The Community and Economic Development Department has received your request for exemption from
shoreline substantial development permit requirements. The proposed deck improvements are within 200
feet of the Ordinary High Water Mark of Puget Sound. The subject property is zoned single-family
residential, RS 7.2, and the proposed improvement is located within the Rural environment designation by
the city's Shoreline Master Program (SMP).
PROPOSAL
The applicant proposes to replace a nonconforming deck that was historically built within the side yard
setbacks and potentially within the shoreline setback.
Shoreline Substantial Development Permit Exemption
Washington t4dministrative Code (WAC) 173-27-040 identifies actions exempt from the requirement to
obtain a shoreline substantial development permit. WAC 173-27-040(2)(g) exempts, under specific
circumstances, single-family residences and normal appurtenances, including but not limited to, garages
and decks. Therefore, the remodel of the deck is considered an exempt action and does not require a
shoreline substantial development permit.
CLOSING
This exemption is not an approval to begin construction. The Single -Family building permit (file #11-
104349-00-SF) is still under review. No work on the site may begin until all necessary permits are
obtained.
