Mr. Bontempo;
You requested if an automobile sales activity could be provided upon the lot at 34110 Pacific
Highway South which now has an auto service activity upon it.
FWRC chapter 19.15.030 (4)states:
Where an improvement/addition that houses a new and different use is added to an
existing developed site, the new improvement/addition shall be processed under the use
process indicated by the applicable use zone chart.
You provided evidence that the property and building was operating as a service and secondary
vehicle sales when the property was purchased, and that you wish to continue that use. While the
initial use established after the time of purchase was an auto services site, your letter testimony
and staffs background analysis of the property through aerial photographic image, indicates that
the lot had been used for auto service and sales prior to the sale.
Your interest in continuing using the site for vehicle sales does not preclude the need to meet
current parking standards since the previous use met parking standards. Current parking for the
auto service and sales requires one parking space per 300 square feet of office and service area.
The building and office for the services of auto sales and servicing equals 3760 square feet, and
therefore, requires thirteen (13) parking spaces for the use. It has been determined that the
current lot has room for 9 parking spaces not including the service bays inside the structure.
It is further determined that if four (4) additional parking spaces are provided adjacent the parcel,
and if the adjacent land owner allowed such parking on his property for the auto service/sales use,
the parking requirement for the use will be satisfied. Staff has received a certified letter from the
adjacent land owner, Mr. Michael Pattison, indicating that he has given permission for the need
for the additional parking. It must be noted that the parcel 202104 9041 will be encumbered four
(4) parking spaces while the auto services/sales uses exists, and will be noted on title of parcel
202104 9041.
Because the auto service and sales existed before the sale of the property to the current owner,
there is no "new use" and therefore, does not need process review.

and Service Lot. I'm going to continue to use this
property as an Automobile Sales and Service Lot.
Attached you will find a letter of permission from
the property owner. He will allow overflow parking
at his place of business which is attached to the
above property.
