CONCLUSIONS _�?_i _devalg _-tL%A=QQ.2L. use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020: I The proposed improvements are consistent with applicable chapters of F)VRC Title 19 including, bu! not limited to: Pennits and Review Processes; Process I — Director's Approval; Community Design Guidelines; and Neighborhood Business (BN); 2. The health, safety, and welfare of the citizens of the city are preserved; 3. There is no change of use; 4. There is no reduction in the amount of required landscaping, buffering, open space, or public areas; 5. There is no material change or reduction in the amount of required parking; 6. There is no material change in the location of utilities, easements, or pedestrian connections; 7. There is no material change to the approved architectural design; and 8. There are no additional adverse impacts to sensitive areas or significant trees. FINDINGS OF FACT 1 . Proposal — The applicant submitted a Process I MLU application on April 14, 2011, proposing to add an outdoor eating area/beer garden behind the existing Jersey's Sports Bar. Six to ten tables contained by a temporary fence will be located in the proposed area directly behind the exit door. The area is currently used for employee parking and a delivery zone. An existing 8'x2O' outdoor storage container is also proposed to be included as part of the proposal. The storage container is located behind the property and is painted to match the existing building. 2. Zoning Designation —The subject property is located within a Neighborhood Business (BN) zone. Restaurants or taverns are permitted per Federal Way Revised Code (FVVRC) 19.215.020. The enclosed area must be set back a minimum of 20 feet from the rear (west) property line as it abuts z -I r. and Mris. Nflse� Page 2 residential zone (RM2400). Jersey's Sports Bar is part of a multi -tenant retail complex which exceeds the nurtium required parkin s aces. Per FVIRC 19.125.180(3)(f), containers shall be screened in accordance with FVv`RC 19.125.170(3)(b). In reviewing proposed screening methods, the director will consider the zoning of the site and surrounding properties; location of the container and visibility from adjacent streets and properties; existing and proposed landscaping; and the physical condition of thi_� container; provided, that containers located on or adjoining a residentially zoned property shall receive 100 percent sight -obscuring screening. Pursuant to FV*TRC 19.125.170(3)(b), the director may determine that the required landscape screening is not necessary because the use or stored materials are not visually obtrusive. After not necessary because the use is not visually obtrusive to surrounding properties. The storage container is behind the existing restaurant/bar, bordered by parking stalls on the North, South, and a solid tree screening from the residential properties to the West. There is minimal visibility of the container from the right-of-way or from neighboring properties. The Director of Community and Fconomic Development hereby waives the screening requirement. 4. Maximum Environmental Noise Levels —Per FVVRC 7.10.050, the city adopts by reference the maximum environmental noise levels established in the Washington Administrative Code (WAC) 173-60. WAC 173-60-040 (enclosed) establishes maximum permissible environmental noise levels in which the subject property must comply with. 5. Environmental Review — The proposed outdoor eating area and storage container are categorically exempt from an environmental threshold determination pursuant to State Environmental Policy Act Rules 197-11-800(3). 6. The following International Building Code (113C) sections apply to the proposal. The path from the rear door to the gate shall be provided with egress illumination complying with IBC section 1006. An exit sign at the gate shall be provided (10 11. 1). Exit signs shall be internally or externally illuminated (10 11.2). Exit signs shall be illuminated at all times. To ensure continued illumination for a duration of not less than 90 minutes in case of primary power loss, the sign illumination means shall be connected to an emergency power system provided from storage batteries, unit equipment, or an on - site generator (1011.5.3). The gate shall be side -hinged, shall swing in the direction of egress travel, and shall be equipped with panic hardware or fire exit hardware (1008.1.2, 1008.1.10, 1008.2). The door hardware on the outside of the existing rear exit door is required to be accessible. Door handles, pulls, latches, locks, and other operating devices on doors required to be accessible by IBC Chapter I I shall not require tight grasping, tight pinching, or twisting of the wrist to operate (1008.1.9.1). It is the responsibility of the applicant to obtain or maintain proper licenses and permits through the Washington State Liquor Control Board. This Land Use Approval does not constitute a license or permit to handle or sell alcoholic products or goods. Planning Department 0 Community Design Guidelines Compliance — FWRC 19.115.090, District guidelines. The following supplemental guidelines apply to. the subject property: (f) Chain -link fences visible from public rights -of -way or adjacent properties, and not screened by Type I landscaping as defined by Chapter 19.125 FVVRC, shall utilize vinyl -coated mesh, powder -coated poles, dark color(s), and architectural element(s) such as pole caps and/or decorative grid pattern. Building Department 0 A separate building permit is required to establish the use and occupancy of this outdoor seating area. A separate electrical permit is also required to install any required exit signs or lighting. APPEALS the effective date of this decision is May 12, 2011, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by May 26, 2011. Any appeal must be in the form of a letter delivered to the Department of Community and Economic Development with the established fee.
