Dear Mr. Cox:
The Community Development Department has reviewed the Process I Master Land Use Application for a
proposed storage container at the Light of Christ Church Community Garden. The application was determined
complete on February A 2020, and is hereby approved per the enclosed Endings of fact and conclusions of law.
BUILDING PERMIT
As the storage container is approximately 160 square feet in size, no building permit is required.
APPEALS
The effective date of this decision is March 1, 2020, or three days from the date of this letter. Pursuant to Federal
Way Revised Code (FWRC) 19.55.050, any person who received notice of the administrative decision may appeal this
decision to the Federal Way Hearing Examiner by March 16, 2020. Any appeal must be in the form of a letter
delivered to the Department of Community Development with the established fee. The appeal letter must contain
a clear reference to the matter being appealed and a statement of the alleged errors in the director's decision,
including the identification of specific findings and conclusions made by the director disputed by the person filing.
In that you are the only party of record, you may waive your right to appeal, if desired, by submitting a letter to this
effect to the City of Federal Way, Department of Community Development. Waiver of the right to appeal does
not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City, of Federal Way codes, policies, and standards
relating to this development. This Process I approval is valid for one year from the effective date of this decision.
If no further action is taken within one year, this decision will expire.

The Director of Community Development hereby makes the following findings pursuant to content
requirements of the Process I written decision as set forth in Federal Way Revised Code (FWRC) 19.55.020.
These findings are based on review of existing city documents and submitted items by the applicant received
February 4, 2020, and February 13, 2020.
FINDINGS
1. Proposal — The applicant proposes to place a 20-foot by 8-foot, 160 square foot metal storage
shipping container as an accessory to the existing Light of Christ Church Community Garden. The
community garden was approved by the city on June 30, 2011, under file number 11-102373 UP.
2. Existing Conditions —The subject site is an 8.5-acre parcel developed with a church use and
community garden. the community garden portion of the property is bordered by a vacant residential
property to the north; SW 344t' Street to the south; 21" Avenue SW to the east; and the church
building and associated improvements to the west.
3. Comprehensive Plan & Zoning Designation — The subject property is zoned Residential Single -
Family (RS) 7.2 and is within the High -Density Single -Family comprehensive plan designation. The
primary use of the subject property is a church, which is permitted in the RS zone pursuant to FWRC
19.200.050. A secondary use of the subject property is the existing community garden associated with
the church, which was approved by the city on June 30, 2011, under file number 11-102373-UP.
4. Use & Review Process — According to FWRC 19.125.180, outdoor storage containers for permanent
accessory storage are allowed subject to Process I in the RS zone only in conjunction with institutional
or quasi -public uses. As proposed, the container will be used for the church community garden purposes.
5. Design Criteria — The proposed storage container meets the design criteria in FWRC 19.125.180 for a
storage container in conjunction with an institutional use in an RS zone, as discussed in the applicant's
written responses submitted to the city on February 13, 2020. The applicant's response to the design
criteria are hereby incorporated by reference. In summary, the proposed storage container will meet the
following: minimally visible from a public right -of way; screened from the view of adjacent right-of-
ways and residences by existing and supplemental landscaping and vegetation; painted in gray or gray -
green to match adjacent buildings; and not stacked or refrigerated.

6. Environmental Review —The proposed improvements are exempt from environmental review. The
new building will be less than 12,000 square feet and the improvements are consistent with the State
Environmental Policy Act (SEPA) definition of "minor new construction," as set forth in WAC 197-
11-800(2)(e).
7. Height —The height of the structure is below the 30-foot height maximum limitation for a church use,
as stated in FWRC 19.200.050.
8. Setbacks — The required minimum yard setbacks for the proposed container is 30 feet from all property
lines, which is met by the proposed location on the site plan.
9. Nonconforming Development —As proposed, the project is exempt from the requirements of FWRC
19.30.090(1), to bring all nonconforming aspects of a development into conformance. Additions of
less than 2,500 square feet are exempt.
10. Transportation — Based on the submitted materials for the construction of a 160 square foot storage
shed, the proposed project is estimated to generate no new weekday PM peak hour trips.
11. Stormwater — The project as designed with a new 160 square foot storage shed is exempt from
stormwater review under the 2016 King County Surface Water Design Manual.
12. Building Permit — A building permit is not required as the building size is less than 200 square feet in size.
13. Decision Criteria — Staff finds the proposal is consistent with applicable site plan approval criteria
required for Process I, as set forth in FWRC 19.55.020. The proposal is consistent with the city's
comprehensive plan; applicable provisions of FWRC Title 19 "Zoning and Development Code"
(including FWRC 19.125.180); public health, safety, and welfare; and streets and utilities in the area are
adequate to serve the anticipated demand from the proposal.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings above,
the proposed improvements to the developed site meet the Process I approval criteria and land use review
standards of FWRC 19.125.180 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19,
including, but not limited to: Chapter 19.125, Article IV, "Outdoor Activities and
Storage"; Chapter 19.55, "Process I — Director's Approval"; and FWRC Zone Use Chart
19.200.050, "Church Use in the RS Zone."
2. The proposal is a minor improvement, modification, or addition to a site that is exempt
from State Environmental Policy Act (SEPA) review.
3. The health, safety, and welfare of the citizens of the city are preserved.
The approved site plan complies with specific FWRC regulations These findings shall not waive
compliance with future City of Federal Way codes, policies, and standards relating to this development.
