Proposed modifications include: changing the location of the Americans with Disabilities Act (ADA) parking from the front to the back of the building; installing a C-Curb that defines the walkway from the ADA parking to the entryway; removing five parallel parking stalls at the north side of the property; replacing the existing concrete at the front entry and adjacent sidewalk; adding a concrete planter and landscaped area in front; and adding a new sidewalk from the city walkway to the front of the building_ CONDITIONS The proposed work is hereby approved subject to the following conditions: The current width of the driveway (including parallel parking) is stated to be 23 feet. This width will be reduced once the accessible walkway along the building is in place. As such, the parallel parking should be removed to allow safer ingress/egress of the property from the street. The removal of visible parallel parking lines should be distinct enough to clearly indicate the area is no longer to be used for parking. A C-Curb will be required along the length of the building from the ADA parking to the front entry as depicted in your illustrated site plan. In compliance with ADA Part 36 "Standards for Accessible Design," pursuant to 4.3.3* "Width," the ADA walkway must be a minimum of 36 inches. Pursuant to 4.8.2* "Slope and Rise," the maximum slope of the concrete ramp leading up to the existing entry level illustrated in your site plan shall be 1:12. That is, 1 inch of rise for every 12 inches of horizontal run. CONCLUSIONS The subject property is zoned Community Business (BC) and pursuant to Federal Way Revised Code (FWRC) 19.222.010, dental office use is permitted in BC zoning districts. Various sections of the FWRC Title 19, "Zoning and Development Code," indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed modifications to the developed site meet the following Process I appro� al criteria and land use review thresholds of FWRC 19.15.0 30 and 19.55.020: 1. The proposed modifications are consistent with applicable chapters of FWRC Title 19 including, but not limited to: "Permits and Review Processes"; "Process I — Director's Approval"; and "Community Design Guidelines"; 2. The health, safety, and welfare of the citizens of the city are preserved; 3. There is no change of use; r the amount of required landscaping, buffering, open space, or 5. T, here �nb` a er range or reduction in the amount of required parking; 6. There is no material change in the location of utilities, easements, and the proposed ADA walkway is in compliance with applicable codes; 7. There is no material change to the approved architectural design; and 8. There are no additional adverse impacts to sensitive areas or significant trees. APPEALS The effective date of this decision is January 1, 2012, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing by January 17, 2012. If you wish to waive your right to appeal, you must do so in writing to the Department of Community and Economic Development. No work on the proposal may begin until the end of the appeal period or receipt of your waiver. Any appeal must be in the form of a letter delivered to the department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
