Dear Dayshawn Burns:
On June 7, 2021, the City of Federal Way’s Department of Community Development received your zoning
inquiry regarding the property located at 1704, 1720, 1710, 1626, 1620 South 341st Place, Federal Way, WA
(parcel numbers 390380-0110, -0120, -0130, -0140, & -0150). Your request for information includes questions
listed below in bold, with the city’s response following.
1. The current zoning classification for the subject property is:
The current zoning classification is twofold on this property. For parcels 390380-0110, 390380-0120,
390380-0130, and 390380-0140, the zoning classification is Commercial Enterprise (CE). Parcel 390380-
0150 zoning classification is Community Business (BC).
The adjacent property zoning designations for parcels 390380-0110, -0120, -0130, and -0140 are:
North: CE
South: CE

West: BC

4. The subject properties are currently regulated by:
For parcels 390380-0110, -0120, -0130, and -0140, the zoning classification is CE. These parcels are
regulated by Federal Way Revised Code (FWRC) Title 19, “Zoning and Development Code”; Chapter
19.240, “Commercial Enterprise”; and Section 19.240.010, “Warehouse – Distribution – Storage facilities
– Truck Stops – Automotive emissions testing facilities.”
Parcel 390380-0150 zoning classification is BC. The parcel regulated by FWRC Title 19, “Zoning and
Development Code”; Chapter 19.220, “Community Business”; and Section 19.220.010, “Office/retail –
Manufacturing and production, limited.”
The subject parcels are also regulated by FWRC Chapters: 19.115 “Community Design Guidelines,”
19.125 “Outdoors, Yards and Landscaping,” and 19.140 “Signs”; among other aspects of FWRC Title 19
regulating development of the subject parcels and their associated zones.
5. According to the Zoning Regulations for this district, the uses of the subject properties are:
For parcels 390380-0110, -0120, -0130, and -0140, the zoning classification is CE. These parcels are
“Permitted Use by Right,” currently regulated by FWRC Title 19, “Zoning and Development Code”;
Chapter 19.240, “Commercial Enterprise”; and Section 19.240.010, “Warehouse – Distribution – Storage
facilities – Truck Stops – Automotive emissions testing facilities.”
Parcel 390380-0150 zoning classification is BC. The parcel is “Permitted Use by Right,” currently
regulated by FWRC Title 19, “Zoning and Development Code”; Chapter 19.220, “Community Business”;
and Section 19.220.010, “Office/retail – Manufacturing and production, limited.”
6. The subject structures were developed:
The time of construction on these parcels was prior to the City of Federal Way’s incorporation under the
jurisdiction of King County. Verification of conformance with current zoning regulations is typically
performed at the time of a formal project review. At this time, the city cannot confirm compliance with
the current zoning code or building requirements without a formal site plan review.
7. Have any variances, special use permits/exceptions, ordinances or conditions been granted/
approved for either the use or structures of the subject property:
According to the city’s database, there are no variances, special permits/exceptions, or ordinances for the
subject properties.
A Stipulation and Agreed Order was conditioned in 2005 for parcels 390380-0110, -0120, -0130, and -
0140, associated with code violation file #05-103681-00-VO (enclosed).
8. Rebuild in the event of a casualty, in whole or in part, the zoning code states that a legal non-
conforming property:
If the development is found nonconforming at the time of casualty, then it would have to comply with
the FWRC 19.30.200, which states:
“If a nonconforming use or development is damaged by sudden accidental cause, that use or
development, including associated improvements, may be reconstructed if it meets the
following requirements:

“(1) The use or development, including associated improvements, as reconstructed, is
not any more nonconforming than it was immediately prior to the damage.
“(2) The applicant applies for building and any land use permits to reconstruct the
damaged improvement within six months of the date of the damage and reconstructs
the improvement pursuant to such permits.”
If it is a conforming development, then the structure may be rebuilt according to codes then in effect.
