The site is located on parcel 614360-0560. The City received your application on December 29, 2006. The City deemed the application complete on January 18, 2007. During the course of review the City sent a request -for - information letter, to which you responded with a resubmittal on April 11, 2007. The City of Federal Way hereby grants preliminary approval of the Graham Short Plat, subject to the conditions noted below. This approval corresponds to the Short Plat Map, date -stamped as received June 5, 2007. You may now proceed with engineering design. This Decision of the Director is based on the enclosed Statement of Facts and Conclusions and in accordance with decision criteria listed in FWCC Section 20-93. This preliminary approval of the short plat does not constitute approval for land clearing or grading, vegetation removal, or any other activities which otherwise require permits from the City. Prior to construction of any improvements, the applicant must apply for engineering approval for all road improvements, storm drainage facilities, and appurtenances. The engineering plans will be reviewed by the Public Works Department and Lakehaven Utility District. No permits or authorization to begin construction or site work will be granted until the final approval of all engineering plans, the payment of all fees, and the submittal of performance securities, as may be required. APPEAL PROCESS Pursuant to FWCC Section 20-94, any person who receives a copy of this decision may appeal the decision within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services by 5:00 PM, June 22, 2007, at the following address: City of Federal Way, 33325 81h Avenue South, PO Box 9718, Federal Way, WA 98063. An appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusions of the Director of Community Development Services disputed by the person filing the appeal, and must include the appropriate appeal fee. Any additional requirements of FWCC Section 20-94 must be followed. Mr. Graham June 8, 2007 Page 2 SEPA THRESHOLD DETERMINATION Pursuant to the State Environmental Policy Act (RCW Chapter 43.21 C), the proposal is exempt from SEPA review. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, notwithstanding any program of revaluation. DURATION OF APPROVAL Short Plat approval shall expire one year from the date of issuance of this decision. However, the applicant may submit a written request in the form of a letter with supporting documentation to the Department of Community Development Services requesting a one-time extension of this limit of up to one year, pursuant to FWCC Section 20-107. OTHER AGENCY PERMITS The applicant is responsible for identifying and obtaining all required state, federal, or other agency permits, as may be required. RECORDING OF THE SHORT PLAT MAP One final signed mylar of the BLA and three paper copies, along with the recording fee of $104 is required by the City of Federal Way. (King County charges $98 to record the first sheet and $5 for each additional sheet, with an additional $1 for a conformed copy of the recorded mylars.) Statement of Proposal — Proposal is to subdivide one, 21,000 square -foot lot into two lots. Lot "1" will be 9,600 square feet. Lot "2" will be 11,376 square feet. Review Process — Pursuant to the Federal Way City Code (FWCC), the proposed short plat is permitted, subject to administrative review and a Decision of the Director of Community Development Services, as described in FWCC Chapter 20. The proposal has been reviewed by staff from the City's Planning Division, Building Division, and Public Works Department, as well as the Lakehaven Utility District and South King Fire and Rescue_ 3. Zoning — The site is located in a Single -Family Residential (RS) 9.6 zone (a zone with a minimum lot size requirement of 9,600 square feet). The proposal meets the density requirement as noted below. The zoning chart for this zone (FWCC Section 22-631) lists setback and lot coverage requirements. Future building permit applications will be reviewed for compliance with this zoning chart. As conditioned, the proposed lots meet the minimum requirements of the zone. 4. Comprehensive Plan — The site is designated as Single Family — High Density in the Federal Way Comprehensive Plan (FWCP). The proposal is in compliance with the FWCP and related criteria listed in FWCC Section 20-2. 5. SEPA — Consistent with Section 20-87 of the FWCC, the project is categorically exempt from the State Environmental Policy Act (SEPA) process (WAC 197-11-900). 6. Lot Design (FWCC Section 20-152) — All lots of the proposal abut a public street right -of --way. Access to all lots will be via a paved 15-foot easelnent created by this short plat extending from 380' Avenue South. All easements and utilities will be provided. 7. Density — Pursuant to FWCC Section 20-153, "All lots in conventional subdivisions shall meet the density and minimum lot size requirements of Chapter 22 FWCC." Calculation of density in subdivisions shall not include streets or vehicle access easements. The existing lot is 21,000 square feet. The proposal still meets the minimum density requirement. 8. Open Space and Recreation (FWCC Section 20-155) — In response to case law, the City of Federal Way has determined that it will not require open space for short plats. 9. View Considerations (FWCC Section 20-157) — No adverse view impacts are anticipated. 10. The proposal, as conditioned, will be consistent with the FWCP, all applicable provisions of the FWCC, and will not adversely impact public health, safety, and welfare_ Thus, the project meets all decisional criteria for short plats as found in FWCC Chapter 20. The project is considered complete as it has been exempt from Concurrency and a Street Modification request was received. Following are preliminary technical comments for the project: 1. At a minimum, the first 40 feet of the driveway must be paved. 2. Construct the required shoulder improvements as indicated in the response to the street modification request. 3. Based on a field visit it appears that sight distance is obstructed by vegetation north of the proposed driveway(s). Please submit an intersection sight distance analysis at the short plat proposed access driveway intersections with 38th Avenue S. The analysis shall bear the seal of an engineer licensed in the state of Washington. The sight distance triangle shall be depicted on the plan set. 4. Please provide photo documentation within the report of the sight distance analysis. The photo must show the location of the sight distance standard in the picture as well as the location of the viewer. Plan sheets within the report should also provide the site distance documentation. State if the sight distance requirements are met or not and provide any required safety mitigation measures. 5. At a minimum, the first 40 feet of the driveway must be paved. 2. Construct the required shoulder improvements as indicated in the response to the street modification request. Based on a field visit it appears that sight distance is obstructed by vegetation north of the proposed driveway(s). We understand that you propose to subdivide the site into two lots for residential development. The proposed layout of the site is shown on the Site Plan, Figure I. Soils mapped in the SCS for the site consist of Ag13, Alderwood soils. These soils are typically derived from glacial till and have a very low infiltration capacity. These soils are typically classified as a "D" soil. A copy of the SCS map for the area is included as Figure 2. We completed two test pits in the west portion of the site for driveway stormwater runoff, Figure 1. The soils encountered in the test pits consisted of approximately 3 to 5 feet of weathered medium dense glacial till over undisturbed very dense glacial till. Although no groundwater seepage was observed, localized mottling was observed in the lower portion of the weathered till. Copies of the test pit logs are included as Figure 3. It is therefore our opinion that infiltration of stormwater is not practical at this site. If required, very shallow systems can be utilized in the weathered soil horizons, however overflow systems should be included in the design, and discharge to the road side ditch that flows to the lake. Roof runoff may be dispersed via splash blocks. This will closely match the existing conditions at the site. We appreciate the opportunity to be of service to you on this project. The purpose of this Drainage Assessment Letter is to illustrate that this Short Plat falls under the "Small Site Drainage Requirements" as set forth under the 1998 King County Surface Water Design Manual (KCSWDM). EXISTING CONDITIONS The existing Parcel Number is 614360-0560 and is located at 32829 - 381h Avenue South. The total parcel area is 20,976 square feet (0.48 acres). The parcel will be divided into two separate lots, Lot 1 and Lot 2 being 9,600 square feet and 11,376 square feet respectively. The parcel is currently undeveloped with fourteen trees ranging from ten inches to 48 inches in diameter, of which 12 are considered "significant". The site slopes at approximately 5% from east to west towards 38th Avenue South. There is an existing pond within Tract B of the "Plat of Northlake Ridge Division 2". The pond discharges through a closed conveyance pipe through the Short Plat Parcel to an existing catch basin located along 38th Avenue South. See Sheet 2 of 2 of the attached Preliminary Plat for the location and Auditors Fee Number for the 15 foot wide storm drainage easement. PROPOSED CONDITIONS Lot 1 consists of 11,376 square feet. There is an existing gravel driveway of approximately 2,520 square feet. The proposed shared driveway will consist of 20 feet of pavement with a five foot buffer/landscape strip on both sides of the driveway up to Lot 2 and 12 feet of pavement and five feet of buffer/landscape strip thereafter. The total proposed driveway impervious area will be approximately 2,900 square feet. This includes the driveway approach and minor shoulder improvements along 38t" Avenue South. Lot 2 consists of 9,600 square feet. The total amount of impervious area for both lots will be approximately 9,440 square feet including a 50% credit for the existing gravel drive, which is less than the 10,000 square foot limit for a small site drainage review. See the breakdown of areas below. Oro Per Figure C.2.A, Flowchart for Determining Small Site Flow Control Requirements, we propose to use perforated stub outs due to the existing site constraints. Per the Figure, the site is less than two acres, the Short Plat Lots or existing parcel is not larger than 22, 000 square feet and the soils appear not to be suitable for infiltration. Each lot does not lend itself to dispersion to provide a minimum of 50 feet for a vegetated flow path. Per the attached documentation, the Soil Conservation Service (SCS) maps this area as Alderwood gravelly sandy loam (AgB), a Class C soil. Due to the typical soil characteristics of Alderwood, we anticipate infiltration will not be feasible for this site. A soils report will be submitted once the initial Preliminary Plat review has been completed. Since the soils are Class C, some infiltration is expected. We proposed to use Perforated Tightlined trench connections to the existing storm drainage system for the driveway and roof areas. Each driveway and roof will have separate perforated tightlined trenches. The runoff from each driveway will sheetflow to a slotted drain or shallow swale across the driveway and be tightlined to the perforated trenches of approximately two feet wide by 15 feet in length, per Figure C.2.1 (Perforated Tightfine Connection), of the 1998 KCSW DM. A catch basin with a down turned elbow or tee structure will provide spill control for the driveways. Each perforated trench will discharge to the existing closed drainage system running through Lot 1. It will then be conveyed to the conveyance system in 38th Avenue South where it flows North and then West to North Lake. Since the runoff through the closed conveyance systems will be directly discharged to the existing 38th Avenue South conveyance system, overflow will not be a concern. At the downstream end of each driveway and roof trench system, a yard drain or catch basin with a grate will be provided as an emergency overflow device if the four inch to six inch closed conveyance system becomes clogged due to lack of maintenance. There are no offsite downstream structures or features that will be impacted by the additional flow that we are aware of. Each lot will be served by a separate sewer system. Both lots will have a grinder pump system that will discharge into the nearby sanitary sewer system. Therefore, there will be no potential impacts to on -site septic sewage disposal systems. City of Federal Way December 29th, 2006 Page 3 of 3 This Short Plat is a simple division of property with very little onsite and offsite improvements. Minimal grading is expected for the construction of the driveways. Several trees are expected to be removed in order to provide adequate building envelopes. Temporary Erosion and Sedimentation Control measures consist of a rock construction entrance, silt fence and catch basin protection. It is similar to Alde-rwood gravelly sandy loam, 6 to 15 percent slopes, but in places its surface layer is 2 to 3 inches thicker. Areas are irregular in shape and range from 10 acres to slightly more than 600 acres in size. Some areas are as much as 15 percent included Norma, Bellingham, Tukwila, and Shalcar soils, all of which are poorly drained; and some areas in the vicinity of Enumclaw are as much as 10 percent Buckley soils. Runoff is slow, and the erosion hazard is slight. This Alderwood soil is used for timber, pasture, berries, and row crops, and for urban development. Capability unit IVe-2; woodland group 3d2. Alderwood gravelly sandy loam., 15 to 30 perceni slopes (AgA) .--Depth to the substratum in this soil varies within short distances, but is commonly about 40 inches. Areas are elongated and range from 7 to about 250 acres in size. Soils included with this soil in mapping make up no more than 30 percent of the total acreage. Some areas are up to 25 percent Everett soils that have slopes of 15 to 30 percent, and some areas are up to 2 percent Bellingham, Norma, and Seattle soils, which are in depressions. Some areas, especially on Squak Mountain, in Newcastle Hills, and north of Tiger Mountain, are 25 percent Beausite and Ovall soils. Beausite soils are underlain by sandstone, and Ovall soils by andesite. Runoff is medium, and the erosion hazard is severe. The slippage potential is moderate. This Alderwood soil is used mostly for timber. Some areas on the lower parts of slopes are used for pasture. Capability unit VIe-2; woodland group 3d1. Alderwood and Kitsap soils, very stee (AkF).-- This mapping unit is about 50 percent Alderwood gravelly sandy loam and 25 percent Kitsap silt loam. Slopes are 25 to 70 percent. Distribution of the soils varies greatly within short distances. About 15 percent of some mapped areas is an included, unnamed, very deep, moderately coarse textured soil; and about 10 percent of some areas is a very deep, coarse -textured Indianola soil. Drainage and permeability vary. Runoff is rapid to very rapid, .and the erosion hazard is severe to very severe. The slippage potential is severe. These soils are used for timber. Capability unit VIle-1; woodland group 2dl. 10 Areiits, Alderwood Material Arents, Alderwood material consists of Alderwood soils that have been so disturbed through urban- ization that they no longer can be classified with the Alderwood series. These soils, however, have many similar features. The upper part of the soil, to a depth of 20 to 40 inches, is brown to dark - brown gravelly sandy loam. Below this is a grayish - brown, consolidated and impervious substratum. Slopes generally range from 0 to 15 percent. These soils are used for urban development. Arents, Alderwood material, 0 to 6 percent slopes (AmB).--In many areas this soil is level, as a result of shaping during construction for urban facilities. Areas are rectangular in shape and range from 5 acres to about 400 acres in size. The upper, very friable part of the soil extends to a depth of 20 to 40 inches and ranges from dark grayish brown to'dark yellowish brown. Some areas are up to 30 percent included soils that are similar to this soil material, but either shallower or deeper over the compact substratum; and some areas are 5 to 10 percent very gravelly Everett soils and sandy Indianola soils. This Arents, Alderwood soil is moderately well drained. Permeability in the upper, disturbed soil material is moderately rapid to moderately slow, depending on its compaction during construction. The substratum is very slowly permeable. Roots penetrate to and tend to mat on the surface of the consolidated substratum. Some roots enter the substratum through cracks. Water moves on top of the substratum in winter. Available water capacity is low. Runoff is slow, and the erosion hazard is slight. This soil is used for urban development. Ca- pability unit IVe-2; woodland group 3d2. Arents, Alderwood material, 6 to 15 percent slopes (AmC).--This soil has convex slopes. Areas are rectangular in shape and range from 10 acres to about 450 acres in size. �l DESCRIPTIONS OF THE SOILS This section describes the soil series and map- ping units in the King County Area. Each soil series is described and then each mapping unit in that series. Unless it is specifically mentioned otherwise, it is to be assumed that what is stated about the soil series holds true for the mapping units in that series. Thus, to getfull information about any one mapping unit, it is necessary to read both the description of the mapping unit and the description of the soil series to which it belongs. An important part of the description of each soil series is the soil profile, that is, the sequence of layers from the surface downward to rock or other underlying material. Each series contains two descriptions of this profile. The first is brief and in terms familiar to the layman. The second, detailed and in technical terms, is for scientists, engineers, and others who need to make thorough and precise studies of soils. Unless it is otherwise stated, the colors given in the descriptions are those of a moist soil. As mentioned in the section lgiow This Survey Was Made," not all mapping units are members of a soil series. Urban land, for example, does not belong to a soil series, but nevertheless, is listed in alphabetic order along with the soil series. Following the name of each mapping unit is a symbol in parentheses. This symbol identifies the mapping unit on the detailed soil map. Listed at the end of each description of a mapping unit is the capability unit and woodland group in which the mapping unit has been placed_ The woodland desig- nation and the page for the description of each capability unit can be found by referring to the "Guide to Mapping units" at the back of this survey. The acreage and proportionate extent of each mapping unit are shown in table 1. Many of the terms used in describing soils can be found in the Glossary at the end of this sun'ey, and more de- tailed information about the terminology and methods of soil mapping can be obtained from the Soil Survey Manual (19) . Alderwood Series The Alderwood series is made up of moderately well drained soils that have a weakly consolidated to strongly consolidated substratum at a depth of 24 to 40 inches. These soils are on uplands. They formed under conifers, in glacial deposits. Slopes are 0 to 70 percent. The annual precipitation is 35 to 60 inches, most of which is rainfall, between October and May. The mean annual air temperature is about 50° F. The frost -free season is 150 to 200 days. Elevation ranges from 100 to 800 feet. In a representative profile, the surface layer and subsoil are very dark brown, dark -brown, and grayish -brown gravelly sandy loam about 27 inches thick. The substratum is grayish -brown, weakly consolidated to strongly consolidated glacial till that extends to a depth of 60 inches and more. Alderwood soils are used for timber, pasture, berries, row crops, and urban development. They are the most extensive soils in the survey area. Alderwood gravelly. sandy, loam, 6 to 15 percent Slopes (AgCT'.-__n.i3 soil is rolling. Areas are irregular in shape and range from 10 to about 600 acres in size. B2--2 to 12 inches, dark -brown (10YR 4/3) gravelly sandy loam, brown (10YR 5/3) dry; moderate, medium, subangular blocky structure; slightly hard, friable, nonsticky, nonplastic; many roots; strongly acid; clear, wavy boundary. 9 to 14 inches thick. B3--12 to 27 inches, grayish -brown (2.5Y 5/2) gravelly sandy loam, light gray (2.5Y 7/2) dry; many, medium, distinct mottles of light olive brown (2.5Y 5/6); hard, friable, non - sticky, nonplastic; many roots; medium acid; abrupt, wavy boundary. 12 to 23 inches thick. IIC--27 to 60 inches, grayish -brown (2.5Y 5/2), weakly to strongly consolidated till, light gray (2.5Y 7/2) dry; common, medium, distinct mottles of light olive brown and yellowish brown (2.5Y 5/6 and IOYR 5/6); massive; no roots; medium acid. Many feet thick. The A horizon ranges from very dark brown to dark brown. The B horizon is dark brown, grayish brown, and dark yellowish brown. The consolidated C horizon, at a depth of 24 to 40 inches, is mostly grayish brown mottled with yellowish brown. Some layers in the C horizon slake in water. In a few areas, there is a thin, gray or grayish -brown A2 horizon. In most areas, this horizon has been destroyed through logging operations. Soils included with this soil in mapping make up no more than 30 percent of the total acreage. Some areas are up to 3 percent the poorly drained Norma, Bellingham, Seattle, Tukwila, and Shalcar soils; some are up to 5 percent the very gravelly Everett and Neilton soils; and some are up to 15 percent Alderwood soils that have slopes more gentle or steeper than 6 to 15 percent. Some areas in New- castle Hills are 25 percent Beausite soils, some northeast of Duvall are as much as 25 percent Ovall soils, and some in the vicinity of Dash Point are 10 percent Indianola and Kitsap soils. Also included are small areas of Alderwood soils that have a gravelly loam surface layer and subsoil. PLANNING DIVISION (Deb Barker, 253-835-2642, deb.barker@cityoffederalway.com) Short Plat Process— Pursuant to FWCC Chapter 20, Article I1, Division 5, "Short Subdivision Plats," short plat applications are administratively processed through the Department of Community Development Services under FWCC Section 20-83, et al. The administrative review process requires that the Director of Community Development issue a decision on the short subdivision request. Public notice of the complete short plat proposal is required per FWCC Section 20-90, and a 14-day public comment period is provided. However, no public hearing will be required. A master land use application, short plat handout, and code sections are enclosed. 2. State Environmental Policy Act (SEPA) —This proposal is exempt from environmental review under SEPA. Fees — The land use fees for a'short plat application are as follows (additional utility fees, school impact fees, and engineering plans review fees may apply): Short Plat Filing Fee: $2,131.50 4_ Lot Size — The zoning for the subject site is Residential Single -Family, RS-9.6_ Minimum lot size for all lots is 9,600 square feet_ As depicted, the proposed lots satisfy the minimum lot size requirements. Lot size, however, is calculated after any required right-of-way dedication. Please see comments below under Traffic Division headin . l 1 a k) O-Je - r r�-i =5 Y1 0 5_ Design Criteria — Pursuant to FWCC Section 2r152, all lots should be of ample dimensions to provide a regular -shaped building area that meets required setbacks; all lots should be designed to provide access for emergency apparatus; and all lots should abut a public street right-of-way. The proposed lots appear to satisfy these design criteria. Please be advised that the "flag lot" driveway on parcel B shall be a minimum of twenty-two feet 'in width to provide for a one-way driveway twelve feet in width with five-foot side yards on either side. Setbacks — Existing and future residences must conform to the following structural setback requirements of FWCC Section 22-631, "Detached Dwelling Units" (enclosed): front yard, 20 feet; side yard, five feet; and rear yard, five feet. The short plat must depict these typical building setback requirements. Lot coverage for residential uses is limited to 60 percent and includes al] impervious surfaces such as driveways, walkways, patios; and roof overhangs. 7. Driveways — Driveways must meet a five-foot setback from side property lines within the 20-foot front yard setback_ As noted above, dimensions for flag driveways are minimum 22 feet wide for one-way driveway and 30 feet for two-way driveway, and includes five-foot side yards. 8. Open Space — Based on recent state case law, the City has determined that the open space requirements of FWCC Section 20-155, do not apply to short plat applications. As such, no open space is required for this application. 10. Significant Trees — The plat drawing must indicate any significant trees on the site, and whether they are proposed to remain -or be removed_ Any trees and vegetation on the site meeting the definition of significant must be retained to the maximum extent possible in accordance with the City's subdivision ordinance (FWCC Section 20-179, enclosed). Significant trees are defined as 12 inches in diameter or 37 inches in circumference, measured 4%2 feet above the ground, in good health, and not detrimental to the community. Significant trees do not include red alder, cottonwood, poplar, or big leaf maples. Significant trees shall be flagged, and protection techniques for retained significant trees shall be identified in areas proposed to be disturbed. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732, ann.dower@cityoffederalway.com) Land Use Issues — Stormwater I _ Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 1998 KCSWDM. Staff anticipates that Iess than 10,000 square feet of new impervious area Vvill be created with this proposal. If that is the case, this project will qualify for Small Site Drainage Review - Along with the relimina lat application,,the applicant will be required to submit a drainage review examining the site layout, topography, proposed impervious area, and soil conditions. Based on these factors, the application must propose both temporary erosion control measures to be used during construction, and permanent flow control methods for runoff generated by driveways and roofs. Best Management Practices (BMPs), outlined in Appendix C of the KCSWDM, may be used if all design criteria can be met_ 2. The project lies within a Level 1 flow control area and Basic Water Quality Area. If the project generates more than 10,000 square feet of new impervious area (including frontage improvements), or if BMPs cannot be used for this site, then flow control and water quality facilities must be designed to meet, this performance criteria. Detention and water quality facilities for short plats must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 3. Infiltration is the preferred flow control method_ Sol] logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability - Right -of -Way Improvements See the Traffic Division comments from Maryanne Zukowski, Senior Traffic Engineer, for traffic related items_ Building (or EN) Permit Issues Engineered plans are required for clearing, grading, road construction, drainage, and utility work_ Plans must be reviewed and approved by the City. In addition to engineering approval, short plats and subdivisions are required to obtain a separate pen -nit for grading. Details and fees may be obtained from the Federal Way Building Department_ 3. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR_ 4. Bonding is required for all improvements associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements_ An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 5. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. 6. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N_G_V.D.-29" or "DATUM: K.C_A_S.," on all sheets where vertical elevations are called out. 7. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper_ All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1 " = 20', or larger. Architectural scales are not permitted on engineering plans. 8. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 1998 KCSWDM, must also be shown. 9. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. 10. Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements in meeting the FWCC. Based on the analysis and FWCC, the applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: 38'h Avenue South is planned as a Type "S" street, consisting of a 36-foot street with curb and gutter, four -foot planter strips with street trees, five-foot sidewalks, and street lights in a 60-foot right-of-way. No additional right-of-way is required. Staff will support a right-of-way modification based upon the existing pavement section not centered within the right-of-way. In lieu of frontage improvements the applicant will be required to improve the shoulder area for the continuous parking strip. Staff will support a right-of-way modification request application for the frontage improvements that includes improvements to the existing shoulder as the existing pavement is not centered within the existing right-of-way. The applicant must submit a right-of-way modification request form. Figure C.2 provides guidelines for determining appropriate BMPs for the proposed project. The type of system(S) used will depend on the lot size, soil type, setback requirements, and topography of the site. In addition, if an onsite sewage system will be used, flow control BMPs must be designed to maintain setbacks and proper functioning of that system. The BMPs in this appendix are designed to mitigate changes in surface water runoff. Flow control BMPs should not be connected to sub -surface drains (e.g., footing drains, French drains, etc.) as these connections may adversely affect the performance of the BMPs, and in some cases may cause reverse flow into the footing drains during storm events_ Note: Projects which require Targeted Drainage Review may be required to submit engineering plans (site improvement plans, erosion control plans, and a technical information report) signed and stamped by a professional engineer registered in the State of Washington to address drainage issues not covered by this appendix. Native growth open space BMPs are required for small site projects over 2 acres in size (see Section C.2.2, p. C-9). The open space shall be protected in a separate tract or through easement on individual lots. Projects that set aside open space may qualify for tax relief under the Public Benefit Rating System. Dispersion or infiltration BMPs are required for small site proposals applying for single family residential building permits or short plats except in the following case: If the existing lot is smaller than 22,000 square feet, or if the short plat creates lots less than 22,000 square feet, then infiltration is required if suitable soils are present. If soils will not support infiltration, then other flow control BMPs must be considered. If site constraints make dispersion and infiltration unfeasible, then the site may be connected to the storm drainage system with perforated tightline connection (see Section C.2.5, p. C-23). The intent of small site flow control requirements is to reduce runoff leaving the site to the greatest extent practical, given constraints of the site. For large single family residences on large lots, or rural short plats creating large lots, retaining open space with native vegetation combined with flow dispersion BMPs should be functional, inexpensive, and easy to construct and locate on the site. However, urban short plats creating small lots will likely not be able to meet design specifications for dispersion for all added impervious surface (e.g., driveways). In these cases, flow control BMPs are required to the extent achievable. In all cases, DDES review staff must approve the use of small site BMPs for the proposed project. If the project cannot incorporate the small site BMPi, or if there is a potential for impacts to a neighboring property, then additional drainage review and engineered mitigation may be required. C.2.1 DESIGN SPECIFICATIONS FOR SMALL SITE FLOW CONTROL BMPS The following sections contain detailed information on small site flow control BMPs. These are divided into four basic types: open space retention (for larger lots), dispersion, infiltration, and perforated tightline connections. Feasibility of dispersion and/or infiltration must be evaluated before use of a perforated tightline connection can be considered- If none of the BMPs can be effectively applied to the site or there are additional drainage concerns, a professional engineer may be required to provide a workable drainage design and plan. They are a last resort, and are appropriate on sites so small or constrained that dispersion will be ineffective or will create problems on neighboring properties. Perforated tightline connections are intended to provide for some infiltration during drier periods (late spring through early fall). During the wet winter months, these BMPs may provide little to no flow control or water quality benefits. Typical Uses: Flows from impervious surfaces on small urban lots where vegetated flowpaths are not available for surface dispersion and where infiltration is not feasible. Design Specifications Connection to a storm drainage system with perforated pipe can be used for all types of impervious surface. Figure C-2.1(p. C-24) provides details on perforated tightline connections. Perforated tightline connections must be placed using the following constraints: • The perforated stub -out connection shall be placed in native soil to maximize infiltration and dispersion of water. • Setbacks from features other than septic systems shall be as listed in Reference Section B. Note: To facilitate maintenance, the perforated pipe portion of the system may not be located under impervious or heavily compacted (e_g., driveways and parking areas) surfaces. • Runoff discharge toward landslide hazard areas must be evaluated by a geotechnical engineer or a qualified geologist. The perforated portion of the pipe may not be placed on or above slopes greater than 20% or above erosion hazard areas without evaluation by a geotechnical engineer or qualified geologist and DDES approval. • For sites with septic systems, the discharge point must be downgradient of the drainfield primary and reserve areas. This requirement can be waived by DDES permit review staff if site topography will clearly prohibit flows from intersecting the drainfield. See Reference B for a summary of SKCDPH onsite sewage system requirements. Mbugua and Sophea Hay (the "Grantor"), for and in consideration of $10.00 (ten and no/100 dollars), hereby dedicate, convey, and grant to Mark J. and Janine N. Springall and Haggai Homes, LLC (the "Grantee") and their heirs, successors, and assigns a permanent non-exclusive easement for sewer lines and appurtenances thereto upon the following described property situated in King County, Washington, legally described as follows: Nature and Location of Easement: Grantor's property (the "Real Property") is legally described in Exhibit A, attached hereto and incorporated herein by this reference. The easement granted by Grantor (the "Easement") herein shall be a permanent non-exclusive easement for the benefit of Grantee over, upon, across, through, and under the portion of Grantor's property as legally described in Exhibit B and as graphically depicted on Exhibit C, both attached hereto and incorporated herein by this reference. The Easement shall be for the purposes of installing, laying, constructing, maintaining, inspecting, repairing, removing, replacing, renewing, using, and operating sewer lines, together with all facilities, connectors, and appurtenances (the "Sewer Lines"), including the right of ingress and egress for said purposes. 2. Right of Entry: Grantee shall have the right, without notice and without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property and adjoining property owned by Grantor and their heirs, successors, and assigns to install, lay construct, renew, operate, and maintain lines and necessary facilities and other equipment for the purposes of serving the property and other properties with sewer service. Grantee agrees to restore the Easement area, as nearly as possible, to its condition prior to any disturbance from construction, operation, maintenance, repair, or replacement of the Sewer Lines. 3. Encroach ment/Construction Activity: Grantor shall hdt Undertake, authorize, permit, or consent to any construction or excavation, including, without limitation, digging, tunneling, or other forms of construction activity on or near the Easement which might in any fashion unearth, undermine, or damage the Sewer Lines or endanger the lateral or other support of the Sewer Lines without Grantee's prior written approval. Grantor further agrees that no structure or obstruction, including, without limitation, fences and rockeries, shall be erected over, upon, or within the Easement, and no trees, bushes or other shrubbery shall be planted or maintained within the easement. Grantor shall have full use of the surface of the Real Property within the Easement, so long as such use does not interfere with the Easement or the Sewer Lines. 4. Bindinq Effect/Warrant of Title: The Easement and the covenants, terms, and conditions contained herein are intended to and shall run with the Real Property and shall be binding upon Grantee and Grantor and their respective successors, heirs, and assigns. At this meeting we talked to Maryanne Zukowski of the Traffic Division who suggested the Staff would support a right of way modification. In lieu of frontage improvements, we would be required to improve the shoulder adjacent to the property. You will notice by your site visit that there are no curb, gutters and sidewalks along this road in the nearby vicinity of this proposed development. Therefore, these improvements would not be harmonious with the existing street. If a sidewalk was provided in this location to encourage pedestrians to walk in this area, they would only walk approximately 80 feet and would be directed back onto 38"1 Street with very little shoulder and potentially unsafe situation. Therefore, as suggested by Maryanne Zukowske, we are requesting a waiver from this requirement. You prompt response would be appreciated.
