a. Concur with the checklist. Short-term impacts to air quality occur during construction
and paving activity. Construction activity, especially site preparation work, contributes
to a short-term increase 'in local suspended particulate levels. Construction activity also
contributes to carbon monoxide levels through the operation of construction machinery,
the use of trucks to deliver equipment and materials, and worker access to the site by
automobile.
The implementation of an approved Temporary Erosion and Sedimentation Control
(TESC) plan that incorporates watering of the site, wheel washing, and approved
construction entrances, should adequately mitigate potential adverse construction
impacts.

g. The City's Public Works Traffic Division has indicated that the Hong Retail project will
be allowed to participate in pro-rata share contributions to mitigate identified impacts on
pending TIP projects in accordance with the 2003 Federal Way Comprehensive Plan
(FWCP) transportation policies and FWCC Chapter 19, Article II, "Methods of
gation," which requires that traffic impacts created by development be mitigated.
Pro-rata share contributions are not sought for projects that are under construction.
Six Year Transportation improvement Plan (TIP) — The City of Federal Way has
identified three TIP projects in which the proposed development exceeds the net 10 PM
peak hour threshold for requiring mitigation. Pursuant to FWCC Section 22-1475, the
applicant shall construct these improvements, or voluntarily offer to contribute a pro-
rata share of the impacted TIP projects.
TIP projects at the following locations are impacted by the proposed development:
a. TIP project #8 along I O'h Avenue SW/SW 344fl' Street between SW Campus Drive
and 21" Avenue S W to extend three -lane collector with sidewalks and street lights.

upon impacts identified in the environmental checklist; the Final Staff Evaluation for Environmental
Checklist, Federal Way File #06-106298-00-SE; Conclusions of Law based upon the Federal Way
Comprehensive Plan (FWCP); and other policies, plans, rules, and regulations designated as a basis for
exercise of substantive authority under the Washington State Environmental Policy Act Rules pursuant to
RCW 43.21 C.060.

building, in a Neighborhood Business (BN) zoning district. Associated site improvements include
parking lot and perimeter landscaping.
accordance with code requirements, traffic impacts associated with the proposed action were
analyzed and mitigation proposed in the applicant's November 10, 2006, Traffic hnpact Analysis
(TIA) prepared by Jake Traffic Engineering, Inc, with revisions dated March 9, 2007, and reviewed by
the City's Public Works Traffic Division. Traffic impacts identified in the analysis will be
appropriately mitigated by implementation of required mitigation measures.

CONCLUSIONS OF LAW
The goals and policies of the Federal Way Comprehensive Plan (FWCP) serve as a basis for requiring
SEPA conditions.
TG2 Provide a safe, efficient, convenient, andfinancially sustainable transportation system with
sufficient capacity to move people, goods, and services at an acceptable level ofservice.
The City shall develop and adoptpoliciesfor the construction, reconstruction, maintenance, and
preservation of new and existingJacilities.
TP43 Minor capacity projects, placing spot (localized) traffic improvements, will be carried out to
extend the capacity of system components.
The lead agency for this proposal has determined that the proposed action does not have probable
significant adverse impact on the environment and an Environmental Impact Statement (EIS) is not
required under RCW 43.21 C.03 2(2)(c), only if the following condition is met. This decision was made
after review of a completed environmental checklist and other information on file with the lead agency,
