Dear Ms. Hamel:
The Department of Community Development Services received your application on January 7, 2000, to
do a boundary line adjustment between King County parcel numbers 252103-9002, 252103-9037, and
252103-9041. Pursuant to city regulations, upon receipt of an application the city has 28 days to
determine whether all required information and documentation required for a complete application
pursuant to "Federal Way City Code" (FWCC) Section 22-33 have been submitted.
Based on a review of your submittal relative to those requirements as set out in FWCC Section 20-43,
your application is deemed incomplete as of today's date (February 2. 2000). In orderto complete the
application, the following items must be provided:
A) Signatures of all persons with ownership interest in the subject property must be provided. King
County records indicate Royal Plaza Enterprises as the owner of parcel number 252103-9002 and t
application lists Northshore Plaza Enterprises. Please provide names and signatures of all persons
with ownership interest. Per Mr. Joe Young, he is the owner of lot number 252103-9002 and is
unaware of any boundary line adjustment application. He can be reached at 253-272-7221. Also,
please indicate who is signing for the Irmas Charitable Foundation. Provide signature blocks on th
survey for all persons with ownership interest in the subject property.
B) A copy of the easement agreement recording number 8504100758. The existing building occupies,
part of the 38-foot easement. Review of this recorded easement is necessary to determine if it need
to be revised to provide adequate access to King County parcel number 252103-9041.
C) Sewer and water availability certificates for all lots.
D) Clarification if parcel labeled 'Existing parcel B' is a separate legal lot or not. Title report provides
legal description of it as a separate lot. However, per my phone conversations with Keith Eisenbrey
at Chicago Title Insurance Company, it is not a separate legal lot. Instead, a portion of lots 252103-
9037 and 9041 were deeded to lot number 252103-9002 in June 1999. Please provide a copy of the

recorded deed. It is unclear as to how ownership of a portion of lot was transferred to another lot
without a boundary line adjustment application being processed. If existing parcel B is not a separate
legal lot, it shall not be shown on the drawing as a separate lot. Instead, provide revised legal
descriptions, lot closurecalculations,.and survey.
After receipt of the requested information, we I notify you within 14 calendar days whether your
application is complete, or if incomplete, what information is still needed to complete the application. It is
important to note that the department cannot formally begin processing your application until all items are
submitted.

shed is not shown and the footprint of the buildin occupied by the dry-cleaning business is noi

I am responding to your letter to Denise Hamel, of Lawler & Burroughs, P.C., dated February 2,
2000, regarding the above referenced Boundary Line Adjustment. Summit Surveying has
addressed the preliminary comments, regarding the survey map, as outlined in the letter
mentioned above. I have enclosed 5 revised sets of prints of the Boundary Line Adjustment
survey, for the city's review. The survey now shows the location of the Pizza Hut shed (near the
West property line), additional dimensioning to existing building comers, the location of and
dimensions to the off -site gas station building (near the Southeast comer of the property) and the
location of driveway curb cuts along the streets fronting the site.
It is my understanding that other items required for this application as mentioned in your letter,
will be supplied directly to the city by Denise Hamel. Hopefully, these revised copies of the
survey, along with the other items from Ms. Hamel, will satisfy the completeness of the
Boundary Line Adjustment Application and allow the review process to proceed.

I am responding to your letter to me dated February 2, 2000 regarding
the above referenced boundary line adjustment. I will address each of your
lettered paragraphs in turn.
A . It is my understanding that you have spoken with someone
from Mr. Young's office and they have confirmed the signature on the
application and indicated their consent to processing the BLA. Mr. Young;
is an officer in Royal Plaza Enterprises, Inc., which I believe is now doing
business as Northshore Plaza Enterprises. The signature for the Ir as
Charitable Foundation is that of Robert Irmas, its Trustee. I might suggest
that the application form be modified to allow more room for signatures,
printed names and indications of representative capacity.
B, A copy of the requested easement is enclosed. As will be seen
upon review, the easement was to provide access for the shopping center
only. The one of the purposes of this BLA and the prior Boundary Line
Agreement and Bargain & Sale Deed' as to transfer fee title to the
easement to the ease enVs beneficiary, the shopping center. This BLA
does not reduce or otherwise affect access to Tax Lot 41, since Tax Lot 41

THIS EASEMENT (Easement) is made effective Of' the 9r.h day of
April, 1y85 by North Shore village Associates ("North Shore"), a
Washington joint venture, and Walter Hogan Enterpriser, Inc.
("Walter Hogan"), a Washington corporation, for the vise and
benefit of real property described herein.
1 r RECITALS
e A. North Shore is purchasing from Walter Hc'vgan Enterprises,
.y Inc. two ;adjoining parcels of real property legally described in
Exhibit A hereto (hereinafter "Parcel 1'") and Exhibit hereto
(hereinafter "Parcel 2"), which descriptions by this reference are
:O incorporated herein as if fully set forth.
B. Parcel 1 is improved with buildings, paved parking and
other structures constituting a shopping center (collectively
"Improvements"). A portion of said IMDrove'.:nent5 extend onto the
southerly -portion of Parcel 2•
C. North Shore wishes to provide f i the continued use and
occupation of the Improvements on Parcel
D. In connection with its purchase of Parcels 1 and 2, North
Shore is executing a deed of trust on Parcel 1, alone with the
easement set forth herein, wherein Rainier National Bank is

beneficiary and a deed of trust on Parcel 2, subject to
easement set forth herein,.wherein Walter Hogan is beneficiary -
NOW, THEREFORE, in consideration of the above recitals and for
other gaol and valuable consideratirn: the receipt of which is
hereby acknowledged, North Shore and Walter Mogan hereby declare,
w grant, convey and establish a easement as follows:
LS 1. Easement Area. The area of the easement ("Easement

is the dominant estate and Parcel 2 is the servient estate.

Parcel 1 through said owner or its lessees shall have use of the
Easement Area for any and all lawful purposes, including without
limitation the continued use for Improvements, access, parking and
maintenance. The Easement Area also may be used for remodeling,
repair, rehabilitation, demolition, ind new construction of

Easement Area part of the fee of Parcel 1 and any portion of the
Easement Area not so adjusted shall continue to be an Easement
Area governed by the terms and conditions of this Easement. Any

Easement Area shall be perpetual unless terminated by the owner by
recording a document of termination or unless terminated
automatically upon recording of a lot line adjustment or other
action by the owner(s) of Parcel 1 and 2 as provided in
paragraph 4. Termination by recording shall require the approval
of all deed of trust beneficiaries or mortgagees of Parcel 1. Any
:modification of this Easement shall be by mutual agreement of the
owners and any deed of trust beneficiaries or mortgagees of
Parcels 1 and 2.
