RE: Permit #15-102845-00-AD; FRED MEYER
33702 21" Avenue SW, Federal Way
Dear Ms. Long:
statewide arkin lots.oi'fice comcast.net
The City of Federal Way's Department of Community Development has received your request for a work
hour variance to perform construction activities outside of normal working hours. The proposed project
site is located at 33702 21" Ave SW (Fred Meyer) in Federal Way. The proposed work hours are between
7:00 pm and 7:00 am and will occur July 19 through July 26, 2015. As such, you are requesting relief
from Federal Way Revised Code (FWRC) 19.105.040, "Regulation of Work Hours."
WORK HOUR EXCEPTION
Pursuant to FWRC 19.105.040, work hours are permitted outright between the following hours:
7:00 a.m. and 8:00 p.m. Monday through Friday
9:00 a.m. and 8:00 p.m. Saturday
Development activities and heavy equipment operations are also not permitted on Sundays or holidays
observed by the city. However, the Director of Community Development may grant revocable written
permission to engage in development activity other than the above permitted times, in accordance with
FWRC 19.105040(2)(a):
a) Any exception must be requested by advance written request to the director, including a
description of the specific exception(s) requested; proposed temporary construction
mitigation measures for any related impacts such as traffic, noise, and glare; and an
analysis of how the request meets the following criteria:
i. The work will not result in substantial adverse impacts to surrounding
properties.
ii. The exception is necessary to avoid undue delay of project completion
and/or long-term inconvenience or disruption to the public.
APPROVAL
The proposed work activity involves Statewide Parking Lot Services, who will use a seal coating
machine, striping machines, and grinder at 33702 21" Ave SW (Fred Meyer) in Federal Way. The
applicant has requested a work hour variance for night work as the proposed work would heavily interfere
with customer parking at the site. Therefore, based on your written request, the Director of Community
Development hereby grants you revocable approval to engage in construction activity between 7:00pm
and 7:00am between July 19 and July 26, 2015.

NOTICE
Pursuant to FWRC 19.105.040(3), the Director hereby requires the following notice requirements:
Applicant shall mail written notice, at least seven calendar days in advance of the approved work,
to owners and occupants of residential property located within 300 feet of project boundaries; and
post one notice board at each driveway of the project site. Such notice shall include the approved
construction hours, general description of construction activities, summary of mitigation measures
accepted by the director, if any, and two 24-hour project contacts for the duration of the project.
CLOSING
Please be advised that the city may revoke or modify any exceptions approved under this section based on
verified complaints that the development activity or equipment operation does not meet the terms of the
approved exception, or if the activity creates some unanticipated and verifiable adverse effect.

Sarah,
A few clarifications are needed regarding the request to work outside of normal city hours at the Fred Meyers in Federal
Way, WA (33702 21s' Ave SW).
Specifically, what is the work to be completed at the Fred Meyers, and what (if any) major equipment will be
used on site?
In a previous email, you noted that work will be commencing (weather permitting) on either "July 19th —July 19cn
or July 20th —the 27th". Can you help us understand the discrepancy between date ranges here? Eg. one day vs.
one week
Thank you,
Cory Darrow
