replacing curbs, gutters, and sidewalks; upgrad•ing wheel chair ramps; and installing Dura Stripe pavement
markings. Due to the scope of the project, construction activity is expected to take place daily from June to
July of 2014. In order to shorten the duration of the project and limit impact to the public, you have
requested to work outside of normally -approved hours. As such, you are requesting relief from Federal Vay
Revised Code (FWRC) 19.105.040, "Regulation of Work Hours." The proposed work schedule follows.

WORK HOUR EXCEPTION
Pursuant to FWRC 19.103.040, work hours are permitted outright between the following hours:
7:00am and 8:00pm Monday through Friday
9:00am and 8:00pm Saturday
Development activities and heavy equipment operations are not permitted on Sundays or holidays observed
by the city. However, the director of community and economic development may grant revocable written
permission to engage in development activity other than the above permitted times, in accordance with
FWRC 19.105.050(2)(a):

i) The work will not result in substantial adverse impacts to surrounding properties.
ii) The exception is necessary to avoid undue delay of project completion and/or long-term
inconvenience or disruption to the public.
APPROVAL
The proposed project is to make a number of enhancements to South 352nd Street from Enchanted Parkwa
to Interstate 5. Due to the location of the project.site, it is anticipated that development activity during the
proposed work hours will not interfere with any residential use and will not result in substantial adverse
impacts to surrounding properties. Therefore, based on your written request, the director of community an
economic development hereby grants you revocable approval to engagein construction activity during the
hours listed in the 'Proposed Work Schedule' section above. Per RIVRC 19.105.040(3), written noticeat leas
seven days prior to the ptoposed work activity is required before a work hour variance may be granted.
However, pursuant to FWRC 19.105.040(4), "Warver of Notice," the director of community and economic

posted at the entrance (eastbound) of South 352nd Street. Further, weekly construction schedule updates 'vll be posted on the City of Federal Way website and emailed to interested parties. Finally, due to the location

hereby waives the public notice requirement.

verified complaints that the development activity or equipment operation does not meet the terms of the

mailed to all interested persons.
We anticipate project construction will begin in June 2014 and the need for the waiver will extend through July 2014.
Please issue a construction work hour waiver to the Public Works Department for the 2014 Asphalt Overlay Project
months listed. If night work is re:#,uested outside this listed window, the contractor will
apply for a waiver covering the times needed based on the requirements of City Code 19.105.040. This waiver is
revocable at any time.
