The City has completed an administrative land use review of your proposal to use the site as a facility to service trucks, vehicles, and trailers. Additional uses include renting, parking, maintenance, contracting, and truck and vehicle sales. Based on the City's review, this Process I application is approved. To be clear, rental of heavy equipment' is not allowed in the BC zone and is not approved with this correspondence. To approve a Process I review there may be no change from the previous use. The City does not consider this a change of use for zoning purposes as this property, the former Pacific Coast Ford dealership, was an automotive sales and repair business. The zoning for the subject site is Community Business (BC). Pursuant to Federal Way Revised Code (FWRC) 19.22.030 vehicle sales and rentals, and service repair are permitted uses. As the use of the property has ceased for more than one year, FWRC 19.30.090 (1) (e) requires that the applicant repair and restore the improvements on the site (drainage, landscaping, curbing, parking, parking lot landscaping) to a condition as near as physically possible to the condition required by the requirements of approval for the existing development. In your application you state that you will address the above issues, which includes restoration of existing required landscaping, striping and handicap parking delineation for customer and office parking areas, replacement and repair of curbing as needed, cleaning of oil water separators and storm drains, and general clean-up. This sufficiently meets the intent of the above quoted FWRC section. For your information you must obtain permits from the building department for any repairs or electrical work, in addition to ensuring handicap accessible restrooms and parking stalls. Water and sewer issues are reviewed by Lakehaven Utility District, who has requested a notarized copy of the easement for water facilities, and is enclosed. You will also be required to complete a Sewer Use Survey (SUS) so Lakehaven can determine pretreatment requirements. 1 "Heavy equipment" means high capacity mechanical devices for moving earth or other materials, mobile power units, including but not limited to carryalls, graders, loading/unloading devices, cranes, drag lines, trench diggers, tractors over 80 HP, augers, caterpillars, concrete mixers and conveyors, harvesters, combines, or other major agricultural equipment, and similar devices operated by mechanical power as distinguished from manpower (FWRC 19.05.080). Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal the decision to the Federal Way Hearing Examiner by August 1, 2011 (14 calendar days). The appeal must be in the form of a letter delivered to the Community and Economic Development Department with the established fee. The appeal letter must contain clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing - As you are the only party of record, you may waive your right to appeal by submitting a letter in writing to this effect to the City. Waiver of the right to appeal does not affect the effective date of this decision. This decision shall not waive compliance with future City of Federal Way codes, policies and standards relating to this development. Skyline Group LLC is purchasing the site for continuation of use as a truck and vehicle facility. It is the intent of Skyline Group to facilitate truck servicing for its own fleet of trucks/vehicles/trailers, rental, parking, maintenance, and contracting along with truck/vehicle sales as depicted on the attached site plan. Skyline Group will conduct truck and trailer parking on the rear portion of the site and facilitate maintenance and repair in the existing service bays. Accessory office uses will occupy the existing building and truck/vehicle sales and display area will be conducted in the existing showroom and frontage of the site. As the site has been vacant for some time, Skyline intends to conduct a building inspection and address any maintenance issues, no additions or alterations are planned at this time, Skyline will seek building permits for any future alterations. Maintenance items will be addressed as needed, including, but not limited to restoration of existing required landscaping, striping and handicap parking delineation for customer/office parking areas, replacement and repair of curbing as needed, cleaning of oil water separators and storm drains, along with general clean-up. As this property is being purchase as -is in avoidance of a foreclosure action, the timeline for wrapping up due diligence and occupancy issues is extremely short. We have no later than July 15, 2011 to establish the ability for Skyline, LLC to occupy the site for the above mentioned continuation of use. WATER • A separate water service connection application submitted to Lakehaven is required for each new service connection to the water distribution system, or any modification to an existing water service connection (e.g., larger service, fire protection, irrigation, abandonment of existing service(s), etc.), in accordance with standards defined in Lakehaven's current Fees and Charges Resolution'. The property is currently served by a "active", single two-inch (2") service/meter (i.e., irrigation water used at the site is billed for sewer discharge). • Lakehaven has no record of a formal easement that covers Lakehaven's water facilities on the property and would like to resolve this at this time. These water facilities exclusively serve the subject property & nothing else. To that end, we've prepared an easement document (attached) for the applicant to sign (with notary) & return to Lakehaven.
