. You may contact Matthew
