Dear Mr. Hovland:
The city is in receipt of your October 5, 2015, request to verify zoning and allowed use of a new
proposed business that includes steel assembly, storage, and offices at the above -mentioned
location. The zoning of the subject property is Community Business (BC).
ZONING COMPLIANCE REVIEW
FWRC 19.15.025 addresses a change of use at a developed site as follows:
"19.15.025. Zoning and use review process for new tenants — Change of use at a developed site.
The purpose of this section is to review and determine compliance with applicable zoning and
development code requirements when a new use is proposed to occupy an existing building or
site. When a land use changes from one use category in the zoning charts to another use
category, a zoning compliance review shall be performed as part of the use process review, when
required, or in conjunction with the required business registration and/or building permit review.
Each paragraph in a zoning chart is a use category. If the new use is in the same use category as
any previous legal use of the site, no zoning compliance review is required."
A new use is proposed to occupy the existing building. The steel assembly business is an allowed
use per FWRC 19.220.010 `Manufacturing and production, limited.' The site was previously
used by New Lumber & Hardware for retail sales, which is a permitted use per FWRC
19.220.010. The two uses are in different paragraphs and considered a different use category;
therefore, a zoning compliance review is required as indicated above.
Any new use shall comply with only those standards of the use zoning chart that are directly
related to the new use. This includes parking, setbacks, use -specific notes/regulations, and
surface water quality improvements identified. Other nonconforming aspects of the site which
are not made nonconforming as a result of the change of use are not required to be brought into
conformance as a result of this subsection.

CLOSING
The proposed steel assembly/storage use is allowed in the BC zone. A change of use analysis
will be required. Please fill out the attached change of use analysis form and include a site plan
and floor plan that will help in the evaluation. There is a $148.00 fee that must be included when
submitting the change of use analysis to the Permit Center. If you have any questions please feel

the existing site and building(s).
Description of proposed Improvements,
Phase I Use.
The Proponent intends on using the existing building and site for storage of steel suds
and related construction materials on the First Floor
Phase I - Proposed improvements:
• Upgrade the exterior of the main building by repairing and/or replacing the
existing siding
• Repair/Replace rooting as necessary
• Site improvements•
- Landscaping
- Lot drainage if necessary
- Fencing if needed
It should be noted that our emphasis at this time in is being able to
occupy the First Floor for the storage and completing siding
upgrades, rooling repairs, improvements to the site, etc, so that they
can utilize the building as soon as possible.
Phase 2 Uses.
• Remodel the portion of the second floor of the building adjacent to Pacific
Highway for office use:
- General office use
- Sales of steel studs and steel stud panels
• Assembly ofsteel stud panels at the First Floor
Phase 2 Improvements. -
Remodel the second floor of the building adjacent to Pacific Highway for office
use:
- Remodel of the second floor to accommodate their office functions
- Remodel of first floor to accommodate barrier free access to ohices, etc.
■ Improvements will include building upgrades to meet relevant Building and
Zoning Codes

"Manufacturing and production" means the mechanical or chemical transformation of materials or
substances into new products, including the assembling of component parts, the creation of products,
and the blending of materials, such as oils, plastics, resins, or liquors. Manufacturing and production
is divided into the following categories:
(1) "Manufacturing and production, general, " means establishments typically manufacturing and
producing for the wholesale market.
(2) "Manufacturing and production, limited," means retail establishments engaged in the small-scale
manufacture, production, and on -site sales of custom goods and products. These uses are
distinguished from "manufacturing and production, general," by a predominant use of hand tools or
domestic mechanical equipment, limited number of employees, limited sales volume, limited truck
deliveries, little or no outdoor storage, typical retail hours of operation, and an obvious retail storefront
with a public entrance that is in scale with the overall building ,and oriented to the right-of-way. This
category includes uses such as ceramic studios; candle -making shops; custom jewelry
manufacturing; woodworking and cabinet making; manufacturing of specialized orthopedic appliances
such as artificial limbs or braces; manufacturing of dental appliances such as bridges, dentures, and
crowns; production of goods from finished materials such as wood, metal, paper, glass, leather, and
textiles; and production of specialized food products such as caterers, bakeries, candy stores,
microbreweries, and beverage bottlers.
