I am unable to speak to the email correspondence from 2005,as I have not seen it.When Colella Estates was created in 2005,Tract E was established to the west of your property.According to the Colella Estates plat map(copy attached),Tract E was created for play and recreation purposes and was conveyed to the Colella Estates Homeowners Association (HOA),who is responsible for maintenance of the tract. Sometimes various ideas can be discussed during project review. It is what makes it into the final decision that is enforceable.The final plat staff report for Colella Estates contains the following information: "13.All on site fencing associated with plat construction is subject to the City's final review and approval of design, location,and any screening. Fencing shall allow for the migration of small animals.Any chain link fencing, if approved by the City, shall be vinyl coated black or green,and shall be screened with vegetation. Staff Response: This condition has been met through installation of appropriate fencing. Black,vinyl coated chain link fencing has been installed along the top of the Joe's Creek slope,and split-rail fencing has been installed along the wetland buffer. Pursuant to the landscape plan,as approved and bonded, both fences will be screened with vegetation and the landscaping must be installed within six months of final plat approval." Tract E is neither one of the locations that were required to be fenced (along the top of the Joe's Creek slope and along the wetland buffer). When subdivisions(plats)are created,survey markers are placed in the ground by the surveyor at the corners of the new tracts and lots. I've attached the Century Palisades plat map,of which your lot is#14.As your property and Tract E of Colella Estates are private property,the fence is considered a civil matter that the City would not get involved in.The City does not perform survey services on private property. I encourage you to review the plat maps for both subdivisions to see property line measurements and corner marker information, locate any survey markers,contact the Copperleaf HOA, and consult a surveyor if necessary before a fence is installed. Some years ago our back property faced an undeveloped lot of trees and shrubbery. It was removed when homes were built on the property (2005 maybe?). We were told at that time that there would be a fence placed along the back (west) side of our property as the trees etc. were removed. There were a few emails back/forth at some point between us and the city during the development, however nothing ever came of those. The area is now just a field that someone mows down every once in a while. We would like to re-visit either the fence being placed, or having the city of FW come out and put survey markers on the NW and SW points of our property line so we can move forward with placing a fence.
