Dear Mr. McWilliams & Ms. JOubert:
The city is in receipt of your request dated November 29, 2016, for a "change of use at a developed site"
in accordance with Federal Way Revised Code (FWRC) 19.15.025 from office (real estate) to retail
services (hair and beauty salon). Your request is to locate the Daisy B Salon and Spa on the first floor of
an existing commercial building at the abovementioned address, which is zoned CE (Commercial
Enterprise). A therapeutic massage business is located in Suite B. The applicant proposes no external
fagade or site improvement modifications at this time.
The City of Federal Way Building, Development Services, Planning and Traffic Divisions, Lakehaven
Water & Sewer, and South King Fire & Rescue have reviewed this zoning change of use request.
FWRC 19.15.025 addresses a change of use at a developed site as follows:
"19.15.025. Zoning and use review process for new tenants — Change of use at a developed site. The
purpose of this section is to review and determine compliance with applicable zoning and development
code requirements when a new use is proposed to occupy an existing building or site. When a land use
changes from one use category in the zoning charts to another use category, a zoning compliance
review shall be performed as part of the use process review, when required, or in conjunction with the
required business registration and/or building permit review. Each paragraph in a zoning chart is a
use category. If the new use is in the same use category as any previous legal use of the site, no zoning
compliance review is required "
The proposed salon use is not located within the same zone chart or use category an office use; therefore, a
zoning compliance review is required as indicated above.
Change of Use Analysis — Permitted Use
The proposed salon is located in the Commercial Enterprise (CE) zoning district. Beauty and barber retail
services are a permitted use under the FWRC 19.240.070, `Retail, general and specialty — Manufacturing
and production,' limited use zone chart.
Parking Analysis
For the former real estate office, FWRC 19.240.080 required 1 parking space for every 300 square feet of
gross floor area. Required parking under FWRC 19.240.070 `Retail, general and specialty —
Manufacturing and production limited' retail services including beauty and barber also requires 1 parking
space for each 300 square feet of floor area. Daisy B will use the other half of the two -unit building and
the existing therapeutic massage business will use one half of the 3,572 sq. ft. building. Therapeutic

massage uses are considered a medical office use, which also requires 1 parking space for every 300
square feet of gross floor area.
The subject property requires 12 spaces for both Suites A and B (3,572 sq. ft. /300 sq. ft. = 11.9 spaces).
Planning staff have detennined the subject property contains 15 existing parking spaces, thereby
satisfying parking requirements for the existing use in Suite B and the proposed change of use in Suite A.
OTHER DEPARTMENT REQUIREMENTS
The following comments are provided as information in preparing subsequent permit application submittals to
the city.

Based on the application materials received the applicant proposes to alter the suite internally. The
applicant must apply for a tenant improvement building permit approval. For building permit submittal
requirements please contact the Permit Center at 253-835-2607 or permit.centerl ityotfederal%vay.c.oni.
Please contact Peter Lawrence, Plans Examiner, regarding accessible parking spaces requirements. It
appears no spaces are marked or signed as accessible.
CLOSING
Any new use shall comply with only those standards of the zoning and development regulations that are
directly related to the new use. This includes parking, setbacks, use -specific notes/regulations, and other
department review comments enclosed in this letter. Other nonconforming aspects of the site which are
not made nonconforming as a result of the change of use are not required to be brought into conformance
as a result of this subsection.
The proposed beauty salon is allowed in the CE Zoning District. The change of use request is hereby
approved.
Please be aware you must obtain a Business License approval through the City of Federal Way Finance
Department and building permits for suite modifications as required by the building department prior to
occupying the subject property and operating the new business.
