Dear Mr. Wei:
This letter summarizes the pre -application conference held January 23, 1997, at which
time members of the City's Development Review Committee discussed the general
requirements that will apply to the above referenced project. Those requirements are
summarized below and included as enclosures with this letter. Referenced sections of
the Federal Way City Code (FWCC) are enclosed with this letter or they were provided
to you at the meeting.
Land Use Division (Lori Michaelson, 661-4045)
a. Required review processes: The project site is located in the RM-3.6
zoning district (multi -family residential, 3,600 square feet of lot size per
dwelling unit. The proposed apartment complex is a permitted use in this
zoning district and the proposed density of 21 units is consistent with
density allowances. Pursuant to FWCC Use Zane Chart Sec. 22-667,
the proposal is subject to site plan review and development regulations
contained in the chart. The project is also subject to environmental
review under the State Environmental Policy Act (SEPA), and possibly a
Process II intrusion into stream setback pursuant to FWCC Sec. 22-1312,
as dicussed in b.(1), below.
b. Key zoning issues:
(1) Federal Way City Code (FWCC) Article XIV, Environmentally
Sensitive Areas, Division 5, Streams, regulates development
activity within 100 feet of a major stream. A portion of the property
and proposed development is located within fhe required 100-foot
setback from the delineated edge of a major stream. No intrusion
into the 100-foot setback is permitted, except as allowed by
FWCC Sec. 22-1312, Intrusion into setbacks. Under this section

b. (1) (cont'd.) only certain improvements such as essential public
facilities or minor improvements, such as walkways, are permitted
within this setback area. Minor remodeling of the house, involving
no earthwork or other use of heavy equipment, would not trigger
these requirements. However, any major alterations, grading, or
other proposal, such as usable open space, would require a
Process 11 public hearing. Any work proposed as part of Uniform
Buiding Code requirements will have to be reviewed for compliance
with this section. Further information concerning the existing
structure is included in paragraph (3) below, and also in the
attached comments from the Building Division. Further information
regarding the open space_ is included in paragraph (5) below.
(2) The proposal would also require culvert work within the stream for
required street improvements at South 330th Street (see Public
Works comments, below). Culvert work will be subject to Process
I review and approval pursuant to Sec. 22-1309. It is the
applicant's responsibility to demonstrate how the proposal meets
the stated decision criteria.
(3) The property contains an existing, vacant single family dwelling
that is located entirely within the 100-foot setback from the major
stream. FWCC Article IV, Nonconconformance, applies to aspects
of pre-existing developments that became non -conforming as a
result of the adoption of the FWCC, and determines when and
under what circumstances certain nonconformances must be
corrected. Under this article the existing single family dwelling may
continue to be used, but pursuant to Sec. 22-341, it can not be
expanded or intensified, unless approved as a stream setback
intrusion pursuant to FWCC Sec_ 22-1312 (as discussed in
paragraph (1), above*. Without an approved stream setback
intrusion, you could improve the existing structure within its current
building footprint, but no expansion of floor area would be
permitted.
(*Note: a stream setback intrusion under FWCC Sec. 22-1312 is
the appropriate zoning action for this type of proposal, not a
varianceas previously indicated to you by Greg McCormick in a
telephone conversation with you. )

b. (4) The subject property currently contains two separate lots. For
purposes of the proposed development you may eliminate the lot
line to create one parcel; re -locate the lot line; or retain the lot line.
You are not required to remove or re -locate the lot line. However,
zoning requirements such as density, building setbacks, open
space, and landscaping, must be addressed on an individual lot
basis if the property remains in separate lots: If you intend to not
eliminate the lot line, or to re -locate it, staff will further assist you
on related necessary requirements, i.e. boundary line adjustment,
reciprocal parking agreement and stormwater easement.
(5) Per FWCC Sec. 22-667, the project must provide a total of 8,400
square feet (400 square feet times 21 units) of common
recreational open space, usable for many activities. In meeting
this requirement, the proposed open space within the stream
setback area would not be allowed without special approval under
FWCC Sec. 22-1312. Also, Sec. 22-667 establishes dimensional
requirements for the open space. Specifically, when 20 or more
units are provided, 50% of the required open space must be in one
or more pieces, each having a length and width of at least 40 feet.
The proposed on -site open space does not meet this requirement.
Please note other design requirements in FWCC Sec. 22-667
applicable to open space requirements.
(6) The site plan must incorporate dumpster and recycling facilities, as
required by FWCC Sec. 22-949 (enclosed). Contact Federal Way
Disposal for locational comments.
(7) Pursuant to FWCC Article XVII, Landscaping, an approved
landscape plan, prepared in accrordance with this article, is
required for site plan approval. No preliminary landscape plan was
submitted at this time. Generally, the development must provide
the following landscaping:
- Type III landscaping 20 feet in width along all rights -of -way;
- Type III landscaping 10 feet in width along all other lot lines;
- Interior lot landscaping at the rate of 22 SF per stall with 50
or more stalls. For 63 stalls, a total of 1,384 sf is required.
- Parking areas adjacent to rights -of -way must incorporate
berms at least three feet in height within perimeter
landscape areas, or alternatives as specified in the code
(i.e. substantial shrub plantings or architectural features);

-A number of trees on the subject property meet the code definition
of "significant" (i.e, 12" diameter or 37" circumference measured 4-
'/ feet above ground). Significant trees must be retained or
replaced according to FWCC 22-1568.
(8) At time of formal application, a complete set of elevation drawings
must be submitted, along with a statement of design intent
including architectural style, colors and materials.
(9) Refer to the enclosed Developmental Application Submittal
Requirements in preparing your formal land use application.

After reviewing the materials submitted and a visit of the proposed site the following
comments and findings address issues that need to be resolved prior to developing the site.
LAND USE ISSUES
If the applicant proposes to create more than 5,000 square feet of impervious
surfaces, then surface water runoff control and treatment will be required per the
King County Surface Water Design Manual (KCSWDM) and any amendments
thereto.
Additionally, the City has identified downstream conveyance, erosion, and habitat
problems associated with stormwater runoff from the area. As part of the land use
application and SEPA process, the applicant will need to analyze these problems and
provide appropriate mitigation, as approved by the City. The analysis must be a part
of the required downstream analysis submittal for the land use and SEPA review. As
an option, the applicant may voluntarily provide mitigation as recommended in the
Executive Proposed Basin Plan, Hylebos Creek and Lower Puget Sound (Plan). More
specifically,. the proposed project is located within the East Branch Hylebos Creek
Sub -Basin in an area designated to use basin -wide recommendation BW-2 for storm
water control. BW-2 recommends the use of a 2- and 10-year, 7-day design storm in
sizing the required retention/detention (R/D) facility instead of the 24-hour event used
in the KCSWDM. When using a 7-day design storm a modified time of concentration
(without the 30 % safety factor) is used that takes interflow into consideration. The
applicant's engineer may contact the Public Works Department for further details.
2. At the time of the site plan review submittal a narrative addressing the relevance to
the project of the 7 core and the 12 special requirements of the KCSWDM will be
required. A Level I downstream analysis shall also be provided. The city has
available V =100', 5 foot contour, planimetric maps that must be used for basin
analysis. Contact Kevin Peterson, Engineering Technician at 661-4126 for further
details.

3. The proposed driveways may be a maximum of 30 feet wide. (FWCC 22-1542)
Driveways may not be located closer than 150 feet to any street intersection or to any
other driveway, whether on or off the subject property (FWCC 22-1543).
4. The proposed development can not be situated over the existing lot lines. A Lot Line
Elimination or a Boundary Line Adjustment will need to be recorded to remove or
relocate said lot lines.
6. Section 22-1473 of the FWCC requires full width right-of-way improvements along
SW 340th Street and 24th Ave, both residential collectors. The improvements include
both sides of the road and any necessary transitions. Per section 22-1525, this street
classification calls for 2 lanes, the minimum right-of-way width is 50 feet, minimum
paving width is 28 feet with vertical curbs, street lighting, 5 foot sidewalks with a
minimum 4 foot utility/landscaping strip planted with street trees at 30 foot on center
are required.
8. Per section 22-1477 of the FWCC, the applicant may make a written request to the
Public Works Director for a modification, deferment or waiver from the above
requirements. A handout on these procedures is attached.
9. A Traffic Impact Analysis will not be required for the proposed development.
10. The site plan submitted should show the location of any existing and proposed utilities
in the areas affected by construction.
11. Since the site is served;by an on site septic tank system approval by the Seattle -King
County Health Department will be required. Contact Southwest Public Health Center,
1404 Central Avenue South, Suite 101, Kent, WA 98032 (Telephone 296-4666).
BUILDING PERART ISSUES
1. Final site improvement plans will need to be prepared for the project and submitted
with the building permit application. The plans shall be drawn on 24" x 36" size
sheets at a scale of 1" = 20', based on KCAS or NGVD-29 vertical datum and
signed/sealed by a professional engineer licensed in the State of Washington.
2. Provide as -built storm drainage and street improvement plans on mylar per the city's
as -built standard.
3. Prior to issuance of the building permit, payment of engineering review costs, Public
Works inspection fee deposit, and posting of a performance bond is required. A
supplemental administrative fee deposit shall also be provided in accordance with the
table in FWCC section 22-151. A two-year maintenance bond in the amount of 30-
percent of the bond amount will be required after acceptance of on -site and off -site
improvements and as -built plans.
4. The applicant shall reimburse the City for the cost of all required regulatory, warning
and street name signs that are installed prior to acceptance by the City of all other
required improvements.;
5. Copies of Public Works' standard checklists are available upon request to assist the
applicant's engineer and other professionals in preparing plans for review.

WATER SUPPLIES FIR FIRE PROTECTION
The required fire flow for this project is gallons per minute.
A Certificate of Water Availability shall be provided indicating the fire flow available at
the site.
This project will require fire hydrant(s). Existing fire hydrants on public streets
are available for this project. Existing fire hydrants on adjacent properties shall not be
considered unless fire apparatus access roads extend between properties and easements
are established to prevent obstructions of such roads.
When any portion of the facility or building protected is in excess of 150 feet from a
water supply on a public street, as measured by an approved route around the exterior of
the facility or building, on -site fire hydrants and mains capable of supplying the required
fire flow shall be provided. Fire hydrants:
1) Shall be located not more than 300 feet on center. All measurements shall be
made as vehicular travel distance.
2) Shall not be located closer than 50 feet to any building.
3) Shall not be obstructed by any structure or vegetation, nor shall the visibility
of the fire hydrant be impaired for a distance of 50 feet in the direction of
vehicular approach to the fire hydrant. [K.C.F.D. #39 Administrative Policy
Guideline No. 1004]
Fire hydrant locations are subject to the approval of the Fire Marshal or his/her designee.
When exposed to vehicular damage, fire hydrants shall be suitable protected.
Fire hydrants shall be in service PRIOR to the start of combustible construction.
FIRE APPARATUS .ACCE,S ROADS
Fire apparatus access roads shall be provided when any portion of the facility or any
portion of an exterior wall of the first story of the building is located more than 150 feet
from fire apparatus access as measured by an approved route around the exterior of the
building or facility.
EXCEPTION: When buildings are completely protected with an approved
automatic fire sprinkler system, these provisions may be modified by the chief.
Plans for fire apparatus access roads shall be submitted to the fire department for review
and approval prior to construction.
Fire apparatus access roads:
1) Shall have an unobstructed width of not less than 20 feet and an unobstructed
vertical clearance of not less than 13 feet 6 inches.
2) Shall be designed and maintained to support the imposed load of a 25 ton fire
apparatus and shall be provided with a surface so as to provide all-weather driving
capabilities.
3) Shall be not less than a 32 foot inside turning radius and not less than a 40
foot outside turning radius.
4) With a dead-end in excess of 150 feet in length shall be provided with a cul-
de-sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in
diameter.
5) Gradient shall not exceed 12 percent. [K.C.F.D. #39 Administrative Policy

Designated fire lanes may be required for emergency access. This may be done during
the plans check or after the facility is in operation.
When required, approved signs or other approved notices shall be provided and
maintained for fire apparatus access roads to identify such roads and prohibit the
obstruction by parking and other obstructions.
Fire apparatus access road gates .shall comply with K.C.F.D. #39 Administrative
Policy Guideline No. 1003 (copy attached).
Fire apparatus access roads shall be installed and made serviceable PRIOR to and
during the time of construction.
FIRE-1 XTINGUJSHING SYSTEMS
Four (4) sets of plans and specifications for automatic fire -extinguishing systems,
standpipes and their appurtenances shall be submitted to the fire department for review
and approval prior to installation. Plans shall be drawn to an indicated scale, on sheets of
uniform size, with a plan of each floor, and shall show those items listed in Chapter 6 of
1994 Uniform Building Code Volume 3 (UBC Standard 9-1) that pertain to the design of
the system. Sprinkler plans shall bear a Washington State Certificate of Competency
stamp.
An automatic fire sprinkler system shall be installed in all Group R, Division 1,
occupancies having three or more levels or containing five or more dwelling units and
hotels having three or more floor levels or containing ten or more guest rooms. Area
separation walls shall not be considered to separate a building to enable deletion of the
required fire sprinkler system. [Federal Way City Code Chapter 8, Article II, Division
4]
An automatic fire sprinkler system shall be installed in all occupancies requiring 2,000
gpm or more fire flow or where the total floor area included within the surrounding
exterior walls on all floor levels, including basements, exceeds 10,000 square feet. Area
separation walls shall not be considered to separate a building to enable deletion of the
required automatic fire -extinguishing system. [Federal Way City Code Chapter 8,
Article II, Division 4]
The automatic fire -suppression system shall be connected to the fire alarm system (last
zone) in all buildings having an automatic fire detection system.
The total pressure (to the source) required in a hydraulically designed automatic fire
sprinkler system shall be at least 10 per cent less than the stated static P.S.I. from
the appropriate water flow test.
Fire department connections shall comply with K.C.F.D. 39 Administrative Policy
Guideline No. 1002 (copy attached).
AUTOMATIC FII?.E DETECTION SYSTEl1�I
Plans and specifications for fire alarm systems shall be submitted to the fire department
for review and approval prior to system installation. Plans and specifications shall
include, but not be limited to, a floor plan; location of all alarm -initiating and alarm -
signaling devices; alarm control and trouble -signaling equipment; annunciation; power
connection; battery calculations; conductor type and sizes; voltage drop calculations; and
manufacturer, model numbers and listing information for all equipment, devices and
materials.
Fire alarm systems, automatic fire detectors, emergency voice alarm communication
systems and notification devices shall be designed, installed and maintained in accordance
with U.F.C. Standards 10-2 and 10-3 and other nationally recognized standards.
Systems and components shall be listed and approved for the purpose for which they are
installed.
An automatic fire detection system shall be installed in all buildings exceeding 3,000
square feet gross floor area. This fire detection system shall be monitored by a central
and/or remote station conforming to the current requirements of the National Fire
Protection Association standards and/or the fire chief or designee. [Federal Way City

Group R, Division 1 Occupancies shall be provided with a manual and automatic fire
alarm system in apartment houses three or more stories in height or containing 16 or
more dwelling units, in hotels three or more stories in height or containing 20 or more
