CONDITIONS OF PROJECT APPROVAL

REVIEW PROCESSES REQUIRED
The site is located in a Single Family -Residential 15.0 (RS) zoning district. Home occupations are
permitted in this zone subject to the provisions of Federal Way Revised Code (FVvRC) 19.270.030
"Home Occupations. " Review of the proposal pursuant to FWRC 19.270.030 (2) (a) is meant to ensure
the character of the neighborhood is not harmed due to the nature of the proposal and to provide public
notice. This use is reviewed through Process III project approval, under FWRC 19.65.
PROCEDURAL INFORMATION
If no action is taken to open the proposed home occupation within 5 years, project approval will expire.
One, two-year extension may be granted only if a written request is submitted to the Department of
Community and Economic Development, 33325 8th Avenue South, Federal Way, WA 98003, at least 30
days prior to the expiration of the decision.

The Planning Division hereby presents the following analysis to the Director of Community and Economic
Development pursuant to content requirements of the Process III written decision as set forth in Federal Way
Revised Code (FVVRC) 19.65.100(4).
1. Proposal — Use Process III application for home occupation of a dog -kennel boarding facility on a
developed residential property and includes construction of a fenced area for five dog kennels and up to ten
dogs.
2. Site Conditions — The commercial kennel home occupation will be located at the residential property 36606
9'h Avenue S. The parcel, #302104-9136, is approximately 2 acres in size. There is a minor stream with a
required 50-ft buffer and a type II wetland with a required 100-ft buffer. Kennels and fencing will take
place outside the stream and wetland buffers. Home occupations are permitted within the Single -Family
Residential 15.0 (RS) zone.
3. Review Process — Pursuant to FVTRC 19.270.030 (2), the proposed improvements require Process III land
use approval. A site plan review and public notice was completed asp of the Process III review. The
proposal is exempt from SEPA review.
4. Public Notice — Pursuant to Process III regulations, notice of the proposed land use Action was mailed to
owners of property within 300 feet of the subject property, published in the Federal Way Mirror on July
23, 2011, posted at one location at the subject site, and displayed on the designated city notice boards. No
comments were received by the Department regarding the land use application.
5-.- Additional -Permits — A commercial kennel permit-willbe obtained -from the King Co ty Department of -
Public Health. The use will be conducted in accordance with their Infection Control Plan Guide for
KennellPet Daycare/Pet Grooming Service.
6. Noise — Permitted levels of noise generated by the proposed kennels are regulated pursuant to FWRC
7.10.020, Public disturbance noise. It is unlawful for any person to cause, or for any person in possession of
property, to allow sound originating from that property to be a public disturbance. Noise generated from

may result in action taken by City of Federal Way Animal Services or Code Enforcement departments.

Responding to your letter Of July 27, 2011, 1 am providing the following
9dditional information to the city.
Regarding specific methods to address noise and odor impacts from the propos-&i
kennels and your request for a description of the maintenance that will be performed to
address animal waste and odor, generally, I have been in contact with the Seattle &King
County Department of Public Health and the kennel will be complying with the attached
Infection Control Plan Guide for Kennel/Pet Daycare/ Pet Grooming Service. Because
the proposed kennel is relatively small in size (I anticipate boarding no more than ten
dogs at a time), the kennel and grounds will be cleaned at least daily, probably more
often.
Dogs will be confined to individual kennels every evening and will not be able to
enter the enclosed, but un-insulated dog run portion of the structure. That's not only W,
matter of noise mitigation, but also just basic safety for the animals.
The hours when dogs are kenneled and unable to enter dog run portions of the
property are from 8 PM until 5-30 ^ but dogs might be kenneled earlier and released
eafli6rparficularlyin the wintertimewhen daylight hours are shorter. Thedogswillnot
be able to enter dog run portions unless supervised by human handlers; again, that's
partly noise control and partly just basic safety for the animals.

Pioneer K-9 Kennels will be a small boarding facility, with the ability to house 5 to 10 dogs. I own 2.25 acre
and live on site. The area is a wooded community with several 1-2+ acre parcels. The area also butts up to t
power lines which is also a green belt. I will be fencing off an area 80'x8O'x6'.On the south side of the fenc
we are going to be building 5 dog houses with roofed kennels. Each kennel/dog house will be I O'x 1 4'x6'. 11

be put in their houses in the evening time. The houses also will be on cement blocks and can be moved arou is
if necessary and not create a permanent type structure. The facility will have property setbacks of 95' on the
eastside, 95' on the westside (road), 165' from the north end, and 80' from the south end of the property. Th
southwest comer of the fence would be a minimum of 50'from a small seasonal stream. The road traffic is
approxinently 20 to 25 cars a day. We will be creating a park like setting for dogs to stay. I
I will need to remove a handful of trees (5) which are dead or a hazard to the existing proposal. The
