Specifically, you are requesting that the portions of Roadway A (south of the intersection with Roadway D) and Roadway C, that are required to be constructed using roadway Cross Section 1 (60' of ROW containing: 36' of pavement, 4' planter, 5' sidewalk and 3' utility strip on each side), be modified to Roadway Cross Section 2 (54' of ROW containing: 30' of pavement, 4' planter, 5' sidewalk and 3' utility strip on each side). Although the proposed development appears to meet Community Development guidelines regarding the number of parking spaces required for each dwelling, additional parking to accommodate guests and overflow parking from the community is needed. While roadway Cross Section 2 does provide additional parking on one side of the street, given the density of the proposed development, we do not believe it will be adequate. Therefore, your request to deviate from the approved modification request dated August 28, 2007, is denied. Federal Way City Code (FWCC) Section 22-1477 gives the public works director (Director) the discretion to modify, defer or waive the requirements of the FWCC after consideration of a written request In the residential (western) portion of the site, the FWCC requires the design and construction of the north -south internal street connecting S 336th Street to the S 131h Street extension in accordance with a Type S Street Section (36' pavement, vertical curb and gutter, 4' planter strip with street trees, and 5' sidewalks in a 60' right-of-way). Unusual topographic or physical conditions preclude the design and construction of the improvements to the applicable Street Sections as required by the FWCC in the residential portion of the site. Two large Wetlands on the site necessitate a modified design for the internal roads within the site. To safely and efficiently provide internal circulation, provide the greatest protection to the wetlands and buffers, and provide a reasonable economic return on investment, a reduced roadway design must be located between Wetland 2 in the northwest comer of the site and Wetland 1, a wetland that bisects the site from north to south. We have discussed your question regarding S 340th St Improvements and reached the following conclusion: Both Federal Way Village and Progressive must either reach written agreement regarding the construction of 340th Street, or each project must be designed to stand alone with respect to providing a functional street and connection to Pacific Highway South. 1. The Zoning Approval for Federal Way Village requires that S 340th Street be constructed. South 340th Street shall be constructed to meet the City's Cross Section R standard, which consists of 40' of pavement, 4' planter strips, six-foot sidewalks, and 3' utility strips all within a 66' right-of-way. 2. If the above mentioned parties are unable to reach an agreement that would result in the roadway being constructed equally on each property, then the first development in will be required to construct a 3/4 street section on their property, which will allow the improvement to function adequately until the balance of the roadway is built. A 3/4 street improvement would consists of at least 24' of pavement, one 4' planter strip, one 6' sidewalk, and one 3' utility strip. 3. The Federal Way Village plans submitted do not show a definite right-of-way dimension along the south side of the property, however it scales out to be approximately 20 feet. If the developer wishes to progress to preliminary plat approval or to land use approval for the commercial portion, the plat map must show a minimum of 33' of right-of-way dedication on all portions of S 340th Street along the southern property line. In addition, please note the following: 1. It is the responsibility of the developer to acquire any construction or grading easements on the neighboring property to accommodate road construction. Please show the future right-of-way dedication graphically, label, and dimension. This must be shown on all plans for the plat and the commercial areas. Why are we dedicating even more ROW along the commercial portion of the property? Shouldn't this have been taken care of when the city completed its recent intersection improvements? It there a UP project to add this additional lane? If not, then there doesn't seem to be a nexus for this additional dedication. And lastly, why wouldn't this lane be shared with a 6 ft dedication from each side of 336th? Our plat is based on a boundary survey, so the ROW widths should be accurate. We are working on an agreement with the neighboring property owner regarding the ROW dedication and cost sharing of the 340th improvements. Is this something you need now? The 340th extension will be part of the residential development as required even though that area is shown as part of Phase 5. I'm not aware of a modification to this requirement. Can you explain why the 12' dedication is not shown? Is there already enough room out there for the extra turn lane? I seem to be in the dark on this one. Some other questions: We previously noted that the right-of-way shown for 340th is insufficient for the required 3/4 street improvements along the south property line. If you're planning on the neighboring property dedicating a portion of it, we need written verification from the neighbor. Do you have that available? Your phasing lines indicate that the extension of 340th out to Pac Hwy is not part of the residential plat, however that is a requirement for the plat. Plats that large must have a second access. Is this simply an error in the graphic representation, or is there a problem regarding the access? Also, typically we provide street sections with the preliminary plat when it goes to the hearing examiner. In my last set of comments I asked for the street sections to be revised to match the modification that was issued, but I didn't get that sheet back with this resubmittal. I am required to have this information accurate and available for the hearing examiner. There are other items outlined in my 9/5/07 memo to Janet Schull, which she passed on to you previously (I attached it to this email), however they can be addressed in the civil review. This would move the sidewalk to against the curb and allow the road to be moved to the west. The right of way will return to 54' with 3.5' planter and 3' utility strip south of here per the October 1, 2007 letter. Same message I left for you in voice mail on Monday. Site plan approval is highest priority to get out this week, followed by processing of the plat once we receive the revised plat drawing. Concurrently we will process a new SEPA and amendments to rezone conditions. I'm not sure how Len interpreted that to mean the plat is on the "back burner", but that's not the city's position.
