Dear Mr. Hovland:
This letter updates landscape comments for the WIRB phase II site. The September 21, 2009, letter included
comments on landscaping proposed in the new perimeter island on the northeast corner of the site, as well as in a
new interior parking lot landscape island north of the building, and in large planters adjacent to the pedestrian plaza.
As noted in the October 5, 2009, amended Process I Director Decision, the perimeter landscaping is not a
requirement of this project. In light of that fact, landscape plan comments are updated as follows:
Landscape Plan Comments - The landscape plan can be approved once it is revised to address the following items:
1. Crroundcover must be planted so that it achieves fall coverage of the planting areas within three
years per Federal Way Revised Code (FWRC) 19.125.040(lo). The quantity and location of the
proposed Fountain Grass will not meet this requirement and must be
revised. Note that the Daylilies are deciduous perennials and do not qualify as groundcover.
2. Provide across section of the interior parking In perime landscaping that includes curbing on
each side of the landscape island, , the depth of ground
excavation when the existing asphalt is removed, soil amendment type and depth, planting and
staking specifications, mulch with specifications, and other relevant information in conformance
with FWRC 19.125.040. Provide "industry specifications" to the landscape plan so it is bid ready.
3. Revise the landscape plan to include planting information about the new planters, including size of
pot and the type, and size and quantity of landscape materials to be installed in each pot.
4. Add the stamp of the licensed landscape architect to the landscape plan.
5. Indicate how all new planting is to be irrigated.
As noted in the September 18, 2009, conditions of approval for Phase 11 of WIRB as well as the October 5. 2009
letter, approved landscaping must be installed and inspected by City staff prior to opening of the auto sales business.
When resubmitting, please provide three (3) copies of the revised landscape plan page with the enclosed Resubmittal

This letter provides comments on landscaping proposed in the new perimeter island on the northeast corner of the
site, in a new interior parking lot landscape island north of the building, and in large planters adjacent to the
pedestrian plaza. I reviewed the March 24, 2009, landscape plan prepared by Earth Tech Landscaping, which depicts
perimeter and interior parking lot landscaping.
The landscape plan can be approved once it is revised to address the following items. Please refer to the redline plan:
Landscape Plan Comments
1. Groundcover must be planted so that it achieves full coverage of the planting areas within three
years per Federal Way Revised Code (FWRC) 19.125.040(lo). The quantity and location of the
proposed Erica Cinerea `CD Easton' and Fountain Grass will not meet this requirement and must be
revised. Note that the Daylilies are deciduous perennials and do not qualify as groundcover.
2. Provide a cross section of the perimeter landscaping that includes curbing on each side of the
landscape island, perimeter fencing adjacent to the inside curb, the depth of ground excavation when
the existing asphalt is removed, soil amendment type and depth, planting and staking specifications,

To Whom It May Concern:
First, I am in receipt of a letter from Deb Barker, addressed to Mr. Michael Hovland, dated
September 21, 2009, in which she outlines her comments to our landscape plan for the property
located at 29805 Pacific Hwy South.
Second, I am also in receipt of a letter from Mr. Greg Fewins, Director, Community
Development Services, outlining his findings for process I approval of our project.
In follow-up to these communications, this letter is to bring to your attention the issue of the
City's requirement for us to now remove pavement that was recently installed by your city
workers and also for us to pay for the review of the site in question.
As has been the case to date, we will make every good faith effort to satisfy reasonable
conditions you outline for the completion of our project. However, in the letter from Mr.
Fewins, he clearly states that the city is expecting that we should "replicate original perimeter
landscaping that was removed with recent roadway acquisition." In other words, the City of
Federal Way removed existing landscaping from this exact site, paved over it so as not to incur
additional cost to the City, but is now requiring that we re -excavate the site and replace the
landscaping that was removed by the City, in addition to paying the City for their time to
review this.
To date, we have made every effort to comply with your requirements. However, the issue of
removing what you recently installed at our expense is not reasonable. During the paving
activity, your employee, Mr. Brian Roberts, Street Systems Project Engineer, verbally stated to

us that that City of Federal Way was paving over the site so as not to incur the cost of
landscaping.
This type of landscaping should never be required of us. The City of Federal Way chose to
remove the landscaping; therefore, the City of Federal Way should be responsible for replacing
it. Further, this letter is our official appeal of the following aspects:
➢ Replacement of landscaping
➢ Payment of $556.50 for the review of the landscape plan
➢ Change in fencing from the color of black to vinyl clad
