Re: File #13-102083-00-UP; USE PROCESS APPROVAL
All Right Auto Sales; 33333 Pacific Highway South FILE
Dear Mr. Azzan:
The City of Federal Way's Department of Community and Economic Development, Planning Division, has
completed an administrative review of your proposal to place a 40' x 8' x 8.5' metal shipping container to be
used for the storage of lot tools at the above mentioned site, All Right Auto Sales. The zoning for the subject
site is Community Business (BC). According to Federal Way Revised Code (FWRC)19.125.180, outdoor
storage containers for permanent accessory storage are allowed in the SC zone. The city has completed a Land
Use Process I Review and herby conditionally approved the proposed storage container, subject to the below
condition:
(d) Containers shall be painted to match adjacent buildings) or improvements.
Pursuant to FWRC 19.125.170(3)(b), the director may determine that the required landscape screening is not
necessary because the use of stored materials are not visually intrusive. After reviewing the site, the required
100 percent sight -obscuring screening around the storage facility is not necessary because the use is not
visually obtrusive to surrounding properties. The storage container is located behind the principle building and
will be painted to match the building's existing color. The container is well camouflaged to the existing
building and is not visible from the public right-of-way. The Director of Community and Economic
Development hereby waives the screening requirement and no additional screening is required.
The effective date of this decision is May 28, 2013, or three working days from the date of this letter. Pursuant to
FWRC 19.55.050, any person who received notice of the administrative decision may appeal the decision to the
Federal Way Hearing Examiner by June 11, 2013. Any appeal must be in the form of a letter delivered to the
Department of Community and Economic Development with the established fee. The letter must contain a clear
reference to the matter being appealed and a statement of the alleged errors in the director's decision, including
the identifidation of specific findings and conclusions made by the director disputed by the person filing.
In that you are the only party of record, you may begin work on the effective date of this decision. This
decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to
this development. If you have any questions regarding this decision, please contact Planning Intern Reece Golz
