Stipulation and Agreed OrderCITY OF FEDERAL WAY OFFICE OF THE HEARING EXAMINER IN THE MATTER OF: } } SPECTRUM BUSINESS PARK & } FWHE# 05-13 SPECTRUM PLAZA, LLC. } STIPULATION AND APPEAL OF NOTICE AND ORDERS } AGREED ORDER } FEDERAL WAY FILE NUMBERS: 05-103681-000-00-VO; 05-103682-000-00-VO, 05- 103683-000-00-VO; 05-104090-000-00-VO; 05-104197-000-00-VO; 05-104198-000-00-VO; 05-104231-000-00-VO; 05-104257-000-00-VO; 05-104269-000-00-VO; 05-104285-000-00-VO; 05-104286-000-00-VO; 05-104287-000.00�=�V0; 05-104393-000-00-VO; 05-104395-000-00-VO AND 05-104416-000-00-VO WHEREAS, the City of Federal Way (City) initiated several code enforcement actions against Spectrum Business Park (Spectrum) by issuing numerous Notice of Violation and Orders to Correct Violation (Notice and Orders) listed above, WHEREAS, Spectrum appealed the Notice and Orders to the Federal Way Hearing Examiner, WHEREAS, the Hearing Examiner has issued decisions on April 21, 2006 and January 26, 2007 that have procedurally resolved all of the Notice and Orders with the exception of one, WHEREAS, the City and Spectrum have met several times to resolve the remaining Notice and Order, and WHEREAS, the City and Spectrum have agreed to outline the uses that Spectrum is vested to and the uses that will require additional land use approval if Spectrum desired to add those uses to its Business Park, NOW THEREFORE, the City and Spectrum stipulate and agree to the following: A. Vested Uses. The City and Spectrum agree that Spectrum is vested to uses that have historically existed legally at the Spectrum site. These uses include Auto Repair, Storage, Light Manufacturing, Office, Deli/Cafe, Services. A list of allowed uses is attached as Exhibit A. B. Non -vested Uses. The City and Spectrum agree that the following uses are not considered outright vested rights granted to the property. When proposed, the following uses may be reviewed for possible environmental and zoning change of use pursuant to WAC197-11- 800(3) and FWCC definition 22-1 "change of use", or as may be amended. The following proposed uses shall be consistent with use definitions, process and development standards as specified by the FWCC Business Park (BP) zone or any future zoning assigned to this property. I . Additional office uses that will cause the total square footage of current office uses to exceed 3,050 square feet. This does not apply to offices that are associated with and incidental to other allowed uses. 2. Banking and related financial uses. 3. Medical/dental offices delivering patient services. 4. Retail stores. 5. Additional sit-down or fast food restaurants greater than 1,110 square feet. 6. Oversized commercial vehicle facilities and service yards. 7. Gas station. 8. Car wash. 9. Hotel/motel. 10. Residential uses. 11. Churches. 12. All schools and daycare. 13. Adult entertainment. 14. Commercial recreation. 15. Outdoor storage, display or activities. 16. Additional industrial uses designated by the Institute for Traffic Engineers `Trip Generation Manual' as: -#110: General Light Industrial 4120: General Heavy Industrial -9130: Industrial Park 4140: Manufacturing This does not include Light Manufacturing uses like those included in Exhibit A.
