Analysis The application states the following: "Disturbance of the surrounding soil and vegetation should be kept as minimal as possible. Standing stumps shall be left "as is"and shall not be ground down, dug up or otherwise altered. Work within the wetland buffer shall be limited to removal by hand, only be desiccated, dead wood debris specifically from the (8) eight downed evergreen trees. No other plant material shall be removed. " As the application states, the removal shall be by hand only and will only include the debris from the fallen trees.No stumps or other vegetation shall be removed. Pursuant to Federal Way Revised Code (FWRC) 19.120.030, the removal of other vegetation is not exempt. Based upon the submitted application, the proposal meets this standard. FWRC 19.120.030(7)states that the following will be exempt from provisions of the code preventing clearing of vegetation within the wetland buffer: Actions which must be undertaken immediately, or within a time too short to allow for compliance with the requirements of this article, to avoid an imminent threat to public health or safety; to prevent an imminent danger to public or private property; or to prevent an imminent threat of serious environmental degradation. This determination will be made by the director. As the application states,the debris poses an imminent fire hazard,putting nearby residents at potential risk.The debris in question falls under"imminent threat to public safety"as outlined in FWRC 19.120.030(7),due to its harmful nature as a fire hazard. Ms.Kuhlman August 20,2018 Page 2 Decision Pursuant to FWRC 19.120.030, the removal of debris within the wetland buffer is hereby approved.The removal of debris is subject to observance by city officials in order to ensure the removal is done properly.
