S. Planning Manager Doc Hansen spoke with you over the counter when you visited the City of Federal Way Permit Center in July 2019. He stated the requested use is a legal non -conforming and currently existing on site per historic city business license registrations, established initially by current owner prior to incorporation, Mr. Nelson. The site is legal non -conforming as the current zoning, which the Community Business (BC) zone regulated by the Federal Way Village/Kitt's Corner Master Plan. The current master plan and ordinance adopted by city council does not permit vehicle related uses. The current master plan permits commercial -retail pedestrian orientated uses only. For reference, Federal Way Revised Code (FWRC) Section 19.30.080 states: 'Any non -conforming use must be terminated if., (1) The applicant is expanding gross floor area on the subject property, whether the expansion involves an addition to an existing building or new and separate structure. (2) The subject property has been abandoned." Therefore if said use has continued in operation pursuant to FWRC 19.30.080 towing services and vehicle storage may continue to operate. The use shall be restricted to tax parcel 202104-9090. No other parcels within the master plan shall operate a tax -tow lot or accessory vehicle storage nor have they establish a legal non -conforming use status; doing so would result in a code enforcement action by the city.
