Dear Mr. Shewmake:
I am in receipt of your Process I application for a storage container at the above -referenced property.
According to the application, there are two 8'x40' containers placed on the site for storage. Under
Federal Way Revised Code (FWRC), storage containers are permitted on commercial properties subject to
the standards in FWRC 19.125.180 and other zone specific requirements. This includes specific submittal
requirements for the Process I application and development standards for the placement, design, and
screening of the storage container on the site.
ADDITIONAL INFORMATION REQUESTED
In order for the City to approve the storage unit application, please provide information about the
following:
Design Standards: Under FWRC 19.125.180(3) Design Criteria, permanent outdoor storage
containers are subject to FWRC 19.125.170(l) through (3) and (5) through (7), and the criteria in
FWRC 19.125.180(3)(a) through (3)(f). A visit to the site revealed that the storage containers do not
appear to comply with the following requirements, as discussed:
(a) Containers shall be placed to minimize visibilityfrom surrounding streets, pedestrian areas,
and properties; and shall not be located between the principal building and front property
line.
Discussion: The container is visible from Pacific Highway South. Is there a less visible
location for the storage container on the subject site? Moving the containers behind the
building would be an acceptable alternative location. No additional screening would be
required.
(d) Containers shall be painted to match adjacent building(s) or improvements.
Discussion: The building is painted white with blue trim, while the storage containers are
gray and off-white. Please paint the containers to match adjacent buildings or
improvements in order to meet this requirement, unless the containers are
relocated/screened so as to be not visible from off site.
(f) Containers shall be screened in accordance with FWRC 19.125.170(3)(b). In reviewing
proposed screening methods, the director will consider the zoning of the site and surrounding
properties; location of the container and visibility from adjacent streets and properties;

existing and proposed landscaping; and the physical condition of the container; provided,
that containers located on or adjoining a residentially zoned property shall receive 100
percent sight -obscuring screening.
Discussion: No screening exists to the front (west) side of the site and containers are
visible from the right-of-way. This requirement is not met. Please depict screening in the
form of landscaping/solid fencing along the front of the container (unless it is relocated to
a less visible location as discussed above).
SUMMARY
In summary, applicant responses to the above comments for the Process I application are necessary before
additional project review can proceed. This includes but is not limited to a revised site plan, and
landscape plan if necessary.
With this request for additional information, the 120-day maximum review time frame of FWRC
19.15.10(2) is suspended with 55 of the 120 days used, and it will be restarted within 14 days of the date
of your complete response to this request. When resubmitting requested information, please provide two
copies of any plans, in addition to the green resubmittal form.
CANCELLATION
Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the City within
180 days of being notified that such information is requested, the application shall be deemed null and
void and the City shall have no duty to process, review, or issue any decisions with respect to such an
application.

Subject: Outdoor Storage Containers (Cargo Containers) —ZONING COMPLIANCE 2N0 NOTICE

To Whom It May Concern:
The Federal Way City Council has adopted zoning regulations related to outdoor storage containers such as
cargo, shipping, or freight containers per Federal Woy Revi.4ed Code (VWRC) 19.125-180 and 19.125.190,
which became effective on November 13, 2009. This code requires that all outdoor storage containers come
into compliance within 24 months of the effective date of the ordinance. You arc receiving this notice
because the above referenced property contains outdoor Morage container(s) that are subject to the
compliance period under the new regulations. Please note that outdoor storage containers are prohibited as
an accessory use to either a single-family or multi -family residential use and must be removed by
November 30, 2010, unless they are a legal nonconforming use, having previously been approved by the
City of Federal Way 'or a prior jurisdiction.
Unless previously approved, outdoor storage containers in commercial zones must apply for a Process I
permit or must be removed by November 30, 2010_
in order to have your outdoor storage containers be a permitted use in the City OfFcderal Way, please
complete and submit the following items: (1) a Master Land Use Applicauon (enclosed); (2) an informal
site plan showing the "footprints" of the primary building and outdoor storage container($) on the
property; and (3) a Process I application .Fee, which is charged at the hourly rats: of $80.00 with the first
hour deposit required at the time of application.
Following review of the application, thc.city will issue a Process I approval for the storage containcr(s) if
it complies with FWRC 19.125.180, or we will notify you of any rcquirerrients.ffiat mirst be addressed for
approval_ Conditions of approval may include screen ing, painting, or relocation.
If the City does not receive the required application or approval by November 30, 2010, then the subject
property will be in violation of the MRC, and code enforcement action will be required. Please notify
Rebecca Chapin, Planning Intern, if you have already removed the outdoor storage container(s)-
