Dear Mr. Foy:
A preapplication conference with the City of Federal Way's Development Review Committee (DRC) was
scheduled for November 17, 2005. From speaking with you on the telephone on November 18, 2005, I
understand that, due to a change in staff at Clearwire, no one attended the meeting. Nonetheless, we
would like to provide you with this letter so that you may proceed with your application.
The DRC members who reviewed your project and provided comments include staff from the City's
Planning Division, Building Division, and Public Works Department, as well as the Lakehaven Utility
District and the Federal Way Fire Department. Some sections of the Federal Way City Code (FWCC) and
relevant informational handouts are enclosed with this letter. Please be advised that this letter does not
represent all applicable codes. In preparing your formal application, please refer to the complete FWCC
and other relevant codes for all additional requirements that may apply to your project.

PROJECT DESCRIPTION
Proposal to collocate wireless antennas on an existing monopole in a BC zone.
DEPARTMENT COMMENTS
Outlined below are the comments made by the representatives of each department for the preapplication
conference. Each section should be read thoroughly. If you have questions, please contact the
representative listed for that section.
PLANNING DIVISION (Andy Bergsagel, 253-835-2644, andy.bergsagel@cityoffederalway.com)
The Federal Way City Code is available online at http://search.n-isc.org/codes.aspx. You can click on
"Chapter 22" for zoning.
1) Zoning, Land Use, and Review Process. The zoning for the proposed site is BC (Commercial
Business). PWSFs are permitted in the BC zone pursuant to FWCC Section 22-762 (enclosed). If

you refer to this page of the zoning chart you will see that the required review for a completely new
PWSF at this site would be Process III, per Note 2.a., since the PWSF is located within 300 feet of a
residential zone; however, the site is already developed, so we would refer to FWCC Section 22-32.2
"Review processes for improvements and additions to developed sites" (enclosed), to see what the
review process is. FWCC Section 22-32.2(1) states, "Improvements and/or additions to an existing
developed site that are exempt from SEPA shall be processed using Process I, provided the
improvements and/or additions do not exceed any of the following thresholds...." It appears that your
proposal does not exceed the thresholds. Therefore, your proposal would be reviewed as Process I.
For a Process I land use review the Director of Community Development Services makes a decision
based on criteria listed under FWCC Article N.B. (Section 22-351, et seq.). A Process I Handout
and Master Land Use Application Form are enclosed. Also enclosed are FWCC Sections 22-966
through 22-975, pertaining to Personal Wireless Service Facilities.
2) State Environmental Policy Act (SEPA). The project appears to be exempt from SEPA review, since
it meets the categorical exemption as described in the Washington Administrative Code (WAC) 197-
11-800(25)(a)(ii), in that your proposal is for personal wireless service antennas "to be attached to an
existing structure (that may be an existing tower) that is not a residence or school, and the existing
structure to which it is to be attached is located in a commercial zone."
3) Fees. The Process I project application fee is $64 at the time of application and $59 per each
additional hour of review.
4) PWSF Prioritized Locations. FWCC Section 22-966(d), lists "Prioritized Locations." The Code
states, "...the applicant shall analyze the feasibility of locating the proposed PWSF in each of the
higher priority locations and document, to the City's satisfaction, why locating the PWSF in each
higher priority location and/or zone is not being proposed." This written analysis must be submitted
with the application.
5) PWSF Development Standards (building- or structure -mounted PWSFs not located in the public
right-of-way). Per FWCC Section 22-967(1), a PWSF mounted to an existing structure (such as the
one you propose) shall generally consist of only a "microcell" or "minor facility." In certain cases a
PWSF that exceeds these thresholds can be allowed per FWCC Section 22-967(1)(a)(2). Per the
definitions listed in FWCC Section 22-1, "minor facility means a wireless communication facility
consisting of up to three antennas, each of which is either: (1) four feet in height and with an area of
not more than 580 inches; or (2) if a tubular antenna...." It appears that your proposal does not
exceed the threshold of a "minor facility" if there are just three antennas, but your proposal
mentioned space for one more future antenna. The City will review your request for the fourth
antenna as part of your application, if you provide written justification, per FWCC Section 22-
967(1)(a)(2). Otherwise, you will have to go through another land use process application in the
future for the fourth antenna.
6) Standards for Electronic Equipment Enclosures, FWCC Section 22-967(5). There are four priorities
listed, pertaining to enclosures. The Code states, "In proposing an equipment enclosure in a
particular location, the applicant shall analyze the feasibility of locating the proposed equipment
enclosure in each of the higher priority locations and document, to the City's satisfaction, why
locating the equipment enclosure in each higher priority location is not being proposed." It appears
that you are requesting priority "c" and that you have provided justification.

7) Screening Standards for all PWSFs. Pursuant to FWCC Sections 22-967(4) and 22-967(5)(b),
PWSF's shall be screened. The screening standards include landscaping around equipment cabinets.
The documentation you submitted states that the screening and landscaping already exist.
8) Cumulative Effect. Pursuant to FWCC Section 22-967(8), the City shall consider the cumulative
visual effects of PWSFs mounted on existing structures and/or located on a given permitted site in
determining whether additional permits may be granted so as to not adversely affect the visual
character of the City. You state in #8 of your letter: "Please refer to the attached photo simulations
for verification." There is a note in the file that these will be submitted later.
9) Application Requirements. Pursuant to FWCC Section 22-970, all of the following information must
be submitted before an application for a PWSF can be reviewed for approval. Please refer to the full
text of the code. If the originals are in color, please provide copies that are also in color. Also include
the requirements mentioned elsewhere in this letter.
o A diagram or map showing the primary view shed of the proposed facility.
o Photo simulations of the proposed facility from affected properties and public rights -of -
way.
o Elevations of proposed facility.
o A coverage chart of the proposed PWSF at the requested height, and an explanation of
the need for that facility at that height and in that location.
o An inventory of other PWSF sites operated by the applicant, or other providers, within
a one -mile radius of the proposed PWSF location.
o A site plan showing the specific placement of the PWSF on the site; showing the
location of existing structures, trees, and other significant site features.
10) Collocation. FWCC Section 22-971 requires a signed statement indicating that the applicant agrees
to allow for the potential collocation of additional PWSF equipment by other providers on the
applicant's structure or within the same site location, as part of the permit application. However, this
does not apply to your application, since the existing structure is owned by an entity other than the
applicant.
11) EMF Standards and Interference. FWCC Section 22-972 states that within six months after the
issuance of its operation permit, the applicant shall submit a project implementation report which
provides cumulative field measurements of radio frequency (EMF) power densities of all antennas
installed at the subject site. Also, the applicant shall ensure that the PWSF will not cause localized
interference with the reception of area television or radio broadcasts or the functioning of other
electronic devices.
12) Permit Limitations. FWCC Section 22-974 states that a permit for a PWSF shall expire ten years
after the effective date of the permit approval. Renewals will be considered.

a. Structures located in the BPA Trail. Bonneville Power Administration is
currently reviewing their position on allowing communications carriers to
collocate on existing BPA transmission towers and utility poles. Despite
Clearwire's diligent efforts, BPA has not granted Clearwire a Master Lease
Agreement that would allow the company to locate antennas on BPA towers or
poles.
b. Exising broadcast, relay and transmission towers - regardless of underlying
zoning. Clearwire is proposing to utilize an existing, legal monopole tower.
c. Publicly used structures. N/A. Clearwire is utilizing a higher priority location.
d. Appropriate, business, commercial, and city center zoned sites. N/A. Clearwire
is utilizing a higher priority location.
e. Appropriate public rights -of -way. N/A. Clearwire is utilizing a higher priority
location.

2. Section 22-967.1.: PWSFs Located Outside Public ROW. mounted on existing
buildings and structures not located in a public right-of-way shall conform to the following

3. Section 22-967.4.: Screening Standards. "PWSFs shall be screened or camouflaged
through employing the best available technology and design, as determined by the city.
This may be accomplished by use of compatible materials, location, landscaping, color,
stealth techniques such as, but not limited to, artificial trees and hollow flag poles, and/or
other methods or techniques to achieve minimum visibility of the facility as viewed from
public streets or residential properties. In addition, the provision for landscaping as
outlined in the use zone charts." The antennas and microwaves will be flush -mounted
within 8" to the existing monopole and will be painted to match the color of the pole
to minimize visual impact. The equipment shelter will be placed inside the existing
compound to screen the shelter from view.
4. Section 22-967.5.a.: Standards for E1ectronics.fgg%gngjA Enclosures. "The following
shall be the required order of locations for proposed electronic equipment enclosures for
all PWSFs. In proposing an equipment enclosure in a particular location, the applicant
shall analyze the feasibility of locating the proposed equipment enclosure in each of the
higher priority locations and document, to the city's satisfaction, why locating the

a lower priority location for the equipment enclosure, the burden of demonstrating
impracticability shall be on the applicant. In order of preference, the prioritized locations
for equipment enclosures are as follows:"
a. Underground equipment enclosures. The existing compound contains
underground cable. It would not be feasible to require other carriers to move
their coax in order for Clearwire to be able to locate their equipment
underground.
b. Existing Completely Enclosed Buildings. The existing compound does not
include an existing completely enclosed building with space for Clearwire's
equipment.
c. Equipment enclosures shall be placed above ground in an enclosed cabinet that
shall not exceed six feet in height and occupy more than 48 square feet of floor
area, including areas for maintenance or future expansion." Clearwire's
equipment shelter will be five feet in height and occupy roughly 16 square feet
of floor area. The shelter may not be expanded to more than 48 square feet of
floor area, as some portion of the 49 square foot lease area must be left open to
allow for access to Clearwire's equipment. Also, the equipment will be placed
in the existing enclosed compound.
d. New Completely Enclosed Above Ground Building. N/A
5. Section 22-967.4.b.: Equipment Shelter Screening and Landscaping_ Clearwire is
proposing to place their equipment shelter inside an existing compound that already
is screened from view and landscaped. Thus, this section does not apply to
Clearwire's proposal.
6. Section 22-967.4.c.: Equipment Setbacks. The height of the existing monopole will
not be extended, and Clearwire's equipment shelter will be placed within the existing
compound. Thus, the city's setback requirements will be met by Clearwire's proposal.
7. Section 22-967.7.: Securi Fencin . Clearwire will utilize the existing security
fencing around the existing compound. Thus, this section does not apply to the
proposal.
8. Section 22-967.8.: Cumulative Visual Effects. "The city shall consider the cumulative
visual effects of PWSFs mounted on existing structures and/or located on a given
permitted site in determining whether additional permits may be granted so as to not
adversely effect the visual character of the city." The antennas and microwave dishes
that Clearwire plans to add to the existing monopole will not significantly alter the
visual effect of the existing tower. The antennas and microwaves that Clearwire
proposes will be flush -mounted to the existing structure and are much smaller than
existing antennas on the tower. The visual character of the city will not be adversely
affected. Please refer to the attached photo simulations for verification.
9. Section 22-970: Application Requirements.
a. A diagram or map showing the primary viewshed of the proposed facility.
Clearwire is proposing to use an existing 154' monopole on the property, thus
utilizing the best possible option in this area to meet their coverage objectives.
b. Photo simulations of the proposed facility from affected properties and public
rights -of -way at varying distances. Please seethe attached photo simulations.
c. Architectural elevations of proposed facility and site. Please refer to the attached
site plan and construction drawings.
d. A coverage chart of the proposed PWSF at the requested height and an
explanation of the need for that facility at that height and in that location. The
explanation shall include an analysis of the feasibility of locating the proposed

A Flexible Solution for Mass -Market Applications
In order to provide a successful wireless broadband service, wireless broadband
service providers need to be able to deploy an infrastructure that is easy and cost
effective to install and maintain. The NextNet Expedience'" NLOS base station is a
winner on both counts! Designed for ease of installation in a number of different
configurations, the flexibility of the Expedience base station will keep costs down as
your system needs change by supporting a highly scalable system architecture for
both rural and metropolitan areas.
NextNet's Expedience base station is a fully self-contained, environmentally -
hardened unit. It offers maximum flexibility for installation at the tower top, in an
equipment enclosure, or mounted on a rooftop or pole. Connections to the unit
include a single coaxial antenna feed, -48 VDC power, and GPS UTC (Universal
Time, Coordinated) timing signal used to synchronize the base stations when more
than one cell is installed in a geographical area.
The base station can be used in both sectored or omnidirectional configuration,
using standard antennas. Initial frequency of operation channel setup or channel
changes can be made remotely using the Expedience Network Management
System and do not require any hardware changes at the site. Stacking of up to four
base stations on a single antenna is easily accomplished using accessory combiner
modules.
The network interface to the Expedience base station is a standard Ethernet 10/100
base-T connection, using a special weatherproof connector. Complete management
of the base station can be accomplished through a local serial port, telnet, web
interface or using an SNMP-based Expedience Network Management System.
A complete on -site installation includes a transient voltage suppressor (TVS) module
for each base station. The TVS module also contains a full -wave bridge rectifier,
allowing the Expedience base station to be powered by -48V, +48V, or floating 48V
power supplies. To power the base station in a cell, a dual redundant 48VDC
power package is available.

GROUNDING NOTES
1. AN ANTIOXIDANT COMPOUND SHALL BE APPLIED TO ALL

2. CONTRACTOR SHALL SUPPLY ALL MATERIAL, LABOR AND

POINTS SHALL BE DETERMINED IN THE FIELD, ADJUST LOCATIONS
AS REQUIRED TO KEEP GROUND CONNECTIONS AS SHORT AS
POSSIBLE (9" MIN. BEND RADIUS AND 90 DEGREE MAX
BEND ANGLE). ALL BELOW GRADE GROUNDING SHALL BE
INSPECTED AND APPROVED BY CONSTRUCTION MANAGER PRIOR
TO BACKFILLING.
