After evaluating the existing conditions along the referenced street, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.280; 19.135.040) and the direction provided by the City Council, the Public Works Department hereby provides the following response to each of your requests: Request to waive street improvements along Dash Point Road: Dash Point Road is identified as a Minor Arterial, corresponding to City Standard Street Section "K", which requires 44-foot paved section, curb & gutter both sides, two 6-foot planter strips, and two 8-foot sidewalks within a 78-foot right-of-way. Currently Dash Point Road meets the required roadway Section "K". The Public Works Department hereby approves your request to waive frontage improvements along Dash Point Road. Request to waive street improvements along Pacific Highway S: Pacific Highway S is identified as a Principal Arterial, corresponding to City Standard Street Section "A", which requires 90-foot paved section, curb & gutter both sides, two 6-foot planter strips, and two 8-foot sidewalks within a 124-foot right-of-way. Currently Pacific Highway S meets the required roadway Section "A". The Public Works Department hereby approves your request to waive frontage improvements along Pacific Highway S. Request to waive street improvements along 16a' Avenue S: 16t' Avenue S is identified as a Local Street, corresponding to City Standard Street Section "R", which requires 40-foot paved section, curb & gutter both sides, two 4-foot planter strips, and two 6-foot sidewalks within a 66-foot right-of-way. Currently 16th Avenue S has 22-foot paved section with a grass/gravel shoulder along the east side, which then drops off quickly into the project site. The Applicant shall dedicate 3-feet of frontage as right-of-way. 2. Sign and record a Local Improvement District Waiver of Protest Covenant so that the Applicant acknowledges and understands their responsibilities should the City modify this roadway in the future (form sent via e-mail). The conditions of this right-of-way modification will be applicable for a period of one year. If the building permit is not issued within the one-year time period, this modification will be void, and a new request for modification must be submitted. The applicant requests: 1. Modification of FWRC 19.135.040 frontage improvements along Dash Point Road. 2. Modification of FWRC 19.135.040 frontage improvements along Pacific Highway South. 3. Waiver of FWRC 19.135.040 frontage improvements along 161h Avenue South. Staff Analysis Dash Point Road is identified as a Minor Arterial and is designed to be a Type "K" street. The roadway section is a 78-foot right-of-way with 44-foot paved roadway, curb & gutter, six-foot planter and 8-foot sidewalk. The roadway cross section has been fully constructed. Therefore no further improvements should be required along this roadway. Pacific Highway South is identified as a Principal Arterial and is designed to be a Type "A" street. The roadway section has a 124-foot right-of-way, 90-foot paved roadway, curb & gutter, 6-foot planter strip and 8-foot sidewalk. The roadway cross section has been fully constructed. Therefore no further improvements should be required along this roadway. 161h Avenue S 'is identified as a Local Street with a Type "R" street section. The roadway section is a 66-foot right-of-way, 40-foot paved roadway, curb & gutter, 4-foot planter strip and 6-foot sidewalks. The existing improvements along 16th Ave S consist of approximately 22-foot paved roadway, with grass/gravel shoulder on the east side, which then drops off quickly into the project site (see Existing Condition and Demolition Plan). The west side of 16th Ave S has a shoulder and ditch section, with a paved walking path which appears to extend from S. 3041h Street to Dash Point Road. The existing right-of-way is 60-feet wide. The frontage improvement along 16th Ave S meets the modification/waiver criteria in FWRC 19.135.070 — (1) The improvement as required would not be harmonious�with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole, and (2) Unusual topographic or physical conditions preclude the construction of the improvements as required. Requirements / Conditions of Approval After checking the requirements for frontage improvements of other recent development (Storquest) projects in the local area, Development Services staff make the following recommendations for this project: 1. Approve the waiver request (FWRC 19.135.040) for frontage improvements along Dash Point Road because street improvements already meet the Type "K" roadway section. This project is bordered by three existing roads: Pacific Highway South, South Dash Point Road, and 16th Avenue South. Both Pacific Highway South and South Dash Point Road appear to have been recently improved to both current City of Federal Way and ADA standards and should require no further work. We are submitting this request in regards to 16th Avenue South in accordance with Federal Way Revised Code 19.135.070 on the grounds that unusual topography precludes the construction of further improvements along this road. As is shown in the attached plans, 16th Avenue South sits within a few feet of a steep existing slope making the addition of any sidewalk, shoulder, or other expansion towards the property extremely difficult and costly.
