Dear Lucito Gatlabayan:
The Community Development Department is in receipt of your September 7, 2018, critical areas
buildable lot letter for tax parcel 218820-0355 located in the East Tacoma Addition(Lots 27 and 28).The
site is 6,000 square feet and zoned Residential Single-Family(RS) 15.0.
BUILDABLE LOT
Pursuant to Federal Way Revised Code(FWRC) 19.105.010, ". . .it is a violation of this title to erect a
structure on or to otherwise use or occupancy any lot or parcel unless that lot or parcel is a buildable lot."
The abovementioned tax parcel 218820-0355 meets the"buildable lot"criteria FWRC 19.105.010(1)and
(2)on the following grounds:
• The subject property is a legal nonconforming lot;
• At present there is no residence, nor has there ever been a residence on the subject
property, per the King County Assessor records from 1983 to2018;
• On September 27, 2018,the city received a signed affidavit stating the current owner
does not own contiguous lots;and
• The site abuts 7th Avenue SW, an unimproved public right-of-way, which provides
vehicular access to tax parcel 218820-0355.
CRITICAL AREA MAPPING
The City of Federal Way's critical area mapping does not show any critical areas on or in proximity to the
above-mentioned tax parcel. In particular, there are no streams or wetlands depicted on ourmapping, or
within 225 feet of the subject property.
If the city determines that a wetland may exist on or within 225 feet of the subject property,the director
may require that the applicant submit a critical areas report prepared by a qualified professional.

be used for planning level purposes only and the actual presence/absence,type,extent,and boundaries of
critical areas shall be identified in the field by a qualified professional according to the procedures and
criteria established in this chapter. In the event of any conflict between the critical area location and
designation shown on the city's map and the criteria or standards of this chapter, the criteria and standards
shall prevail."

19.105.010 Buildable lot.
(1) General. It is a violation of this title to erect a structure on or to otherwise use or occupy any lot or parcel
unless that lot or parcel is a buildable lot.A lot or parcel is a buildable lot if it meets all of the following criteria:
(a)It was created or segregated pursuant to all applicable laws, ordinances and regulations then in
effect.
(b)Except as specified in subsection(2)of this section,it is at least as large as the minimum lot size
established by this title.
(c)It is adjacent to a street, access tract,or driveway providing access to that lot or parcel that meets the
minimum requirements of the International Fire Code and other code provisions established by or under
this title.
(d)Nothing in the above subsections eliminates the requirement to comply with all other provisions of the
FWRC, or other applicable regulations, prior to obtaining a building permit or other construction permit.
(2)Exception, detached dwelling units. Subject to all other requirements of this title, an applicant may build one
detached dwelling unit on a lot or parcel regardless of the size of the lot or parcel, if:
(a)There is or has ever been a residence on the subject property;or
(b)It is a legal nonconforming lot and the owner does not own contiguous lots;or
(c)Lots less than 50 percent of the minimum lot size required by this title are combined with one or more
contiguous lots under the same ownership until the resulting lot equals at least 50 percent of the
minimum lot size required. If that is not possible, all lots under contiguous ownership are combined into
one lot,which may then be developed.
(d)The intent of this exception shall not be to construe remnant lots or tracts as buildable lots. Lots that
are not considered buildable lots are those that were not created for the purposes of land development
and include, but are not limited to,vacated rights-of-way, tracts, lot fragments resulting from surveying
errors, public or private easements, and assessor tax parcels created by segregation.
