As you are aware, the City has a longstanding policy requiring the elimination of billboard signs to protect public safety and property values by promoting the aesthetics and visual image of the City. Consistent with this policy and Federal Way Revised Code 19.140.13 0(4), billboards are prohibited in the City. Because billboards are prohibited, and the City does not have a mechanism to pennit the construction of new billboards, the billboard cannot be replaced. All related documents have been enclosed. Site Address: 30423 Pacific Hwy South The applicant, Dean Haugen Clear Channel Real Estate Representative, initially came to the City's Permit Center on April 30, 2015. He had questions regarding the destroyed billboard and whether there was any way to replace it. His request was processed and turned into an Administrative Decision (AD) which was assigned to me for response. The following is a list of all my correspondences with Mr. Haugen: • Mid May: exact date unknown Phone Conversation — Spoke with Mr. Haugen about the inquiry and let him know I was looking into it. I asked for some photos of the damaged billboard. • June 2 — Mr. Haugen emailed photos of damaged billboards • June 2 — Becky emailed Mr. Haugen asking Clear Channel for history of site/records of the appeals. • June 4 — Mr. Haugen emailed the appeal filed with the city. • June 8 — Becky emailed Mr. Haugen asking for more information regarding the appeal hearing outcome. The city could not locate the hearing examiner's decision or notes regarding this case. • June 8 — Mr. Haugen emailed and does not have results of appeal in the file. • July 8 — Mr. Haugen emailed for an update • July 9 — Becky emailed Mr. Haugen that we are still looking into and will keep him informed • July 10 — Becky emailed Mr. Haugen requesting information regarding the drunk driver incident, removal of the billboard, and permits on file. • July 13 — Mr. Haugen emailed the requested information. recollection of conversations. Our crew were asked to remove the damaged and fallen portions off the property on Monday, 12/27. After an additional assessment, it was determined it was to remove the remaining portions of the sign structure and disconnect power due to safety concerns. This work was completed on 1/2/15. 1 have attached photos showing the initial damage. You will notice one panel missing as it was knocked to the ground upon impact from the vehicle. The "driver" is lucky to not have been hurt worse, frankly. I have attached permits which includes electrical, WSDOT, and King County (the recognized issuing agency at the time of construction in 1979. Please let me know if you need anything further. Do you by chance have any record of the outcome of this appeal case? The city doesn't have the Hearing Examiners Decision in our archive system. If AK Media won the appeal, there is a chance the billboard is legally nonconforming. Otherwise, based on current codes the billboard cannot be replaced. I'm still working with our Law Dept. for all the details, but if the decision cannot be tracked we may have to defer to the current codes to answer your question. Reasons for Appeal: The City of Federal Way Sign Code, Article XVIII ("Sign Code'), is illegal and the above -referenced Notice of Violation and Order to Correct Violation ("Notice") purporting to enforce the City of Federal Way Sign Code, Article XVIII, is null and void because: a. The Sign Code and Notice violate the First and Fourteenth Amendments to the Constitution of the United States; b. The Sign Code and Notice violate article 1, section 5 of the Washington State Constitution; c. The purported requirement in the Sign Code and Notice of the removal of the sign(s) covered by the Notice without the City of Federal Way's prior payment to Appellants of just compensation violates the Fifth and Fourteenth Amendments to the Constitution of the United States; d. The purported requirement in the Sign Code and Notice of the removal of the sign(s) covered by the Notice without the City of Federal Way's prior payment to Appellants of just compensation violates article 1, section 16 of the Washington State Constitution; e. The Sign Code was adopted in violation of applicable notice and procedural requirements for such a measure under the laws of the City of Federal Way and the State of Washington and is void and the Notice is an illegal attempt to enforce a void law; I AK MEDIAINT City Clerk City of Federal Way June 1, 2000 Page 3 f. E386778 CASE # 140016917 OF COWSICH 12J24114 00:06 NARRATIVE Radio call of hit and run vehicle collision into billboard. • Suspect seen running away. Witness heard the collision and did not have a description of the suspect due to it all happening so fast. Reporting party was passerby and was not at seen wheh police arrived. I arrived on scene and saw a black BMW (4FW4048) unnocupled and stopped touchng a Clear Channel billboard. Half of the sign portion of the billboard was lying in the HOV lane of south bound Pacific Hwy S. The vehicle was partially, blocking the HOV lane and the sidewalk. As I was completing the impound forrn a male black (identified as Jordan, Melvin by his WA State ID card) walked up to fti6f vehicle. He began looking inside of the vehicle. I asked him if the vehicle belonged to him. He said, "I piead the fifth." I asked him if he was in the vehicle and he replied, "You're game is weak." Jordan refused to answer any questions about the collision. I ran his name and he was clear. Jordan Was"only wearing one sloe. I saw a shoe on the roadway nearby that matched the shoe hevas wearfng. I asked him why his shoe was In the roadway. He again refused to answer. I ` w Jordan had 'a'small clot on his forehead. I asked if he needed.`medical attention and he again said he pleads the fifth. Jordan was not the registered owner of the vehicle. There were no witnesses to identify Jordan as the driver I told Jordan he was free to leave. Jbrdan'said he did not trust me and stayed nearby. Jordan then asked if he could get his phone out of -the vehicle. I asked how his phone got to be in the vehicle. Jordan hesitated then said he was a'passenger in the vehicle and he was not going to'snitch' on anyone. He refused to tell mewhere in the vehicle he was sitting. I told him he could not get into the vehicle to get any property. Jordan walked away and then'retumed after about five minutes. Jordan said if i would not give him his phone then I could arrest him. 1 told him he was not under arrest. He asked a few more times for his phone and again walked away. I impounded the vehicle for unattened collision and blocking the roadway. I also contacted public works and they responded to move the sign out the roadway.
